Stavola, residing at 545 Meday Avenue, Mattituck,New York 11952 and Jhony A. Alvarado andEricka N. Alvarado residing at 335 Meday Avenue, Mattituck,New York 11952 for the purpose of abandoning and cancelling a portion of the street known as "Penn Avenue"which tract of land is described below,pursuant to the provision of Section 335 of the Real Property Law of the State of New York, do hereby certify: 1. That a certain map subdividing such tractiof land and other land situate in Mattituck, Town of Southold, County of Suffolk and State of New York, into lots,plots,blocks and streets, entitled"Map of Tollewood"filed in the Office of the Clerk of the County of Suffolk on January 25, 1927, as Map No.175. 2. That more than 20 years have elapsed since the filing of said map. 3. That the street known as "Penn Avenue"on the aforementioned subdivision map, which is to be abandoned and canceled,' is situated in the Town of Southold, County of Suffolk and State of New York, and described as follows: See Schedule A attached'hereto and made a part hereof 4. That the area to be abandoned has an area of less than one-half acre. 5. That there are no streets,public highways, or portions thereof on the map, described herein,to with,no streets or portions thereof are open, used by the public, or necessary for the purpose of the owners, occupants, or any other persons having an interest in any part of the said subdivision of lands shown on the map. 6. Said David A. Stavola;Joann C. Stavola and Jhony A. Alvarado and Ericka N. Alvarado do hereby abandon and cancel said portion of the street known as "Penn Avenue", and effective with the due approval and recording hereof shall no longer exist. 7. Endorsed hereon is the approval of the Assessor of the Town of Southold as well as approval of the Superintend of Highways of the Town of Southold. 8. Submitted herewith is an Abstract of Title of the portion of said street described in Schedule A to be abandoned, covering a period of at least twenty(20) years last past and a Certification by a duly licensed Title Company doing business in the County of Suffolk to the effect that there are no unpaid taxes or tax liens against said lands, to be approved by the Clerk of Suffolk County at the time of recording hereof.
