Resolution of Adoption to Amend Town Code Chapter 330
Section 320 to Increase the number of Members on the
Landmarks & Historic Districts Board from Nine to Eleven
WHEREAS, the Town Board is considering amending Article XXVIII entitled 'Landmarks and
Historic Districts and Heritage Resource Areas' Chapter 330 Section 320 of the Town Code
to increase the number of members on the Landmarks & Historic Districts Board from nine
to eleven; and
WHEREAS, a public hearing was held by the Town Board of the Town of Southampton on
March 26, 2019, at which time all persons either for or against said amendment were
heard; and
WHEREAS, the Department of Land Management has advised the Town Board that this
proposed local law is considered a “Type II Action” under 6 NYCRR Part 617.5, provisions of
the New York State Environmental Quality Review Act (SEQRA) and Chapter 157 of the
Town Code, and that no further review under New York Conservation Law, Article 8, is
necessary; now therefore be it
RESOLVED, that Local Law No. 13 of 2019 is hereby adopted as follows:
LOCAL LAW NO. 13 OF 2019
A LOCAL LAW amending Article XXVIII entitled 'Landmarks and Historic Districts and
Heritage Resource Areas' Chapter 330 Section 320 of the Town Code to increase the
number of members on the Landmarks & Historic Districts Board from nine to eleven.
BE IT ENACTED by the Town Board of the Town of Southampton as follows:
Section 1. Legislative Intent.
The Town Board of Southampton seeks to increase the membership of the Landmarks &
Historic Districts Board from nine to eleven to allow for a more inclusive membership and
participation by the Town’s residents.
Section 2. Amendment.
Town Code §330-320 of Chapter 330, is hereby amended by deleting the stricken words
and adding the underlined words as follows:
§330-320. Landmarks and Historic Districts Board.
A. The Town Landmarks and Historic Districts Board is hereby established. The Board
shall consist of nine eleven Town residents to be appointed by the Town Board and
to the extent available in the community, shall be representative of the entire
Southampton Town community and drawn from the following disciplines:
architecture, architectural history, archaeology, local history, law, historic
preservation and real estate. All members shall have demonstrated significant

interest in and commitment to the field of historic preservation or related fields and
shall have a known interest in historic, cultural, and architectural development within
the Town of Southampton. The Southampton Town Historian shall serve as an ex-
officio member of the Landmarks and Historic Districts Board.
Section 3. Authority.
The proposed local law is enacted pursuant to Municipal Home Rule Law §§10(1)(ii)(a)(11)
and 10(1)(ii)(a)(12).
Section 4. Severability.
If any section or subsection, paragraph, clause, phrase, or provision of this law shall be
adjudged invalid or held unconstitutional by any court of competent jurisdiction, any
judgment made thereby shall not affect the validity of this law as a whole, or any part
thereof other than the part or provision so adjudged to be invalid or unconstitutional.
Section 5. Effective Date.
This local law shall take effect upon filing with the Secretary of State pursuant to Municipal
Home Rule Law.
AND BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to
publish the following Notice of Adoption:
NOTICE OF ADOPTION
TAKE NOTICE, that after a public hearing was held by the Town Board of the Town of
Southampton on March 26, 2019, the Town Board, at its meeting of April 9, 2019, adopted
LOCAL LAW NO. 13 OF 2019, as follows: “A LOCAL LAW amending Article XXVIII entitled
'Landmarks and Historic Districts and Heritage Resource Areas' Chapter 330 Section 320 of
the Town Code of the Town of Southampton to increase the number of members to serve on
the Landmarks and Historic Districts Board from nine to eleven.”
Copies of the proposed law, sponsored by Supervisor Jay Schneiderman and Councilman
John Bouvier, are on file in the Town Clerk’s Office, Monday through Friday, from 8:30 a.m.
to 4:00 p.m.
