SUPERVISOR RUSSELL: Please rise for the Pledge to the Flag. I am also going to ask
everyone to please remain standing for a moment of silence for Lieutenant William Sawicki,
who served 36 years as an officer, Sergeant and Lieutenant for the Southold Police Department
and Bruce Ferguson, who helped create actually the Southold Local Development Corporation in
2014 and served as executive director and actually, a very good friend of mine, Renee Carragher
Phelps, who was a school crossing guard and mother of Don Laskey in the Southold Highway
Department. Thank you. I am going to offer the opportunity for anyone who would like to
address any of the agenda items to please feel free?

ROBERT DUNN: Robert Dunn, Peconic. Just as a point of information, item 260, I know we
don't really need to know anything about that item but I have seen this before, satisfaction of
mortgage. The Town doesn't mortgage anything, right? Or has that got to do with tax laws?
SUPERVISOR RUSSELL: Yes, I would actually, I would have to assume, I think Bill can
address the issue but it might be from an old Community Grant Block funding program?
TOWN ATTORNEY DUFFY: That's exactly, it was part of the grant (inaudible). Thank you.
MR. DUNN: Okay, you have some kind of a hold...thank you.
SUPERVISOR RUSSELL: It's essentially a lien against property that received money for
personal renovation based on need. Does anyone else have questions? Leroy?

LEROY HEYLIGER: Item #223, I was searching through the code and it stated if the
(inaudible)the property is located at 1645 Wickham Avenue, is that correct?

SUPERVISOR RUSSELL: Yes, that's the hold over, change of zone.
MR. HEYLIGER: Under the section to the code amendment, it says tax map #1000-140-01-6
from B general business and R-40 to limited business and R-40, the property is located at 1645
Wickham Avenue. Is that correct?
SUPERVISOR RUSSELL: I believe that is based on access from Wickham Avenue. You have
raised that issue, we have taken note of that, there is, will not be action, we are going to table this
further tonight to clarify all of the issues that have been raised, both by the applicant and by the
public, including the address.
MR. HEYLIGER: What I see on this map here that I was given, is that the area is actually 5265
Route 48 and Maiden Lane. Inaudible. The Wickham Avenue is Mattituck Creek Lane,
according to my tax records.
SUPERVISOR RUSSELL: We will take that under advisement to clarify that.

WHEREAS, there was presented to the Town Board of the Town of Southold, Suffolk County,
New York, on the 181h day of December, 2018, a Local Law entitled"A Local Law to amend the
Zoning Map to change the zoning of the parcel known as SCTM #1000-140-01-6, from B
(General Business) &R-40 to LB (Limited Business) & R-40"; and
WHEREAS, on January 30, 2019, pursuant to §280-29(C), the Planning Board reviewed the
subject change of zone and issued a report supporting same; and
WHEREAS, on February 12, 2019, the Town Board of the Town of Southold held a public
hearing on the aforesaid Local Law, at which time all interested persons were given an
opportunity to be heard; and

WHEREAS,the public hearing is officially closed; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby declares itself lead agency
for the purposes of SEQRA review for the subject change of zone; and be it further
RESOLVED that the Town Board of the Town of Southold hereby adopts a negative declaration
for the purpose of SEQRA review and finds that the subject change of zone will not have a
significant effect on the environment and that a Draft Environmental Impact Statement will not
be prepared; and be it further
RESOLVED, that the Town Board of the Town of Southold,subiect to the Applicant Pilin:;
with the County Clerk covenants and restrictions on the subject property approved by the
Town Attorney prohibiting hotel and restaurant uses on the LB zoned property and limiting lot

Based on the goals of the Town, and upon our consideration of the recommendations of the
Town Planning Board, the Suffolk County Planning Commission, and the public comments
taken at the public hearing and otherwise, we hereby amend the official Zoning Map of the Town
of Southold as adopted by Section 100-21 of the Town Code to change parcel SCTM#1000-140-
01-6, from B (General Business) &R-40 to LB (Limited Business) &R-40. The property is
located at 1605 Wickham Avenue, Mattituck,New York.
Section 3. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 4. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

WHEREAS, there was presented to the Town Board of the Town of Southold, Suffolk County,
New York, on the 18th day of December, 2018, a Local Law entitled"A Local Law to amend the
Zoning Map to change the zoning of the parcel known as SCTM#1000-6-6-20.8, from R-80
(Residential)to HD (Hamlet Density); and
WHEREAS, on February 15.2018,pursuant to §280-29(C), the Planning Board reviewed the
subject change of zone and issued a report supporting same; and
WHEREAS, on February 26, 2019, the Town Board of the Town of Southold held a public
hearing on the aforesaid Local Law, at which time all interested persons were given an
opportunity to be heard; and
WHEREAS, at the public hearing there was testimony from the public regarding the need for
housing for full time residents of Fishers Island, and
WHEREAS,there was also testimony from members of the public concerned that if the
application for the change of zone was approved that without certain conditions placed on the
change of zone, there was a potential for dwelling units could be as short term housing for
visitors to Fishers Island, and
WHEREAS, the applicant's representative stated that the applicant intended to use any
dwelling units built on the subject property as housing for full-time year-round residents of
Fishers Island and that the applicant was willing to place covenants and restrictions on the
property limiting the use of the subject premises to full-time year round residents of Fishers
Island, and
WHEREAS, the Town Board of the Town of Southold hereby finds that based on the goals of
the Town, and the consideration of the recommendations of the Town Planning Board, and the
Southold Town Board Regular Meeting

public comments taken at the public hearing that approval of the change of zone should be
subject to the filing of covenants and restrictions limiting the use of the subject property to
housing for full-time year round residents of Fishers Island, and

Mattituck Chamber of Commerce to hold a series of First Friday Events and to close down Love
Lane from Route 25 to Pike Street, Mattituck on May 3, June 7, July 5, Aug 2, Sept 6, and Oct 4,
2019 from 5:00 PM to 9:30 PM provided they file a Certificate of Liability Insurance naming the
Town of Southold as addition insured for two million dollars and comply with all the conditions

charge for four weeks, at the Southold Town Compost Facility in Cutchogue (leaves are always
accepted free). This four-week grace period is for those homeowners who wish to take their
brush directly to the Town's compost site themselves. The grace period will start Monday, April
1, 2019, and end Tuesday, April 30, 2019; be it further
RESOLVED that commercial landscaping and tree removal companies will no longer be

permitted to deposit any loads of branches or yard debris for removal in the Town's right-of-
way. It will be the homeowner's responsibility to make certain that their contractor(s) haul their

RESOLVED that the Fishers Island Spring Clean-Up will also commence on Monday, April 15,
2019.

carrying less than one ton of debris (including trailers), or for vehicles without a permit, any
vehicle with a less than one ton carrying capacity (including trailers); and that commercial
vehicles shall be defined as any vehicle with a commercial disposal permit issued by the Town
Clerk of the Town of Southold, or for vehicles without a permit, any vehicle with a carrying
capacity of one ton or greater; and be it further
RESOLVED that the tip fee waiver/reduction described herein shall not apply to stumps of any
type; and that it applies to the charge for the weight of the debris ONLY, and not to single entry
fees for vehicles without permits, which will still be charged as appropriate.

A Local Law entitled, "A Local Law in relation to Amend Chapter 245 Taxation, to Provide
Property Tax Exemption for Certain Veterans Who Participated in Operation Graphic
Hand
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town Board finds and determines that in March of 1970, the United States was in the midst
of a communication crisis when letter carriers for the U.S. Postal Service voted to strike in major
cities throughout the country.
The Town Board determines that New York City was the epicenter of the strike movement,
affecting not just local mail delivery but also the routing of correspondence and parcels
throughout the nation.
The Town Board also finds and determines that on March 23, 1970, President Richard Nixon
issued an executive military order, declaring a state of emergency and mobilizing 25,000 active
duty and reserve service members to maintain postal service in New York City. The Mission
was later designated Operation Graphic Hand.
The Town Board further finds and determines that, while the strike was short in duration, ending
on March 25, 1970, the service of the men and women assigned to Operation Graphic Hand
ensured that essential elements of mail delivery occurred during this period.
The Town Board finds that New York State and Suffolk County recently enacted legislation

authorizing towns in their discretion to extend real property tax exemptions provided under State
and County Law to veterans who were assigned to Operation Graphic Hand.
The Town Board determines that given the Town of Southold's close proximity to the main site
of Operation Graphic Hand,the Town of Southold should authorize the property tax exemption
for those veterans who helped keep our national postal service operating in a time of crisis.
Therefore the purpose of this amendment is to amend Chapter 245 to authorize the inclusion of
veterans of Operation Graphic Hand in the Town's real property tax exemption laws.
II. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
§ 245-15
Definitions
VETERAN -A person:
A. Who served in the active military, naval, or air service during a period of war or
who was a recipient of the armed forces expeditionary medal,naval expeditionary
medal, Marine Corps expeditionary medal or global war on terrorism
expeditionary medal, and who was discharged or released therefrom under
honorable conditions_ or
B. Who was employed by the War Shippings Administration or Office of Defense
Transportation or their agents as a merchant seaman documented by the United
States Coast Guard or Department of Commerce or as a civil servant employed by
the United States Anny Transportation Service (later redesignated as the United
States Army Transportation Corps, Water Division) or the Naval Transportation
Service; and who served satisfactorily as a crew member during the period of
anned conflict, December 7, 1941,to August 15, 1945, aboard merchant vessels
in oceangoing (i.e., foreign); intercoastal or coastwise service, as such terms are
defined under federal law(46 U.S.C.A. §§ 10301 and 10501), and further to
include near-foreign voyages between the United States, Canada, Mexico or the
West Tndies via ocean routes or public vessels in oceangoing service or foreign
waters and who has received a certificate of release or discharge from active duty
and a discharge certificate or an honorable service certificate/report of casualty
from the Department of Defense,
C. Who served as a united States civilian employed by the American Field Service
and served overseas under United States Armies and United States Army Groups
in World War II during the period of armed conflict, December 7, 1941, through
May 3, 1945, and who was discharged or released therefrom under honorable
conditions; or
D. Who served as a United States civilian flight crew and aviation ground support
employee of Pan American World Airways or one of its subsidiaries or its
affiliates and served overseas as a result of Pan American's contract with Air
Transport Command or Naval Air Transport Service during the period of armed
conflict, December 14. 1941,through August 14, 1945, and who was discharged

or released therefrom under honorable conditions.. or,
E. )X'ho served as military personnel in the Reserve component of the United States
Armed Forces and deemed on active duty under Executive Order 11519 signed
March 23. 1970, 35 Federal Register 5003. dated March 24, 1970 and later
designated by the United States Department of Defense as Operation Graphic
Hand, and who was discharged or released therefrom under honorable conditions.
II. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

SUPERVISOR RUSSELL: Just to quickly explain, Graphic Hand actually was the result of a
letter carrier strike in New York City March of 1970. President Nixon at the time declared a
state of emergency,pulled out 25,000 National Guard members to resume mail delivery, they
were ultimately subsequently later that year were declared as serving in active service.

"District"), in the Town of Southold (the "Town"), Suffolk County, New York, pursuant to a

WHEREAS, on February 26, 2019, the Town Board of the Town of Southold
(herein called the "Town"), in the County of Suffolk, New York, on behalf of the District,
adopted an Order pursuant to Section 202-b of the Town Law, describing in general terms a
proposed increase and improvement of facilities, consisting of the acquisition of a high speed
passenger ferry boat, at the aggregate estimated maximum cost of $460,000; and said Order
stated that the Town Board would meet to hear all persons interested in said increase and
improvement of facilities on March 26, 2019 at 4:30 o'clock P.M. (Prevailing Time) at the Town
Hall, 53095 Main Road, Southold,New York; and
WHEREAS, a Notice of said public hearing was duly published and posted
pursuant to the provisions of Article 12 of the Town Law; and
WHEREAS, said public hearing was duly held by the Town Board on March 26,
2019 at 4:30 o'clock P.M. (Prevailing Time) at the Town Hall, 53095 Main Road, Southold,
New York, with considerable discussion on the matter having been had and all persons desiring
to be heard having been heard, including those in favor of and those in opposition to said
increase and improvement of such facilities; and
WHEREAS, the District, as lead agency, has given due consideration to the
impact that the project described herein may have on the environment pursuant to the State
Environmental Quality Review Act (SEQRA), constituting Article 8 of the Environmental
Conservation Law, and 6 NYCRR, Regulations Part 617.5 and has determined that the
acquisition of a high speed ferry is a Type II action and no further environmental review is
required for said project;
Now, therefore, on the basis of the information given at such hearing, it is hereby
DETERMINED, that it is in the public interest to increase and improve the
facilities of the District as hereinabove described, at the estimated maximum cost of$460,000;
and it is hereby
ORDERED, that the facilities of the District shall be so increased and improved
and that the Board of Commissioners shall prepare plans and specifications and make a careful
estimate of the expense for said increase and improvement of such facilities and, with the
assistance of Attorney for said Board, shall prepare a proposed contract for such increase and
improvement of facilities of the District, which plans and specifications, estimate and proposed
contract shall be presented to the Town Board as soon as possible; and it is hereby
FURTHER ORDERED, that the expense of said increase and improvement of
facilities shall be financed as hereinabove set forth, and the costs thereof, including payment of
the principal of and interest on the obligations authorized to be issued, shall be assessed, levied
and collected by the Town Board from the several lots and parcels of land within the District in
the same manner and at the same time as other Town charges, but if not paid from such source,
all the taxable property within said Town shall be subject to the levy of ad valorem taxes, in an
amount sufficient to pay the principal of and interest on said obligations; and it is hereby
FURTHER ORDERED, that the Town Clerk record, or cause to be recorded, a
certified copy of this Resolution and Order After Public Hearing in the office of the Clerk of

WHEREAS, after a public hearing duly called and held, the Town Board of the
Town of Southold (herein called the "Town"), in the County of Suffolk, New York determined
that it is in the public interest to increase and improve the facilities of the Fishers Island Ferry
District(referred to herein as the "District"), and ordered that such facilities be so improved;
Now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN
THE COUNTY OF SUFFOLK, NEW YORK (by the favorable vote of not less than two-thirds
of all the members of said Board)AS FOLLOWS:
Section 1. The Town hereby appropriates the amount of $460,000 for the
increase and improvement of facilities of the District, consisting of the acquisition of a high
speed passenger ferry boat. The estimated maximum cost thereof, including preliminary costs
and costs incidental thereto and the financing thereof, is $460,000. The plan of financing
includes the issuance of bonds in the principal amount of$460,000 to finance said appropriation,
and the assessment, levy and collection of assessments upon the several lots and parcels of land
within the District in the same manner and at the same time as other Town charges, but if not
paid from such source, all the taxable property within said Town shall be subject to the levy of
ad valorem taxes, in an amount sufficient to pay the principal of and interest on said obligations.
Section 2. Bonds of the Town are hereby authorized to be issued in the principal
amount of$460,000 pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called the "Law"), to finance
said appropriation.
Section 3. The following additional matters are hereby determined and stated:
(a) The period of probable usefulness of the object or purpose for which said
bonds are authorized to be issued, within the limitations of Section 11.00 a. 26 of the Law, is

thirty-five (35) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution. The foregoing statement of intent with respect to
reimbursement is made in conformity with Treasury Regulation Section 1.150-2 of the United
States Treasury Department.
(c) The proposed maturity of f the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of said bonds shall contain the recital of validity
prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation said
bonds shall be general obligations of the Town, payable as to both principal and interest by a
general tax upon all the taxable real property within the Town. The faith and credit of the Town
are hereby irrevocably pledged to the punctual payment of the principal of and interest on said
bonds and any notes issued in anticipation of the sale of said bonds, and provision shall be made
annually in the budget of the Town by appropriation for (a) the amortization and redemption of
the bonds and any notes issued in anticipation thereof to mature in such year and (b) the payment
of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the
issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative
to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections
56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized, and the renewals of said bond anticipation
notes, and relative to executing contracts for credit enhancements and providing for substantially
level or declining annual debt service, are hereby delegated to the Supervisor, the chief fiscal
officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with, and
an action, suit or proceeding contesting such validity is commenced within twenty days after the
date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This resolution shall take effect immediately and the Town Clerk is
hereby authorized and directed to publish the foregoing bond resolution, in summary, in "The
Suffolk Times, " a newspaper having a general circulation in said Town, which newspaper is
hereby designated as the official newspaper of the Town for such publication, together with the
Town Clerk's statutory notice in the form prescribed by Section 81.00 of the Local Finance Law
of the State of New York.

discharged or released therefrom under honorable conditions. or,
E. Who served as military personnel in the Reserve component of' the United States Armed
Forces and deemed on active duty under Executive Order 11519, signed March 23, 1970, 35
Federal Register 5003, dated March 24, 1970 and later designated by the United States
Department of Defense as Operation Graphic Hand. and who was discharged or released
therefrom under honorable conditions.
II. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
I do have a notarized affidavit that this has been advertised by the Town Clerk and on the Town
Clerk's bulletin board and a notarized document that it has been published in the Suffolk Times.

SUPERVISOR RUSSELL: That concludes the agenda. I would ask anybody that would like to
address the Town Board on any issue to please feel free?
Robert Dunn,Peconic
ROBERT DUNK: Robert Dunn, Peconic. At the end of the last meeting I had spoken to you
about Goldsmiths and the changing environment down there, it had been closed and it was
opening. It did open, we had that high tide last weekend that kind of did it but the channel itself
is still traveling east and the concern there is, it's really not east, it's almost north but it's traveling
in an easterly way. As it goes easterly, it comes up the beach, if you understand the beach slopes
up.
SUPERVISOR RUSSELL: Okay.
MR. DUNN: And the channel slopes up the beach, as it slopes up the beach once it gets beyond
what is commonly called the rack line, it begins to erode the dune. That sand will never come
back.
SUPERVISOR RUSSELL: That's the dune that is the part of the Suffolk County park property?
MR. DUNN: Yes, that's part of the park property. It will come up that dune and start to
disintegrate that dune, that dune has taken a hit several, the only time that sand builds up back
there is when it is done mechanically.
SUPERVISOR RUSSELL: Right.
MR. DUNN: It does not happen naturally. All the other places, (inaudible) yes, it will. It gives
and takes and you can't control that. But as that dune decays, it's now down to less than 12 feet
width at the base, if that dune goes, Goldsmiths Inlet becomes a bay.
SUPERVISOR RUSSELL: Right.
MR. DUNN: Yes, it is Suffolk County property but it is of concern of the people of Southold
Town because no matter whose property it is, it's in Southold Town. If you look at the south end
of Goldsmiths Pond itself, you will see there's a lot of phragmites in there, there's a whole bunch
of debris that's pushed in by the storm. So what would happen if that dune goes, the entrance
gets very wide and you can see now all the stuff that's carried back in there during exceptional
high tides and storms. That would all be water. That much water would come through, that
intersection of Soundview Avenue and Mill Road would (inaudible) go under water, once that

breach would occur. So do I expect you to go down there and do something about it tomorrow?
No. But it needs to be discussed, it needs to be discussed with the county and hopefully, this
ongoing thing with the Army Corps of Engineers can shed some light on it. We are at a
dangerous point now.
SUPERVISOR RUSSELL: The erosion along that dune for some time has gotten quite bad. I
don't know, I remember, at some point it was exposing I don't know if they were cisterns or, you
know when they started....
MR. DUNN: Inaudible. It went past, there was a time when they were exposed. It's now six,
eight feet behind where they were.
SUPERVISOR RUSSELL: Wow.
MR. DUNN: That dune that they were in, completely gone and it's gone back further. And that's
why I say, normally with a 30 or 40 foot base, there's now no more than 12-15. And when that
breaches, first of all, you know you are going to lose that interdunal swale that's behind it. From
what I have been told, it's the only one of the North Fork, that's a geological formation that
happens, they have a kind of second dune and there's a difference of plant life and stuff that
grows in there, so it does different for animals and wildlife that aren't able to be supported by it.
In any case, that will go aways, it's just a real danger and like I said before I am not expecting to
really run out and do anything but just to kind of keep everybody aware of what's happening
there. Not only there but places all over this town. There's places like the same thing and I
mean, we spend a lot of money protecting land, 85% of our boundaries are by water and if you
did it by linear feet, it's probably 99%with all the ins and outs.
SUPERVISOR RUSSELL: Right.
MR. DUNN: And to not pay attention to what happens to that (inaudible) would be sinful, I
mean part of what we all enjoy out here is the waterside experience that we are all living in and I
don't mean swimming, I go in the water probably twice a year,just living around it, driving by it,
it all leads to what we all enjoy. To let that go to a point where it can't,be repaired would be
sinful.
SUPERVISOR RUSSELL: Yes, the intrusion would change the ecosystem of the pond in the
matter of no time.
MR. DUNN: And the pond, on a high tide, on an extreme high tide it is somewhere around six
feet above mean. Mill Lane at the intersection of Soundview is not much higher. The upper end
of Mill road down towards the beach is below that, so the beach is actually has a berm to keep
the Sound out during high tides, so, the road is actually under water during high tides, it's not, I
mean we get flooding, last year we got flooding several times but I mean, there's a lot of
repercussions that can happen with the failure of that dune. Inaudible.

SUPERVISOR RUSSELL: The status of the Army Corps study, I just don't if they are, they
haven't reached the design stage at this point I'm sure.
MR. DUNN: They haven't reached it anything as far as I know. They are still in the information
gathering stage.
SUPERVISOR RUSSELL: That's a foot race, between,the damage that can occur and the day
that action might take place.
MR. DUNN: And one last thing and this is as much for them as you, we have a situation in our
community. There's a number of private roads that run off of Mill Road and they don't get a lot
of traffic on it, so when people want to get rid of old furniture, bicycles, kids toys, kitchen tables,
there's a property at the corner of Mill and Fasbender, Fasbender is one of the first private streets
and there's a property there that I wouldn't call it abandoned but it's unused. The owners actually
get it cleaned it every now and then so I won't complain about them, (inaudible) but that's their
business. However, people on the private streets in back seem to think when they need to get rid
of junk and stuff they should put it there because they don't get any traffic on their streets. You
get traffic on Mill Road. Now that's kind of sloppy because people live on Mill Road and don't
want to live in a dump. Usually stuff disappears, when it doesn't disappear, one of us, including
myself, on our way to the dump will pick the stuff up and take it to the dump. Some pig, last
week, and I hope they heard me, put a box full of rusty paint cans out. Guess they think there's
people wandering around Southold looking for rusty paint to pick up. This is 60 feet from the
water and it's just got a little-out of control. I mean, what's next? Are they going to be putting
yellow bags there because they are too lazy to take them to the dump? I don't know how to
address it.
SUPERVISOR RUSSELL: Well, to be perfectly candid, I am not sure I know how either. I
mean, we would certainly reach out to the owner first and then we would post notice.
MR. DUNN: It's not their fault.
SUPERVISOR RUSSELL: Yes but ask them to post no trespassing so we at least have some
measure of enforcement but it's describing stuff in a public right of way that's probably not
permitted by code.
MR. DUNN: I mean, if somebody puts a chair there for two days, you know lawn chairs and
they sit there for two days and somebody picks them up you know, live and let live but how do
you put a box full of paint there? I mean, it's old rusty cans from somebody's garage. Nobody is
going to want them and it's 60 feet from the water. Okay, enough said.

LEROY HEYLIGER: Leroy Heyliger, Mattituck. Item 224, the utility company Fishers Island.
I saw in a Newsday article you were quoted as saying that workforce would not have to comply
with housing requirements of the housing, workforce housing act. My question is, how can they
do that, seeing as how so many lawsuits have been filed against Bay Shore and one here Nassau
County, $54 million lawsuit settled.
SUPERVISOR RUSSELL: Yes, that's what you call disparity in equity claims. I am aware of
those. The Supreme Court settled those are a matter of law, you are not allowed to have local
preference in any federally subsidized affordable housing program but let me point out, this isn't
an affordable housing, it's a simple change of zone. The applicant outlined why they need the
change of zone because they want to build housing for employees of the utility company....
MR. HEYLIGER: But the people, their argument is they want it to be residents only.
SUPERVISOR RUSSELL: That's a condition that we put in place, the change of zone that we
granted had a condition in place that it has to be use for year round housing but isn't under
affordable housing program, it's a simple change of zone.
JUSTICE EVANS: It doesn't say that people have to be living on Fishers Island now, it's just
whoever occupies that house has to be a year-round resident at the time they occupy.
MR. HEYLIGER: But the utility company itself, they are workforce, how diversified is their
workforce?
JUSTICE EVANS: Whoever they can find, they need workers. Right now many of them are
commuting from Connecticut to Fishers Island.
MR. HEYLIGER: My thing is I am just thinking down the road, something might come up with
this, I don't want to see us get caught, as taxpayers, caught in another lawsuit like they have over
there in Oyster Bay and this one here, $5.4 million lawsuit because it was some kind of
discrimination. Another question I want to ask you is on 276, contracts leases and agreements,
non-discrimination assurances. Inaudible. I came to the board, I believe it was the end of
December about Factory Avenue, about problems that we were having with the 50 footers. Well,
just yesterday there was one hung up on Factory Avenue for at least 20 minutes because he ran
out of air trying to back in and I happened to be out there at the time and he was stuck halfway in
our church driveway and he couldn't get backed in. The road was blocked all the way to Old
Sound Avenue to the Main Road, for 20 minutes, the truck was building air because from
moving back and forth he lost air pressure. He was stuck. Luckily the train gates didn't come
down. Traffic was backed up both ways, an ambulance couldn't get through there or a fire truck
couldn't get through there. I ended up, finally when he got half way the road open halfway, he
got stuck again while he built more air pressure, I ended up directing traffic back and forth. This
isn't the first time that has happened. I requested a grant study for Factory Avenue, I would like
to see it under this New York State Department of Transportation Office of Civil Rights
Compliance Review if something can be done. Some kind of study. And also we need some
kind of, on the pedestrian walkway going across the railroad tracks to the residential section, we

need something there. Some kind of bicycle path or something so people will have a little bit
more room where they won't get hit by a car, especially when it's dark at night. On a rainy night
I almost hit somebody, a woman with a'baby carriage and she had another child walking in that
residential area and I was very lucky I didn't hit her. Thank you.

SUPERVISOR RUSSELL: Thank you. I do want to mention that when you had brought this to
our attention a few years back, we did establish a no loading zone along that area. A distressed
vehicle, a distressed truck whatever it was, I would have preferred you call the police department
so they could have gone out and directed traffic, so you didn't put yourself in harms way. You
know, that would have been my concern but I hear everything you are saying. Who else would
like to address the Town Board? No response.
