That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The property is located adjacent to the bluff along Cutchogue Harbor in a residential area. This site is the location for the proposal to demo the existing dwelling and garage, reconstruct or alter the existing guest house, and construct a new dwelling, barn/garage accessory building, and in-ground swimming pool. The swimming pool is conforming to building code and does not require comments. The entire parcel is well vegetated, there are no current resource concerns evident. The bluff shows no signs of erosion or degradation, in fact this bluff to the west of the dwelling is not steep, gently sloping seaward. The proposed site for the pool on the south facing side of the dwelling is more drastic. See photos: r r t K t s r` Office Hours: Monday through"I'hursday 7:30 a.m.to-1•:00 p.m. Friday 7:30 a.m. through 3:00 p.m. This location will require re-grading to install the swimming pool. Removing the retaining wall and regrading will be a major ground disturbance. We also came across some other remnant structures that may need to be excavated. I did not see these structures mentionedinthe scope of the project. ZI Although the application is seemingly extensive, it does not pose great concern for bluff degradation or failure. Considerations must always be made to vegetate appropriately upon completing the regrading process. Have an erosion and sediment control plan and measures in place. He also described the chain of events pertaining to the existing guest cottage use Which. was legalized by a current Pre-Certificate of Occupancy issued by the Southold Town Building Department in 2016 (#Z-38226) prior to the owner purchasing the property. The current owner will use the guest house for family and friends only, and the proposed house is approximately half the size of the existing house and situated approximately 23, feet landward of the existing house to be demolished. Moreover, the owner testified that he will'be installing advanced IA septic systems for both the residence and the carriage house/guest cottage, and stated that he was willing to covenant the use of the guest cottage for friends and family only and will not be rented or used as rental property and to also covenant that no sleeping or cooking facilities may be installed in the proposed new two story accessory garage and further,that the right to apply for Page 3,March 14,2019 #7243,Vanston Bear SCTM No. 111-10-14 an accessory apartment in said accessory garage shall be abandoned in perpetuity, unless the guest cottage is removed from the subject property. The second floor of the proposed rebuilt two-story garage, located on the northern boundary of the property will be used as a workshop and as recreational space.Two neighbors testified in favor of the entire application.No objections were heard: FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 7, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law,:F2"6'7-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood ora detriment to nearby properties. The scale of the proposed residence is only half of the square footage of the existing building, thereby making a smaller footprint on the property, and making it less visible to the street. In addition, the Board of Appeals granted prior variance relief in the neighborhood to demolish an existing dwelling located 26 feet from the bluff and construct a new dwelling 34 feet from the bluff (ZBA#7003 2016). The existing guest cottage on this large property has existed for more than 60 years without adverse impact, and guest cottages re relatively common in the neighborhood. The renovated guest cottage will not be larger than the existing cottage, and is in keeping with the scale and character of the neighborhood. b)(21 The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance.The existing house currently sits inside the 100- foot setback to a bluff as determined by the Southold Town Trustees per the zoning code. The proposal calls for the demolition of the existing house, and the construction of a new residence sitting approx. 23 feet landward of the existing house. To move the location to a confirming bluff setback would require construction on land that contains substantial slopes that would require significant land disturbance and tree removal. As for the work on the guest cottage, since both the structure and the use are legally pre-existing and non-conforming, any and all alterations beyond simple maintenance would require a variance under the Town Code. -T The The variances granted herein are mathematically substantial,representing 65% relief from the code for the bluff setback of 35 feet and 100% relief for the renovated guest cottage. However, the proposed new residence will be located approximately 23 ft more landward than the existing residence, or more than double the existing bluff setback of 14 feet, thereby substantially decreasing the degree of non- conformity and reducing potential adverse impacts to the bluff which is heavily wooded and gently sloping to the beach. The relief required for the guest cottage includes the replacement of roofing, doors and windows that will not expand the existing footprint. The proposal for the guest cottage will add no new square footage to the existing cottage which currently has three bedrooms and two full bathrooms, a kitchen, porch and great room. Proposed are three bedrooms and three and a half bathrooms, a kitchen, and great room. Also proposed is a 339 square foot attached wood deck on grade, but it is not habitable space, and therefore minimal in nature. 4. Tritvir t4av &26,71a{ )(b)( ): N`o evidence has been submitted"to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposal calls for the installation of a new IA septic system for the proposed residence, and a separate IA system for the guest cottage. These sanitary systems, and the installation of a non-turf buffer landward of the bluff, as conditioned herein, will mitigate impacts on the adjoining Cutchogue Harbor. All project components are situated substantially more than 100 feet from tidal wetlands associated with Cutchogue Harbor, and all project components except the construction of the new dwelling are located more than 100 feet landward of the top of bluff as most recently defined by Section 275-2 of the Town Code. All other project components proposed in this application are located within Chapter 275 jurisdiction because they are situated at least partially less than 100 feet from the top of bank as most recently defined by Section 275-2 of the Town Code. Specifically, Section 275-2 characterizes slopes adjacent to water bodies as either a "bluff' or "bank" depending on their heights and steepness. Thus, the tops of all slopes on the property having inclines 20 percent or steeper and heights greater than 20 feet have been identified on the survey and site plan as "top of bluff," and the tops of all slopes not meeting these parameters are identified as "top of bank." But unlike the bluff areas typical of Long Island Sound or the east side of Nassau Point, for example, the site slopes nearest to the proposed demolition and construction that can be defined as a "bluff'pursuant to §275-2 are more gently sloping, well vegetated, and in fact forested with mature trees. As described in its site evaluation report dated December 21, 2018, the Suffolk County Soil and Water Conservation District described the bluff to the west of the dwelling as "not steep, gently sloping seaward." And compared to the existing dwelling to be demolished and removed, the new dwelling will be located approximately 21 feet farther from the top of bluff; will have a 433 sf smaller footprint; and will be 11 feet lower in height. To further the goals of protecting and improving water quality and protecting and restoring the quality and function of the adjacent bluff and tidal wetland ecosystems, the project proposes increased bluff and wetland setbacks to structures and sanitary systems; decreased lot coverage within the 100' bluff setback; increased drainage capacity; a decrease in runoff potential; and improved septic treatment through proactive use of an innovative/alternative low-nitrogen sanitary system. Specifically, the historically existing physical and environmental conditions at the site will be improved through the following design elements and incorporated mitigation measures: 1. The proposed location of the new dwelling will increase the existing bluff setback by 150 percent from 14 to 35 feet. 2. Total lot coverage of buildable land within the 100' bluff setback will be decreased by 14 percent as a result of the reduction in the primary dwelling footprint by approximately 433 square feet. 3. The primary dwelling's preexisting nonconforming septic system, which is located on the face of the bluff, will be abandoned and replaced with a low-nitrogen, innovative/alternative sanitary system located at least 100 feet from the top of bluff and more than 250 feet from the surface waters of Cutchogue Harbor. 4. A drainage system consisting of leaders, gutters, and drywells will be installed to collect and recharge roof runoff from all proposed structures. - 11Page 5. The area located within Chapter 275 jurisdiction to be cleared and re-graded in connection with the proposed swimming pool will be stabilized and revegetated pursuant to a landscape plantings plan. 6. A drywell dedicated to containing pool backwash will be installed outside Chapter 275 jurisdiction. 7. A project limiting fence will be installed to contain site disturbance and potential runoff during construction. 8. A Stormwater Pollution Prevention Plan (SWPPP) will be prepared in connection with a New York State SPDES Permit to ensure that both temporary and permanent sources of erosion and runoff are contained and mitigated. In its site evaluation report referenced above, the Suffolk County Soil and Water Conservation District determined that "although the application is seemingly extensive, it does not pose great concern for bluff degradation or failure." Specifically, the historically existing physical and environmental conditions at the site will be improved through the following design elements and incorporated mitigation measures: 1. The proposed location of the new dwelling will increase the existing bluff setback by 150 percent from 14 to 35 feet. 2. Total lot coverage of buildable land within the 100' bluff setback will be decreased by 14 percent as a result of the reduction in the primary dwelling footprint by approximately 433 square feet. 3. The primary dwelling's preexisting nonconforming septic system, which is located on the face of the bluff, will be abandoned and replaced with a low-nitrogen, innovative/alternative sanitary system located at least 100 feet from the top of bluff and more than 250 feet from the surface waters of Cutchogue Harbor. 4. A drainage system consisting of leaders, gutters, and drywells will be installed to collect and recharge roof runoff from all proposed structures. 5. The area located within Chapter 275 jurisdiction to be cleared and re-graded in connection with the proposed swimming pool will be stabilized and revegetated pursuant to a landscape plantings plan. 6. A drywell dedicated to containing pool backwash will be installed outside Chapter 275 jurisdiction. 7. A project limiting fence will be installed to contain site disturbance and potential runoff during construction. 8. A Stormwater Pollution Prevention Plan (SWPPP) will be prepared in connection with a New York State SPDES Permit to ensure that both temporary and permanent sources of erosion and runoff are contained and mitigated.
