Schermeyer Town Clerk Generated 2/14/2019 Page 1 Southampton Town Board - Letter Board Meeting of February 12, 2019 TOWN BOARD RESOLUTION 2019-225 Item # 7.58 ADOPTED DOC ID: 31102 Notice of Public Hearing to Amend Town Code Chapter 330 Section 320 to Increase the Number of Members on the Landmarks & Historic Districts Board from Nine to Eleven BE IT HEREBY RESOLVED, that the Town Board hereby directs that a public hearing shall be held on March 26, 2019 at 6:00 p.m., at Southampton Town Hall, 116 Hampton Road, Southampton, New York, to hear any and all persons either for or against “A LOCAL LAW to consider amending Article XXVIII entitled 'Landmarks and Historic Districts and Heritage Resource Areas' Chapter 330 Section 320 of the Town Code of the Town of Southampton to increase the number of members to serve on the Landmarks and Historic Districts Board from nine to eleven” which provides as follows: LOCAL LAW NO. OF 2019 A LOCAL LAW amending Article XXVIII entitled 'Landmarks and Historic Districts and Heritage Resource Areas' Chapter 330 Section 320 of the Town Code of the Town of Southampton to increase the number of members to serve on the Landmarks and Historic Districts Board from nine to eleven. BE IT ENACTED by the Town Board of the Town of Southampton as follows: SECTION 1. Legislative Intent. The Town Board of the Town of Southampton seeks to increase the number of members to serve on the Landmarks and Historic Districts Board from nine to eleven to allow for a more inclusive membership and participation by the Town's residents. SECTION 2. Amendment. Chapter (or section) 330-320 of the Southampton Town Code is hereby amended by deleting the stricken words and adding the underlined words as follows: §330-320. Landmarks and Historic Districts Board. \[Amended 8-12-2003 by L.L. No. 63-2003; 4-12-2005 by L.L. No. 13-2005; 8-9- 2005 by L.L. No. 40-2005\] A. The Town Landmarks and Historic Districts Board is hereby established. The Board shall consist of nine eleven Town residents to be appointed by the Town Board and to the extent available in the community, shall be representative of the entire Southampton Town community and drawn from the following disciplines: architecture, architectural history, archaeology, local history, law, historic preservation and real estate. All members shall have demonstrated significant interest in and commitment to the field of historic preservation or related fields and shall have a known interest in historic, cultural, and architectural development within the Town of Southampton. The Southampton Town Historian shall serve as an ex-officio member of the Landmarks and Historic Districts Board. SECTION 3. Authority. Generated 2/14/2019 Page 2 Southampton Town Board - Letter Board Meeting of February 12, 2019 This amendment is enacted pursuant to Municipal Home Rule Law §10. SECTION 4. Severability. If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provisions so adjudged to be invalid or unconstitutional. SECTION 5. Effective Date. This local law shall take effect upon filing with the Secretary of State pursuant to Municipal Home Rule Law. AND BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized to publish the following Notice of Public Hearing: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that a public hearing will be held by the Town Board of the Town of Southampton on March 26, 2019 at 6:00 p.m. at the Southampton Town Hall, 116 Hampton Road, Southampton, New York to hear any and all persons either for or against “A LOCAL LAW to consider amending Article XXVIII entitled 'Landmarks and Historic Districts and Heritage Resource Areas' Chapter 330 Section 320 of the Town Code of the Town of Southampton to increase the number of members to serve on the Landmarks and Historic Districts Board from nine to eleven.” Summary of Proposed Law This amendment proposes to increase the number of members of the Landmarks and Historic Districts Board from nine to eleven.
