The code specifies that Article 58-1 applies when there is a public hearing and requires a published notice, the erection of a sign, and the sending of a notice to abutting property owners.This is the second issue. I did see the published notice in the Traveler Watchman on May 8, 2003. Upon checking the application in the Trustees Office, I discovered that the spoils are planned to be placed at the eastern end of Old Harbor Road seaward of a bulkhead. This is a major change in the original permit and 1 need to ask why is this an Amendment and not a New Permit? I have included a picture that my wife recently took which shows the soil from Old Harbor Road running into Cutchogue Harbor and directly into School House Creek. The intended spoil area is not an upland location and the spoil will be washed into the harbor by the runoff through the large culvert, which drains Old Harbor Road, as well by the ebb and flow of the tide. The Town Highway Department has repeatedly replaced this drainpipe at the end of the road due to constant wash outs.This is the third issue. The fourth and essential issue, which needs to be addressed, is the ability of anyone to dredge the side of the creek,which 1 have deeded, rights to without my concurrence. This is the same issue, which the Trustees addressed, in their Public Meeting of December 6, 1993 and Special Meeting of December 21, 1993 of which 1 was never informed of nor notified of the actions taken. At these meetings the Trustees rescinded and then subsequently suspended my Permit#439 issued an November 25, 1987 for bulkheading, a floating dock and additions at my house. This occurred in spite of the correspondence dated May 28, 1991 to Mr. Tuthill by John M. Bredemeyer, III where it was stated that "You have failed to provide this office with a title search as requested in my letter of June 4, 1990 and former Board President, Frank Kujawski's letter of August 15, 1989. To ascertain Trustee ownershiprnteres% if any, in the lands beneath School House Creek and it's tributaries, the Board will need to see a title search which goes back to October 28, 167&"There is nothing in either my file or Mr.Tuthill's file, which explains the Trustee's action of December 6 and 21 of 1993 except possibly a letter dated • Page 2 May 21,2003 December 2, 1993 from Roderick Van Tuyl, P.C. to the Southold Town Trustees which references three surveys submitted and concludes " It is not our province to justify the individual claims in this matter, but to report the lines as requested." It is interesting to note that the Tuthill survey submitted shows a Deed Line referencing Liber 7374 Page 110 and having a bearing of N-6 degrees 10' 50" E. If you read L7374 P 110 there is absolutely no reference to such a bearing. Further more in the original 13 Colonies, a surveying system using metes and bounds is in place and this would require that such a bearing line have a beginning and ending point to show its extent. 1 have brought up the issue of what transpired in these December 1993 meetings with the Trustee's several times since the beginning of April as well as with the Assistant Town Attorney Pat Finnegan and have never received any explanation of what transpired. You suspended my Permit until such time as the ownership in question is adjudicated. 1 MUST POINT OUT THAT THIS ENTIRE PROCESS WAS COMPLETED IN 1993 WITHOUT EVER EXTENDING ME THE COURTESY OF ANY NOTIFICATION OR INVITATION TO DISCUSS OR REBUTE YOUR ACTIONS. THIS HAS REMAINED A SECRET FROM ME FOR TEN YEARS. 1 FIND THIS COMPLETELY UNACCEPTABLE PROCEDURE ON PART OF THE TRUSTEES. Your clandestine actions have caused me considerable grief, time and expense in resolving this situation due to a summons 1 received in April for "not having a permit" Since the deed to my land (Liber 10333 Page 509 dated 5/20/87, preceded by Liber 8370 Page 386 dated 12129177, and preceded by Liber 7374 Page 119 dated 9/22/72) contains the "right, title and interest of the parties of the first part, if any, of, in and to the waters and lands under the waters of School House Creek adjacent to the herein conveyed premises, to the center line thereof" as does Mr. Tuthills deed (Liber 7374 Page 109 dated 9/22/72) you can not grant the permission to dredge the creek based on the precedent established as a result of your 1993 actions. I must also point out that I object to the dredging since my bulkhead is being eaten away by worms and the sand next to it is preventing further destruction. For any dredging to occur next to my bulkhead, it will be necessary to provide protective measures to preserve the bulkhead from further and future damage.This will be a condition of any dredging of the creek to be performed. IN SUMMARY THERE ARE MANY ISSUES THAT ARE UNRESOLVED WITH THE APPLICATION ALL OF WHICH NEED TO BE ADDRESSED.
