Replacement Bulkhead Maximum Height The top elevation of the replacement bulkhead shall be no more than 18 inches higher than the existing bulkhead. 7. No Seaward Extension of Bulkhead The new bulkhead shall be constructed in place of the existing bulkhead with no seaward extension of the outermost bulkhead face. 8. Jet-in Bulkhead Bulkheads constructed directly adjacent to vegetated tidal wetlands shall be hand driven or jetted in with no disturbance to the tidal wetland. Trenching is strictly prohibited. 9. Backfilling The installation of the approved replacement bulkhead shall be completed prior to'the placement of any flll'material behind the structure. 10. Clean Fill,Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition debris). 11. No Beach Excavation For Fill No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 12. No Dredging or Excavation No dredging, excavating or other alteration of shoreline or j underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department will issue a permit for such activities in the future. 13. No Runoff Over or Thrbugh'Bulkhead or into Wetland Upon completion of the bulkhead•- replacement authorized herein, there shall be no discharge of runoff or other effluent over or through.the structure or into any tidal wetland or protected buffer area. 14. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to escape into any wetlands or waters of New York State, nor shall washings from ready-mixed concrete trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms. Is. Use of Treated Wood The use of wood treated with creosote, pentachlorophenol or other wood treatment not specifically approved by the department for use in wetlands and/or marine waters, is strictly prohibited in-the construction of structures that will be in contact with tidal waters. 16. No Structures on Reconstructed Bulkhead or Pilings No structures,other than structures specifically authorized by this permit, shall be constructed on the reconstructed bulkhead or pilings without further authorization from the Department(new permit, modified permit). 17. Storage of Equipment,Materials The storage of construction equipment and materials shall be confined to the upland area landward of the bulkhead or on a barge. 18. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior to permit expiration,whichever comes first. if the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor,germination. 21. Temporary Mulch,Final Seeding if seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather conditions favor germination and growth but not more than six months after project completion. 22. State Not Liable for Damage The State of New York shall in no case be liable for'any damage or z injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 23. The proposed replacement bulkhead is located in the same location as the existing bulkhead and ties into the neighboring bulkhead on the northwest corner of the subject property,protecting the neighboring property from wave energy getting behind that existing wall just as it has done for more than thirty years. The alternative solution discussed at the site meeting, which involved removing the existing bulkhead and connection to the neighboring property and installing a stone revetment is problematic in my opinion. It would require that the toe of the revetment be established at the existing (to be removed) bulkhead on the subject property. The stone would have to batter into the property to be structurally sound, thereby creating a void between where the neighboring bulkhead return ends, and the new revetment for the subject property ends at the north property line. The void would be over 4' wide at elevation 11'2" (top of wall), creating an opportunity for erosion of the neighboring property onto the beach during rain events as well as the potential wall failure of the neighboring bulkhead during a tidal event with a wind component from the south. To protect against this vulnerable condition, this design concept would require the existing neighbors bulkhead return be removed and rebuilt so that it could be extended east, behind the intersecting plane of the proposed revetment on the neighboring property to protect it. We typically design these returns in hybrid situations to extend 10' past the top of the revetment to protect against scouring of the neighbors property as wave energy passes through the stone revetment. Jf . It should be noted that the intersection of the neighbors wall and the wall for this property is right where potential wave energy would be at its highest along this shoreline. There is approximately 3 miles of fetch directly to the south. Proper design and construction of this intersection are critical to the success of protecting the shoreline. It is also noted that the application to replace this bulkhead represents approximately 37' of bulkhead that adjoins more than 600 feet of existing bulkhead to the north. The long term presence of this combined structure has not demonstrated any adverse impacts on the subject beach or shoreline, as evidenced by the presence of maritime grasses seaward of the bulkhead and the stable,vegetated condition of the adjacent section(south) of the subject shoreline,which was restored with terracing and native vegetation in 2013 after Super Storm Sandy. In conclusion,my opinion is that the proposal before you offers the best solution in terms of protection with the least amount of"footprint". The only thing that I would add to the proposal is for it to include the planting of supplemental native grasses to replace any plantings damaged during construction. The bulkhead replacement is proposed along a section of shoreline and embankment that has been improved with and supported and protected from flooding and erosion by a bulkhead for more than 30 years,and there is no viable non-structural alternative means of maintaining and protecting the same portion of property from erosion. Rather,without replacement and maintenance of the bulkhead, the subject property and the adjacent property to the north,whose bulkhead ties into the applicants'bulkhead,would be exposed to severe erosion and flood damage.
