MA Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF APRIL 25, 2019 ZBA FILE: 7266 NAME OF APPLICANT: Andrew Fohrkolb PROPERTY LOCATION: 1335 Fleetwood Road, Cutchogue SCTM No. 1000-137-4-30 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 17, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 9, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is an irregularly shaped 21, 225 sq. ft. parcel that abuts East Creek. The property has a 31.00 feet frontage on Fleetwood road, then runs 268.03 feet towards East Creek, the East Creek frontage is 125.71 feet, which returns 329.65 feet back towards Fleetwood Road. The property is improved with two structures, one is an existing 8 ft. by 12 ft. shed, and an existing one-story garage as shown on a survey prepared by Kenneth M. Woychuck, L.S. dated April 26, 2018. Both structures are slated for removal as part of the project. The building envelope sits behind a bluff that goes down towards East Creek with an existing set of wood stairs, shed, catwalk, and floating dock at water level. BASIS OF APPLICATION: Request for Variances under Article XXIII, Section 280-124; and the Building Inspector's August 30, 2018, Amended September 18, 2018 Notice of Disapproval based on an application for a permit to construct a new single family dwelling and an accessory garage, at; 1) less than the code required minimum side yard setback of 15 feet, 2) less than the code required minimum total side yard setback of 35 feet; at: 1335 Fleetwood Road, Cutchogue, NY. SCTM#1000-137-4-30. Page 2, April 25, 2019 #7266, Fohrkolb SCTM No. 1000-137-4-30 RELIEF REQUESTED. The applicant requests variances to construct a new single-family dwelling with a single side yard setback of 11 feet where 15 feet is required, and a variance for a 21feet combined side yard setback where a 35 feet combined side yard setback is required. ADDITIONAL INFORMATION: Testimony was given by the applicant's attorney and architect as to the proposed removal of existing structures on the subject property and the siting of a proposed new dwelling and accessory garage he They also reviewed the history of the property, explaining that there was once a single- family residence and accessory garage on the subject parcel. The dwelling was destroyed in a fire in 1984, leaving just the accessory garage that is still in use. In the same year, a permit was issued to demolish the fire damaged dwelling. Questions were asked about the proposed septic system, and the need for a new IA advanced septic system. Aerial photographs were presented showing the neighboring properties and both written and oral testimony was given by the surrounding neighbors of the property in support of the project. AMENDED RELIEF: The Notice of Disapproval, dated September 18, 2018, indicated the proposed construction to be setback 11 feet from the single side yard, with a 22 feet combined side yard setback. During the public hearing, the Board discussed with the applicant's attorney that the survey shows the closest setback from the single side yard to be 10 feet not 11 feet and the applicant's representative confirmed that the relief being sought is for a 10 feet single side yard and 21 feet combined side yard. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 11, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Fleets Neck neighborhood is characterized by similar size dwellings with similar shaped narrow lots. Aerial photographs presented to the Board confirm that the neighboring dwellings are constructed on narrow lots with minimal side yard setbacks. This proposed residence will be in keeping with the existing character of the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed location of the house is respecting the front and rear (waterfront) setbacks, but side yard relief would be needed for almost any proposed structure on the site, given how narrow the width is. It is of note that only a small part of the house, and a portion of the garage require setback relief due to the triangular shape of the property. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing a 33% relief for the single side yard setback, and a 40% relief for the combined side yard setbacks. However, only 71.9 sq. ft. of the proposed residence lies within the non -conforming side yard setback, and the remaining relief applies to a covered walkway and a portion of the garage for a total of 400 square feet needing relief. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed residence is in a conforming location as per the bluff setback. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions set forth by this board. Page 3, April 25, 2019 #7266, Fohrkolb SCTM No. 1000-137-4-30 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Due to the irregular shape of the parcel, it would be very difficult to fit a house that is in character with the surrounding neighborhood on the property without variance relief. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single-family residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried, to GRANT the variances as AMENDED FOR A SINGLE SIDE YARD SETBACK OF 10 FEET AND A COMBINED SIDE YARD SETBACK OF 21 FEET as shown on architectural plans (Pages A-001, A-101, A102, A-200 and A-201) prepared by Meryl Kramer, R.A., dated August 22, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The second -floor roof deck on the main house shall remain open to the sky in perpetuity. 2. The covered deck shall remain unenclosed and shall never be turned into habitable space. 3. The roof over the covered deck shall never be used as a second -floor walkway. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. Fohrkolb ("Applicant") is seeking a side yard setback variance from the requirements of Town Code Section 280-124 to construct a two story single-family dwelling with an attached one story garage on his premises located at 1335 Fleetwood Drive in the Fleet's Neck community in Cutchogue. The subject premises lies adjacent to East Creek and is currently improved with a non -conforming, one story framed structure and a shed that will be demolished and removed prior to construction. The property card confirms that the original dwelling on the property was destroyed by fire in 1984 and subsequently demolished as removed. The subject parcel is a non -conforming 21,155 square foot parcel that is triangular in shape. The proposed location of the new dwelling is conforming to the front and rear yard setbacks and lot area restrictions in Town Code Section 280-124, however, the shape of the lot precludes strict compliance with the single and combined side yard setback requirements for a portion of the proposed dwelling. Specifically, the proposed dwelling will require a single side yard setback of 11 feet where 15 feet is required and a combined setback of 22 feet where 35 feet is required. For the following reasons, the Applicant submits that a Variance from Section 280-124 is warranted. POINT I THE APPLICANT HAS MET THE TEST FOR THE GRANT OF AN AREA VARIANCE SET FORTH IN TOWN LAW §267-B Under §267-B, the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: 2 (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. The Applicant submits that under the facts and circumstances presented here, the Applicant can clearly meet the standards set forth in Town Law §267-13 and, as a result, the relief requested herein should be granted. 1. The Grant Of The Variance Will Not Cause An Undesirable Qhange In The Character Of The Neighborhood Or Create Detriment To Nearby Properties. The Fleet's Neck neighborhood is characterized by similarly sized dwellings, many of which are constructed on substandard lots with the benefit of setback relief. In fact, the neighboring property owner to the south is also irregularly shaped and was granted a side yard setback variance prior to construction. Aerial photographs confirm that there are other houses in the immediate vicinity that are constructed on narrow lots with minimal side yard setbacks. The proposed location of the house on the parcel was intended to honor the front and rear setbacks, particularly in light of the bluff. There are also letters from both of the immediate neighbors supporting the request for relief here and confirming that the proposed house will be in character with other houses on Fleetwood Road. It is therefore respectfully submitted that heither an undesirable change 3 � 1 S in the character of the neighborhood or a detriment to nearby properties will be created by the grant of this area variance. 2. The Benefits Sought To Be Achieved By Applicant Cannot Be Feasibly Achieved By Some Method Other Than The Requested Area Variance. To site the house in a location that is respectful of the front and rear setbacks, side yard area variance relief is essential for a portion of the house. It is noteworthy that only a small percentage of the square footage of the proposed improvements will lie within the side yard setback. Moving the house back would require a far more substantial rear yard variance. The side yard relief requested is minimal by comparison and is necessitated only by the irregular configuration of the lot. 3. The Area Variance Sought Is Not Substantial. The Applicant submits that the 27% variance from the single side yard setback and the 37% variance from the combined setbacks are not significant under the circumstances presented here since a substantial portion of the dwelling will be in a conforming location. The total square footage of the house that will lie in the setback is 71.9 square feet and the remaining relief applies to a covered walkway connecting the garage to the house. Nevertheless, the resulting single-family dwelling will be consistent with the location and dimensions of the waterfront homes in the surrounding Fleet's Neck neighborhood. 4. The Grant Of The Variance Will Not Have An Adverse Impact On The Physical or Environmental Conditions In The Neighborhood Or District. As stated previously, the proposed dwelling is reasonable in size and the proposed location is consistent with similar homes in the Fleet's Neck neighborhood and respectful of the adjoining wetland. Due to the conforming location 50 feet from the top of the bluff, there is no 11 perceivable environmental impact from the proposed construction. The granting of the variance relief is supported by neighboring property owners and will result in the removal of a pre- existing non -conforming structure. 5. The Self -Created Nature Of The Alleged Difficulty Should Not Preclude The Granting Of Area Variance Relief. The apparent difficulty here is the inability to fit a portion of the proposed house, that is entirely in character with others in the surrounding community and conforming to the lot area and front and rear setback requirements, entirely within the side yard setbacks. This is due to the irregular shape of the parcel.
