SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 17, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 8, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. In August 2018 a request to construct additions and alterations to an existing single-family dwelling was reviewed and recommended as consistent. Since then the landowner demolished the dwelling. The parcel is located within the Coastal Erosion Hazard area and in the past has suffered erosion and land loss due to storm events and wave action. The coordinator supports relocating the structures outside vulnerable areas and as far from natural features as practicable. However, the applicant's builder testified that the partially re-built dwelling re-used the existing foundation that had been legally built. Therefore, it is impractical to ask the applicant to move the structure, and with the conditions imposed herein, the application is determined to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The applicant's parcel is a non-conforming 14,323 square feet waterfront lot located in the R-40 Zoning District and measures 68.04 feet along Orient Harbor with a western lot line measuring 222.67 feet shared with a neighboring residence to 67.34 feet along South Lane and then running south 179.37 feet along a second neighboring residence to the east. The lot is improved with a 2-story wood frame house, garage and covered front porch along with an asphalt driveway, brick walkway and brick patio, split-rail fencing on the east and west lot lines, and the remains of wood deck steps and bulkheading on the waterside as represented on the survey prepared by Nathan Taft Corwin III,Land Surveyor and last revised November 12,2018. BASIS OF APPLICATION: Request for Variances under Article XXIII, Section 280-124; and the Building Inspector's November 8, 2018, Amended November 13, 2018 Notice of,Disapproval based on an application for a Page 2,May 23,2019 #7263,Patinella SCTM No. 1000-38-6-12 permit to demolish an existing single family dwelling and construct a new single family dwelling, at; 1) less than the code required minimum side yard setback of 10 feet, 2) less than the code required minimum total side yard setback of 25 feet, 3) more than the code permitted maximum lot coverage of 20%; at: 440 South Lane, East Marion,NY. SCTM#1000-38-6-12. RELIEF REQUESTED: The applicant requests three variances for demolition, re-construction, and expansion to the subject residence in order to expand the existing footprint of the house by adding a front covered porch measuring 21.5 feet by 10.9 feet, extending the depth of the garage by approximately 5 feet by 16 feet and squaring off the northwest conger of the home for additional living space measuring approximately 3.5 feet by 9 feet. The total increase of the footprint of the interior living space, as applied for, is approximately 379 square feet. At its closest point,the northwest corner of the structure will be 9.6 feet from the property line where the Code requires a minimum of 10 feet. The applicant's combined side yard setback will be 20 feet where the code requires a 25-foot combined side yard setback. Additionally, when completed the lot coverage for these alterations and additions will represent 21.8%where the Code limits such improvements to 20%. ADDITIONAL INFORMATION: One of the applicant's neighbors spoke in favor of the application. The applicant's survey illustrates a building area of approximately 10,473 square feet north of the Coastal Erosion Hazard Line while the lot size is 14,323 square feet, overall. Proposed additions and alterations include reducing the Code conforming front-yard setback from 69.6 feet to 65.7 feet and adding second floor living space over the garage. During the May 3, 2018 public hearing, the applicant's representative was requested to reduce the proposed excessive lot coverage, to bring the application into more conformity with the Code, and to provide examples of supporting Zoning Board of Appeals decisions regarding excessive lot coverage. The applicant's agent responded on May 8, 2018 with eight Zoning Board of Appeals decisions granting relief for excessive lot coverage in the immediate vicinity and did not alter the application. The applicant's representative also provided Zoning Board of Appeals file #2282 granted June 23, 1977 as a supporting document illustrating relief for a reduced side yard setback in the immediate vicinity of South Lane, East Marion, during the public hearing. On July 18, 2018 the applicant was issued a Wetland Permit to construct additions to the existing two-story dwelling with an attached garage and covered porch addition as well as other improvements. Since then the applicant demolished the dwelling and will need to return to the Board of Trustees for further permits. EVENTS DURING CONSTRUCTION: During the course of construction the applicant's builder demolished the existing structure leaving only the sub-floor, floor joists, box, and foundation. This demolition of more than 50% of the value of the structure exceeded the variance relief for additions and alterations granted in ZBA decision number 7157. The Building Department issued a stop work order and referred the applicant to apply to the ZBA for variance relief for a demolition and the re-construction of a new dwelling. While the stop work order was in effect the Building Department verbally granted the applicant limited approval to make the house weather tight so that the"as-built"structure was not damaged by inclement weather while working through the appeal process. During the public hearing on April 11, 2019 the applicant's builder testified that upon the start of work he discovered a masonry/brick wall behind the sheetrock and siding. The building inspector confirmed that he observed some sort of brick/masonry structure behind the walls. The builder testified that it was impossible to work around the existing masonry walls and frame the new window layout. The builder demolished the entire house except the existing foundation, box, floor joists, and sub-floor in place. The builder had started framing the new structure when the stop work order was issued. The builder further testified that although the architect's plans did not show substantial demolition the builder knew from experience that he would have to demolish large sections of the walls in order to install the new windows and that he estimated building new walls into the project prior to starting construction. Page 3, May 23,2019 #7263,Patinella _ SCTM No. 1000-38-6-12 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 11, 2019 and May 9, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. South Lane and the surrounding Old Orchard neighborhood, along with adjacent Gardiner's Bay Estates is a small-scale bayfront community of homes developed over the mid- to-late 20t" Century. Most homes in the immediate area are developed on smaller, non-conforming lots created prior to current zoning, the majority of which have been renovated and expanded to meet modern needs. The applicant's proposed alterations will not alter or change the character of the neighborhood as the two-story residence is existing and the proposed reconstruction will not be easily discernable from the private road nor from the waterfront. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The previously existing home stood for nearly 50 years without incident and was constructed on an angle, parallel to the east and west lot lines, to take advantage of the view. The application proposes an increased footprint of approximately 379 square feet, the majority of which, 230 square feet, is for a covered front porch. The applicant is re-using the existing foundation and therefore will maintain the same non-conforming setbacks as applied for herein. 3. Town Law $267-b(3)(b)(3). The variance granted herein for the single side yard setback is not mathematically substantial, representing 5% relief from the code. The variances granted herein for the combined side yard setback and lot coverage are mathematically substantial, representing 20% relief from the code for the combined side yard setback and 10.9% relief from the code regarding lot coverage. However, a reduction of 6 inches in the side-yard setback is barely discernable given the size of the existing structure, its orientation on the site and the location's open views. Moreover, the increase of the footprint when scaled against the overall lot size, 14,323 square feet including the lands south of the Coastal Erosion Hazard Line, establishes a lot coverage of 16.5%, well below the 20% allowed by the Code. 4. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. As mitigation to constructing a new dwelling in an environmentally sensitive area 10.5 feet from a costal erosion hazard area the applicant shall install a new I/A Waste Water Treatments system as approved by the Suffolk County Department of Health. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and the applicant made an application for variance relief for additions and alterations to an existing non-conforming structure. The applicant hired an attorney and a licensed architect to advise him on the limitations of the zoning code and which variance relief he should request. The architectural prints used in the application did not accurately represent the scope of work needed to complete proposed additions and alterations. 6. Town Law §267-b. Grant the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single-family residence consisting of increased living area and a covered front porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 4,May 23,2019 #7263, Patinella SCTM No. 1000-38-6-12 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried, to GRANT the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor and last revised November 12, 2018 and the architectural drawings labeled A-1, A-2 and A-3 prepared by Peter T. Podlas, Architect, and last revised October 11, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The covered front porch shall remain open, unenclosed, and unconditioned space. 2. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposed action is recommended as INCONSISTENT with the below noted policies and therefore is INCONSISTENT with the LWRP. In August of 2018 a request to construct additions and alterations to the existing single family dwelling was reviewed and recommended as CONSISTENT. Since the recommendation was made, the landowner demolished the structure and reconstructed a new structure on site without obtaining the benefit of board review. Based on such, the new action is recommended as INCONSISTENT. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse, effects of development. The as-built construction is not consistent with Policy 1. The parcel is located within the Coastal Erosion Hazard area and is subject to Chapter 111 Coastal Erosion Hazard Area of the Southold Town Code. Town records show that the property has suffered /d 6--3 land area loss in the past from erosion due to storm events and wave action. Note, that the single family residence setback from the Coastal Erosion Hazard Area is 10.5'+. RECEIVED Policy 4. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The proposed single family residence does not require a location on the coast. b. water-dependent uses which cannot avoid exposure to hazards. The use is not water dependent. C. sites where relocation of an existing structure is not practical. The structure could be re-located to increase the distance to the Coastal Erosion Hazard Area. Increasing the size of nonconforming structures in areas vulnerable to coastal storms is not supported by the above policies. The total increase of interior living space footprint as applied for is approximately 37S>;square feet. At its closest point, the northwest corner of the structure will be 9.6 feet from the property line where the Code requires a minimum of 10 feet. Additionally, when completed the lot coverage for these alterations and additions will represent 22.5% where the Code limits such improvements to 20%. ADDITIONAL INFORMATION: No member of the public or any immediate neighbor spoke in favor of, or against the application. The applicant's survey illustrates e�building area of approximately 10,473 square feet north of the Coastal Erosion Hazard Line while the lot size is 14,323 square feet, overall. Proposed additions and alterations include reducing the Code conforming front-ya,rd setback from 69.6 feet to 65.7 feet and adding second floor living space over the garage. During the public hearing, the applicant's representative was requested to reduce the proposed excessive lot coverage, to bring the application into more conformity with the Code, and to provide examples of supporting Zoning Board of AppE-als decisions regarding excessive lot coverage. The applicant's agent responded on May 8, 2018 wilh eight Zoning Board of Appeals decisions granting relief for excessive lot coverage in the immediate vicinity and did not alter the application. The applicant's representative also provided Zoning Board of Appeals file 42282 granted June 23, 1977 as a supporting document illustrating relief'for a reduced side yard setback in the immediate vicinity of South Lane, East Marion, during the public hearing. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The:c,on ing Board of Appeals held a public hearing on this application on May 3, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and rrlakes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. South Lane and the surrounding Old Orchard neighborhood, along, with adjacent Gardiner's Bay Estates is a small-scale bayfront community of homes developed over the mid- to-late 2V' Century. Most homes in the immediate area are developed on smaller, non-conforming lots created prior to current zoning, the majority of which have been renovated and expanded to meet modern needs. The appli(,ant's proposed alterations will not alter or change the character of the neighborhood as the two-story residence is existing and the proposed improvements are minor and are not easily discernable from the private road nor from the waterfront. 2. Town Law §267-b(3)(b)(2). The benefit sought by the. applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing home has stood for nearly 50 years without incident and was constructed on an angle, parallel to the ease and west lot lines, to take advantage of the view. The application proposes an increased footprint of approximately 379 square feet, the majority of which, 230 square feet, is for a covered front porch, Furthermore, in order to effectively renovate the interior of the house, the north,,vesl corner of the residence needs to be squared-off reducing the side-yard setback by six inches, not discernable from the exterior, to accommodate a bathroom. 3. Town Law §267-b(3)(b)(3). The variances granted herein are not mathematically substantial, representing 5% relief from the code regarding the side yard setback and 12.5% relief from the code regarding lot coverage. Moreover, the increase of the footprint when scaled against the overall lot size, 14,323 square feet including the lands south of the Coastal Erosion Hazard Line, establishes a lot coverage of 16.5%, well below the 20% allowed by the Code. 4. Town Law §267-b(3)(bb)(4) No evidence has been, submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's S1orm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the, applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions 10 a single-family residence consisting of increased living area and a covered front porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
