SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated November 26, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 8, 2019. Based upon the information provided on the LWRP Consistency Assessment Form as well as records available, it is recommended that the proposed action is INCONSISTENT with the LWRP for the following reasons: A) The proposed action is located within the Coastal Erosion Hazard area and is subject to Chapter 111, Coastal Erosion Hazard Area of Southold Town Code; B) Pursuant to Policy 4, slopes located on the property, labeled as a "Bank", are equal to or greater than 20 percent, and further, site elevations on the submitted plans indicate that a bluff occurs on property pursuant to Chapter 275 Wetland and Shorelines of the Southold Town Code. The Southold Board of Trustees should be consulted to verify the feature. The accessory gazebo is proposed to be located within the FEMA Flood Zone AE, Elevation 11; C) The LWRP supports relocating non-water dependent structures outside of vulnerable areas (potential from erosion due to storm events) and as far from the natural feature as possible. The proposed accessory gazebo does not require a location on the coast and its use is not water dependent. Furthermore, the accessory gazebo could be re-located landward of the top of the bluff and outside the Coastal Erosion Hazard Area. To mitigate the aforementioned concerns, by installing a gazebo on top of the foundation, built over 100 years ago and once used to support a power plant, the structure would be better utilized. Removing the foundation would Page 2,April 25,2019 #7259 Wilmerding SCTM No 1000-9-9-3.1 cause adverse impacts during ground disturbance, and allowing the foundation to remain open would risk public safety. Based upon these factors and the conditions imposed herein, the Board of Appeals has determined that the proposed action is CONSISTENT with the LWRP PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 135,907 square foot(3.12 acre) waterfront parcel located in a Residential R-80 Zoning District. The northerly line measures 336.76 feet the easterly property measures 355.75 feet and is adjacent to Hay Harbor and a small 8.21foot piece of the property that extends out southwest and the westerly property measures 109.53 feet as shown on the survey map and site plan prepared by Richard H. Strouse,PE. LS of CME Associates Engineering,Land Surveying, &Architecture, PLLC, last revised October 29, 2018 The property is improved with a single-family dwelling that has had Town approved renovations and alterations. There is an old pump house foundation on the southeast corner of the property that the applicant wishes to renovate and build a gazebo on top of. The property does contain wetlands and is located within a Coastal Erosion Hazard Area as described in the LWRP Coordinator's response. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and the Building Inspector's October 9, 2018, Amended October 29, 2018 Notice of Disapproval based on an application for a permit to construct an accessory gazebo, a; 1) less than the code required minimum side yard setback of 25 feet; 2) less than the code required minimum rear yard setback of 25 feet; at: Reservoir Road, (Adj. to Hay Harbor) Fishers Island, NY. SCTM#1000-9-9-3.1. RELIEF REQUESTED: The applicant requests a variance to construct an accessory gazebo over an existing foundation. The proposed accessory, on this 135,907square foot lot in the Residential R-80 District, is not permitted pursuant to Article 111, Section 280-15, which states accessory buildings and structures on lots over 80,000 square feet in size require a minimum side yard and rear yard setback of 25 feet. The proposed gazebo will have a side yard setback of 8.5 feet and a rear yard setback of 21.5 feet. The applicant also wishes to build a 3 foot by 9-foot walkway to the gazebo. The new construction outside of the existing foundation's 144 square foot footprint will involve a 27 square foot walkway to the gazebo, a 20 square foot cantilevered projection and 145 square feet of roof overhang which will only increase the lot coverage by 3%. ADDITIONAL INFORMATION: In a letter dated June 25, 1993, the Southold Town Board of Trustees granted a waiver to construct a covered roof deck on top of an existing small pump house, and on June 15, 1993, the New York State Department of Environmental Conservation issued a non jurisdiction letter to the applicant to construct a roof top deck on top of an existing pump house. The applicant will apply for the necessary permits from the New York State Department of Environmental Conservation and the Southold Town Board of Trustees. The only other neighbor who could be impacted by this project has submitted a letter of support to this Board. The applicant will adhere to the height requirement for an accessory structure and satisfy 86% of the rear yard setback requirement. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 11, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b( A)M. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed gazebo will be built on the existing brick foundation of an old pump station. The as built foundation has been at that location for at least 100 years and is in disrepair. Its prior use has been abandoned for many years. The addition of the gazebo on top of the foundation will enhance the historic character of the property and the neighborhood. Enclosing the open foundation will eliminate a safety hazard. Gazebos are a common accessory structure in residential zone districts. Page 3,April 25,2019 #7259 Wilmerding' SCTM No. 1000-9-9-3.1 2. Town Law &267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The foundation has been in place for more than sixty years and any attempt to remove it may risk critical land disturbance. Moving the foundation to meet setback requirements is not a realistic option, not only due to the cost of doing so, but also due to environmental considerations. The gazebo will be built in a remote location and there will be no increase in noise or traffic. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial at 66% relief from the code relative to the rear yard setback and at 14% relief relative to the side yard setback. However, the proposed gazebo will be built on top of an existing foundation and will maintain the pre-existing non-conforming setbacks and repurpose an old historic structure 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Since the abandoned foundation was originally used as an old pump house, the foundation was designed to allow for the flow of water through it to prevent the threat of flooding. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a gazebo while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried, to GRANT the variance as applied for, and shown on the site plan prepared by Richard H. Strouse, PE, LS of CME Associates Engineering, Surveying&Architecture,PLLC last revised October 29,2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall obtain the proper permits from the New York State Department of Environmental Conservation and the Southold Town Board of Trustees. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation fi°om the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Page 4,April 25,2019 #7259 Wilmerding SCTM No. 1000-9-9-3.1 If the Building Department determines that the construction of additions and alterations, as described in this determination, exceed the scope of the approvals.granted herein, or a demolition has occurred, the Zoning Board of Appeals shall retain jurisdiction and shall have the right, after apublic hearing, to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within'three (3) years from the date such variance was granted. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposed action is recommended as INCONSISTENT with the LWRP. The proposed action is located within the Coastal Erosion Hazard area and is subject to Chapter 111 Coastal Erosion Hazard Area of the Southold Town Code. Policy 4. Minimizes loss of life, structures, and natural resources from flooding and erosion ArcMap indicates that slopes equal to or greater than 20 percent are located on the property(Figures 1 and 2). Further, site elevations on submitted plans indicate that a bluff occurs on property pursuant to Chapter 275 Wetland and Shorelines of the Southold Town Code. Note that the feature is labelled as a "Bank" on the plans. Southold Board of Trustees should be consulted to verify the feature. The accessory gazebo is proposed to be located within a FEMA flood zone AE elevation 11. The LWRP supports relocating non-water dependent structures outside of vulnerable areas (potential from erosion due to storm events) and as far from the natural feature as practicable. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. VARIANCES REQUESTED The applicant is requesting variances to the Southold Town Zoning Code (the"Zoning Code")to permit the construction of a new gazebo over an existing foundation at the southeast corner of his 3.12-acre parcel as shown on the Site Plan Prepared for Wilmerding Pump House prepared by CME Associates Engineering, Land Surveying & Architecture, PLLC,dated August 15,2017, last revised October 29, 2018(the"Site Plan"). Variances are required to construct the gazebo due to the pre-existing nonconforming location of the old foundation on which it will be erected. The old foundation has a side yard setback of 8.5 feet and a rear yard setback of 21.5 feet in this 1 lJ` R-80 Zone District where 25-foot setbacks for accessory structures are required for both side and rear yards under Section 280-15 of the Zoning Code. Since the new structure will be used as a gazebo, a permitted use in its R-80 Zone District, and the relief sought relates to the dimensional and physical requirements of the Zoning Code, the requested variances are area variances. Town Law § 267.1. Therefore, the standards of Town Law §267-b.3(b) apply. The factors to be considered by a zoning board of appeals in making a determination regarding an area variance under Town Law§267-b.3(b)are as follows: (1) the benefit to the applicant as weighed against the detriment to the health, safety and welfare of the neighborhood; (2) whether an undesirable change will be produced in the character of the neighborhood or to nearby properties; (3)whether the benefit sought can be achieved in another manner; (4) whether the variance is substantial; (5) whether the variance will have an adverse effect on physical or environmental characteristics; and (6) whether the alleged difficulty was self-created. An examination of the circumstances present in the instant matter in light of the foregoing factors follows. 1. Relative Benefit and Detriment. The applicant intends to build a gazebo in a residential zone for a residential use ancillary to the principal use of the single- family residence on his property. The existing foundation, the origin of which has been lost to history, is a solidly built masonry structure that has no current purpose. The applicant intends to make use of this foundation by creating an attractive new accessory structure over it with no change to its footprint other than the addition of a 3' x 9' walkway to it. The project will involve very little additional development on a very large lot which is almost 70% larger than the minimum lot area of 80,000 square feet required in its R-80 Zone District. Existing lot coverage on this 3.12-acre lot amounts to only 2.89%when 2 counting both the current 895 square-foot addition to the principal residence as well as the existing foundation for the proposed gazebo. New construction outside of the existing foundation's 144 square-foot footprint will involve a 27 square-foot walkway to the gazebo, a 20 square-foot cantilevered projection and 145 square feet of roof overhang which, even if all of the foregoing additions are counted toward lot coverage,will increase that coverage only to about 3%, less than one-sixth of the maximum 20%. Under these circumstances it is not unreasonable for the applicant to obtain the benefit of a gazebo, a use permitted under the Zoning Code and a not uncommon structure on Fishers Island. There should be no detriment to the health, safety or welfare of the neighborhood by the granting of the requested variance. The gazebo will be built in a remote location. There will be no increase in noise or traffic. While there will be some change to the physical characteristics at the site, the overall impact will be slight. 2. Character of the Neighborhood. The addition of the gazebo to the existing foundation will not result in an undesirable change in the neighborhood or to nearby properties. In the first place, the foundation already exists and the footprint of this accessory structure will not change. That structure will be repaired and improved. The only new nonconformity will be added above the existing one. The new structure will conform to the height requirement under the Zoning Code for accessory structures in the R-80 Zone District. Although it will not meet side and rear yard setback requirements, as can be seen from the Location Map on the Site Plan, the improved accessory structure will be located far from any street and will not even be visible by the general public except perhaps from the water. 3 As far as nearby properties are concerned, there is only one (the parcel adjoining the subject on the south) that would possibly be impacted by the new construction and the owner of that property, Sheila Kennedy, has advised your Board that she enthusiastically supports the project as an attractive addition to the neighborhood. (See her letter, dated April 4, 2019, attached hereto as Exhibit A.) 3. Alternatives. The applicant has no feasible alternatives other than to seek the requested relief. It is noteworthy that the foundation for the proposed gazebo has existed in its present size, configuration and location for at least 100 years. It is currently serving no discernable function and, while it can be utilized as a solid foundation for the gazebo, it is in need of some repair. The owner understandably not only wants to repair and improve this historic structure in place, he wants it to serve a practical ancillary use on his residential property. Moving the foundation to meet setback requirements is not a realistic option not only due to the cost of doing so but also due to environmental considerations. Improving the structure in its existing location,the alternative chosen in this case, will have the least impact on the environment. The foundation is located on a slope very close to Hay Harbor. To move it to a conforming place on the applicant's property would involve disturbance both to the area of its current location near to wetlands as well as to the area of any conforming position to which it might be moved. Based on the foregoing, utilizing the existing foundation in its present location is the only feasible alternative. 4. Substantial Nature of Variance. If the applicant were seeking approval for the construction of the gazebo in a nonconforming location when feasible 4 conforming locations were available,the nature of at least the side yard variance requested in this case would rightly be considered substantial. However, as discussed above, the proposed gazebo (a) will be constructed over an existing foundation in an area that has already been disturbed; (b) will meet the height requirement for an accessory structure and satisfy 86% of the rear yard setback requirement; and (c) will increase lot coverage only to 3%, just 15% of the maximum allowed. In light of these factors as well as the absence of an adverse impact on the neighborhood or the environment, the variances requested are not substantial in nature. 5. Impact on Physical and Environmental Conditions. Thanks in part to the relatively small area affected in relation to the size of the subject parcel, resulting in a minuscule increase in lot coverage,the impact of the project on physical and environmental conditions should be slight. The repairs to and improvement of the existing foundation for the construction of the new gazebo will involve little additional disturbance to an area that has been previously disturbed. Moreover, construction activities should produce no adverse environmental consequences. Indeed, in 1993 the then owner of the subject property received (a) a letter confirming that a similar project was out of the jurisdiction of the State Department of Environmental Conservation and (b)a waiver for that project from the Board of Town Trustees. Copies of that letter of non-jurisdiction and waiver are attached hereto as Exhibit B. The applicant understands that, given the laws in place in 2019, he will likely have to secure a permit for the project from the Board of Town Trustees and he is prepared to do so and comply with any conditions thereto if the requested variances are granted. However, we take issue with the finding of"Inconsistent" by the Town's LWRP Coordinator in his report to your Board, dated April 8, 2019, and ask you ,that you make a 5 determination that the project is in fact "Consistent" with respect to at least four general policies under Town Code Section 268-5.1. A finding of consistency with all of these policies is warranted primarily by one essential fact that the LWRP Coordinator seems to have ignored in his report: the old foundation to be utilized forthe new gazebo is not being added to the site, it already exists and its location will not be changed. Consistent with Policy 1, the project will "foster a pattern of development in the Town of Southold that ... makes efficient use of infrastructure [and] makes beneficial use of a coastal location". The old foundation on which the gazebo will be constructed is already in existence in its current coastal location and the new gazebo will take advantage of and improve that structure in the same location. Consistent with Policy 2, the,project will "preserve historic resources of the Town of Southold". As reflected in the article by Island historian Pierce Rafferty attached hereto as Exhibit C(pertinent provisions highlighted),the principal residence on the subject property was once a power plant that was almost certainly designed by renowned architect Bruce Price. The old foundation apparently serviced the power plant/residence in some capacity, perhaps with a pump drawing water from Hay Harbor for use in the power plant. The applicant's project will repair, preserve and improve this historic structure. Consistent with Policy 3, the project will "enhance visual quality and protect scenic resources". What is now an eyesore in need of repair will become an attractive accessory structure in the same location. Moreover, dangerous features of the existing foundation, including a 10-foot deep cavity exposed by an open window and door, will be ameliorated by the new construction. Consistent with Policy 4, the project will minimize the"loss of life, structures, and natural resources from flooding and erosion". Incredibly, the Town's LWRP report 6 suggests on page 2 that the"accessory gazebo could be re-located landward of the top of the bluff and outside the Coastal Erosion Hazard Area". Merely by repairing and improving the foundation in its current location,thereby avoiding the extreme damage to the bluff that would be caused by its removal and relocation, the applicant is minimizing erosion. Ameliorating some currently dangerous conditions is also consistent with Policy 4. 6. Self-Created Hardship. The issue of self-created hardship is not pertinent here. The applicant is applying to your Board for relief prior to undertaking his project. His right to variances depends on the circumstances peculiar to this property and, absent other factors, is the same right as any prior owners have had and any future owners would have. CONCLUSION For the foregoing reasons and in the interests of justice, the variances requested in order to permit the applicant to proceed with his project should be granted. I am referring to today's Macleod residence (a.k.a.the"Garp House")that was originally constructed for Robert P. Linderman,founder of Bethlehem Steel,and today's Baccile residence,originally built for banker and industrialist Garrett B. Linderman, Robert's brother. Several interested people—including architect Jim Righter, Helene Van Oosten,and yours truly—have spent considerable time over the past few decades trying to discover the architects of these two houses.Linderman family members and others have floated vari- ous names,including Addison Hutton, Bruce Price,and Stanford White.Several weeks ago,while doing related online research, I serendipitously stumbled upon—and later confirmed—the architect of the Macleod house.The story unfolded as follows: After Jean Wilmerding visited the Museum in mid July, I googled various Linderman name combinations to locate an article for her about R.P.Linderman's private power plant on Fishers Island.While sifting through the lists of documents that turned up in that search, I followed a link to page 890 of"Real Estate Record and Builder's Guide,v.67, No. 1731:May 18, 1901."Half way down the column on the right hand side was the following text under the heading"Country Work of New York Architects": 'Fishers Island, N.Y.--Summer residence;cost$30,000:R.P.Linderman, 100 Broadway,owner,•Bruce Price, 1135 Broadway,Architect,J.H. L Hommedieu&Sons Co., 1135 Broadway, carpenters." I immediately sent an e-mail to Jacob Albert and Jim Righter of Albert, Righter&Tittmann Architects,Boston,announcing the news that architect Bruce Price was the likely suspect as far as the Macleod house was concerned.Bruce Price,for those who don't know,was a renowned American architect,much associated with Tuxedo Park, N.Y.,who also happened to be the father of Emily Post,best selling author of etiquette books.Jim and Jacob responded to the news with guarded optimism,reminding me that the R.P.Linderman house is not on the master list of Bruce Price commissions,where one would expect to find such a prominent house.Regardless, I decided to press the search further and ran a few more"Bruce Price"online searches.Much to my surprise, the photograph reprinted here popped up as a"buy it now"item on eBay. It had originally been printed in a 1903"Country Life" magazine.
