SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 26, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 9, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming 21,907 square feet, 0.503 acre, rectangular parcel located in the Residential R-40 District measures 60.00 feet along Peconic Bay Boulevard, then 424.39 feet south along a residentially developed lot to the east towards the Peconic Bay, where it turns west 50.94 feet along a wood bulkhead at the high water mark with the Great Peconic Bay, then turns north and runs 403.22 feet along a residentially developed lot to the west. The site is developed with a single family, wood-frame residence with covered waterside porch, wood walk and stairs at the bulkhead accessing the bay, and a two-story wood-frame detached accessory garage as shown on the survey prepared by Nathan Taft Corwin III, Licensed Land Surveyor last revised June 7, 2018. BASIS OF APPLICATION: Request for Variances under Article XXIII, Section 280-124; and the Building Inspector's October 24, 2018 Notice of Disapproval based on an application for a permit to demolish an existing single family dwelling and construct a new single family dwelling, at; 1) less than the code required minimum side yard setback of 15 feet, 2) less than the code required minimum total side yard setback of 35 feet; at: 6130 Peconic Bay Boulevard, (Adj. to Great Peconic Bay)Laurel,NY. Page 2,April 25,2019 #7216,Froehlich SCTM No. 1000-128-2-6 RELIEF REQUESTED: The applicant requests variances to demolish an existing one and a half story single- family residence with partial basement and to build in its approximate place a new,'two story single-family residence of approximately 2,368 square feet footprint with full basement measuring, 32 feet by 61 feet with a ridge height of 32.8 feet and an attached 32 feet by 12 feet waterside, covered porch with second floor balcony where the code requires a minimum side yard setback of 15 feet and a total combined side yard setback of 35 feet. The applicant proposes construction with a single side yard of 6 feet and combined side yards of 19.6 feet. ADDITIONAL INFORMATION: No members of the public or any immediate neighbors spoke in favor of or against this application. The applicant, their attorney/agent and architect all spoke during the public hearing outlining their application and reasons for the variance requests. They propose to redevelop the site by moving the proposed house slightly off of the existing foundation line on the west side in order to increase that side yard setback. At the hearing the Board discussed with the applicant and his agents installing a Suffolk County Board of Health approved innovative and alternative wastewater system. The applicant was open to the idea, but his architect indicated that such an improvement was unnecessary given the elevation of the proposed residence from the water table. The applicant's agent did not provide information relative to the subject property's elevation and depth to the water table, nor any documentation refuting the need for and benefits of an innovative and alternative wastewater treatment system for properties immediately adjacent to the Great Peconic Bay. A prior ZBA decision, file #6974, granted August 2016 allowed variances for the construction of a detached accessory garage building with reduced side yard and combined yard setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 11, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Residences located on the south side of Peconic Bay Boulevard were predominately developed in the early to mid-20`x' Century and are sited on long, narrow, non- conforming waterfront lots, taking advantage of the view and access to the water, many of which have been updated to meet current standards. The immediate neighborhood features a variety of housing styles, sizes, age and condition. The proposed new construction replaces a previously built home in approximately the same footprint as the original structure and fosters a design compatible to other waterside residences along the south side of Peconic Bay Boulevard. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of a narrow, non-conforming building lot measuring 60 feet wide at the roadside and tapering to 50.94 feet wide at the waterside, any structure replacing the existing residence that is wider than approximately 16 feet will require relief. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 60% relief from the code relative to the single yard set-back and 44% relief from the code relative to the combined side yard set-back. However, a residence has stood at this location for many years and the applicant proposed to make the current single side yard setback more conforming by shifting the southwest corner of the residence by about one foot, thereby making the west side yard set-back, more code conforming. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single-family residence measuring 32 feet by 61.8 feet with an attached waterside porch measuring 32 feet by 12 feet with a balcony above while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried, to GRANT the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin III, Licensed Land Surveyor and last revised June 7, 2018 and on the architectural drawings, labeled A-1, A-2, A-3, prepared by Charles M. Thomas, Registered Architect and dated June 5, 2018. SUBJECT TO THE FOLLOWING CONDITIONS:' 1. The first-floor covered porch, partially screened and measuring 32 feet by 12 feet,shall remain unenclosed, and unconditioned. 2. The second-floor waterside balcony, over the covered porch,shall remain open to the sky and unenclosed and unconditioned. 3. The applicant shall install an approved Suffolk County Board of Health I/A wastewater treatment system suitable for a five-bedroom residence. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible dental by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. On December 9, 2022 our surveyor, Nathan Taft Corwin III received notification from Suffolk County Health Services that was Notice of Incomplete Final. The office required us to expose a section of the water line where it enters the foundation and near drain grate drywell to confirm 10 feet separation and depth of water line. The waterline/ drain grate drywell inspection has been completed. The waterline inspection as it enters the foundation requires additional review because the inspector requested that the patio and landscaping must be removed for visualization from the outside. We are currently in the process of complying with the request. William Andes, our attorney, has submitted the completed documentation for the required verbiage in the deed which states the 20 feet buffer on the waterfront to Suffolk County. The deed has been amended and recorded in Suffolk County. In addition, he has submitted the documents to the Southold Board of Trustees. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the proposed accessory garage into more conformity with the code. No alternative proposals were offered by the applicant. The Board also requested submission of the original Notice of Disapproval dated April 21, 2016 which indicated that the proposed accessory garage included second floor habitable space that constituted a second dwelling that was not permitted by code. The applicant's agent stated at the hearing that the oversized garage currently proposed by the applicant was due to his need for storage and the oversized dormers were proposed for aesthetic reasons. Several neighbors expressed the belief that the proposed second story would eventually be used for living space. ADDITIONAL INFORMATION: The survey shows that there is a septic waste line going from the proposed garage to the septic tank. Several neighbors expressed their objections to the size and the non-conforming distance of the proposed garage from the property line. The property owners to the west voiced their concerns with excavation located so close to the property line in close proximity to several of her trees which may be destroyed if damage was done to their root system. The applicant's representative presented photographs of accessory garages she claimed were evidence of oversized garages on neighboring parcels, without indicating the size of the structures or the addresses on which the structures are located. She was asked to produce comparatives and evidence of prior variances granted or any legal proof such as certificates of occupancy that such non-conforming structures are legal. . FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance(s) will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although accessory garages are typical in this neighborhood, no credible evidence has been submitted documenting the existence of legally established accessory garages similar to the size and dimensional setback that is being proposed by the applicant, 2. Town Law 4267-b(3)(b)(2).The benefit sought by the,applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can build an accessory garage with dormers that conform to the Town Code. The configuration of the lot is deep and narrow, and to locate an accessory garage on the property while leaving sufficient safe clearance for driveway access and turn around, the applicant requires variance relief for a side yard setback from the property line. However,two feet is extremely close to the property line and may cause significant negative impacts to neighboring properties. 3. Town Law 4267-b(3)(b)(3). The variances requested herein are mathematically substantial, representing 37% relief from the code for the non-conforming size, 90% relief from the code for the non-conforming side yard setback, and 100%relief from the code for the non-conforming dormers, 4.
