Re: Final Approval — 260 Hortons Lane Resubdivision
Located at 260 Hortons Lane, Southold, NY
SCTM#1000-61.-1-3.1 & 9.4 Zoning District: HB
Dear Mr. Hagan:
The Southold Town Planning Board adopted the following resolutions at a meeting held
on Monday, January 11, 2021:
WHEREAS, this resubdivision proposes to transfer 0.074 acres (3,240 sq. ft.) from
SCTM#1000-61.-1-9.4 to SCTM#1000-61.-1-3.1; and
WHEREAS, as a result of this resubdivision, Lot 9.3 will decrease in size from 2.53
acres to 2.46 acres and Lot 3.1 will increase in size from 0.48 acres to 0.55 acres in the
HB Zoning District; and
WHEREAS, the properties are located at 260 Hortons Lane and 53095 State Route 25,
on the east side of Hortons Lane, +/- 250' northwest of SR 25 in Southold; and
WHEREAS, on April 15, 2019, the applicant submitted a resubdivision application for
review by the Southold Town Planning Board; and
WHEREAS, on May 6, 2019, the Planning Board found the resubdivision application
complete at their Work Session; and
WHEREAS, on May 6, 2019, that the Planning Board, pursuant to §240-56 Waivers of
certain provisions, waived the following provisions of subdivision;

a. Article V. Sketch Plat Review
b. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP)
c. §240-10 (B):Yield Plan
d. §240-10 (C): Primary & Secondary Conservation Area Plan
e. Article VI: Preliminary Plat Review; and
WHEREAS, on May 30, 2019, the application was referred to the Suffolk County
Planning Commission for comment; and
WHEREAS, on June 3, 2019, the Public Hearing was held and closed without comment;
and
WHEREAS, on June 24, 2019, the Suffolk County Planning responded that this
application should be a matter for local determination; and
WHEREAS, pursuant to the resubdivision policy set by the Planning Board in February
2011, this application is eligible for decision from the Planning Board prior to receiving
approval by the Suffolk County Department of Health Services (SCDHS) as it meets the
following criterion set forth in that.policy:
Where no new development potential will be created in the parcel to which the
land is transferred; and
WHEREAS, this application is EXEMPT from review by the Local Waterfront
Revitalization Program as no new development potential will come as a result of this
resubdivision; and
WHEREAS, on July 8, 2019, at their Work Session, the Planning Board found the
resubdivision application complete and determined that the proposed action meets all
the necessary requirements of Town Code §240-57 for a resubdivision application; and
WHEREAS, on July 8, 2019, the Planning Board granted final approval for this
resubdivision; and
WHEREAS, the final approval has since expired before the deeds were filed; and
WHEREAS, the Planning Board has reviewed a request to re-issue the final approval;
therefore be it
RESOLVED, that the Southold Town Planning Board hereby waives the requirement to
receive approval from the Suffolk County Department of Health Services prior to
approval of this resubdivision by the Southold Town Planning Board and be it further
RESOLVED, that the Southold Town Planning Board grants Final Approval upon the
plan entitled, "Lot. Line Modification Map of Property", prepared by Nathan Taft Corwin
III, Land Surveyor, dated November 11, 2016, last revised May 22, 2017.

Please Note: The Southold Town Planning Board, in waiving the requirement for
SCDHS approval prior to their own approval, is simply waiving a technical
requirement of Final Plat Approval under the Town Code and makes no
representations as to whether SCDHS approval is required.
SCDHS approval of this resubdivision may be necessary to be in compliance with the
Suffolk County Sanitary Code, and to be eligible for future construction or renovations.
Please submit a copy of the recorded deed to the Southold Town Planning Department
within 62 days of the date of Final Approval, or such approval shall expire and be null
and void.
The statement below MUST be signed by the property owners and returned to the
Planning Department to validate this approval resolution.
The signed Final Approval resolution must be brought to the Suffolk County Clerk's
Office when filing the deeds to accomplish the resubdivision for certification of the
Planning Board's approval.
I understand that Southold Town Planning Board approval of this resubdivision
does not grant, guarantee or waive an approval, if required, from the Suffolk
County Department of Health Services (SCDHS). I understand that I will need to
apply separately to the SCDHS for any applicable approvals.

On May 6, 2019, the Planning Board waived the following provisions of
subdivision pursuant to Town Code §240-56 Waivers of Certain Provisions:

c. Yield Plan - §240-10 (8)
d. Primary & Secondary Conservation Area Plan - §240-10 (C)
e. Preliminary Plat- Article VI
The recommendation to waive the above listed provisions of subdivision is
justified by the reasons listed below:
1. The two lots are already developed and affirming this lot line change will
not affect the character of the community. This application will correct the
lot line that runs through the existing barn so that the barn is entirely on
proposed Lot 1.
On May 6, 2019, the Planning Board also classified the action as a Type II action
under SEQRA and set the Public Hearing for June 3, 2019.

Dear Mr. Hagan:
The Southold Town Planning Board adopted the following resolutions at a meeting held
on Monday, May 6, 2019:
WHEREAS, this resubdivision proposes to transfer 0.074 acres (3,240 sq. ft.) from
SCTM#1000-61.-1-9.4 to SCTM#1000-61.-1-3.1; and
WHEREAS, as a result of this resubdivision, Lot 9.3 will decrease in size from 2.53
acres to 2.46 acres and Lot 3.1 will increase in size from 0.48 acres to 0.55 acres in the
HB Zoning District; and
WHEREAS, the properties are located at 260 Hortons Lane and 53095 State Route 25,
on the east side of Hortons Lane, +/- 250' northwest of SR 25 in Southold; and
WHEREAS, on April 15, 2019, the applicant submitted a re-subdivision application for
review by the Southold Town Planning Board; and
WHEREAS, on May 6, 2019, the Southold Town Planning Board found the
resubdivision application complete at their Work Session; and
WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town
Planning Board shall have the authority to modify or waive, subject to appropriate
conditions, any provision of these subdivision regulations, if in its judgment they are not

requisite in the interest of the public health, safety and general welfare, except where
such authority would be contrary to other ordinances or state law; and
WHEREAS, the Southold Town Planning Board has determined that the following
provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the
interest of the public health, safety and general welfare because this resubdivsion is not
creating any new development potential and the amount of land being transferred is
very small, and therefore, are eligible for a waiver:
a. Sketch Plat Review
b. Existing Resources Site Analysis Plan (ERSAP)
c. Yield Plan
d. Primary & Secondary Conservation Area Plan
e. Preliminary Plat Review
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is a Type II Action under SEQRA according to 617.5(c)(16) "granting of individual
setback and lot line variances and adjustments,"; be it therefore
RESOLVED, that the Southold Town Planning Board hereby classifies this proposed
action as a Type II Action under SEQRA as described above; and be it further
RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of
certain provisions, hereby waives the following provisions of subdivision;

On August 15, 1984, the Planning Board approved of a set off for the Academy
Printing Services, which created the two parcels adjacently located to the north of
the subject parcels. Currently, SCTM#1000-61.-1-2.1 remains in the same
configuration and continues to be used for printing services.

On March 3, 2007, Southold Town claimed the parcel to the rear of Academy
Printing Services, as well as the rear of the subject lot located at 260 Hortons
Lane in eminent domain.
When the Town claimed the land, there were intentions to move the existing barn
located on 260 Hortons Lane in efforts to complete expansions of the Town Hall,
which were never completed.
Currently, the barn located on SCTM#1000-61.-1-3.1 lies halfway on the subject
parcel, and halfway on SCTM#1000-61.-1-9.4, the parcel where the Southold
Town Hall is located.
This resubdivision seeks to move the rear property line to place the barn entirely
on lot 3.1, proposed Lot 1, so that it is no longer encroaching onto the property
belonging to the Town Hall SCTM#1000-61.-1-9.4, proposed Lot 2.

Waivers
Pursuant to Town Code §240-56 Waivers of Certain Provisions, the Planning
Board may waive certain elements of the subdivision review
§240-56 Waivers of certain provisions.
"The Planning Board shall have the authority to modify or waive, subject to
appropriate conditions, any provision of these subdivision regulations, if in its
judgment they are not requisite in the interest of the public health, safety and
general welfare, except where such authority would be contrary to other
ordinances or state law."
After reviewing the information submitted for this application, it is recommended
that the Planning Board waive the following requirements and steps of the
subdivision review process, as they are they are not requisite in the interest of
the public health, safety and general welfare:

Enclosed please find the requisite forms for a lot line modification at the above referenced property.
The proposed lot line request will correct and an issue regarding a long preexisting barn which rests on
the current lot line. By modifying the lot line as set forth in the application the pre existing barn will fall
within the new lot line boundary. The applicant is the Town of Southold which owns the property which

1. Pre-submission conference
2. Submit complete Re-Subdivision Application (see Checklist for Re-Subdivisions)
3. Application reviewed to determine if the proposal is eligible for a waiver pursuant
to Town Code § 240-57 Waiver, ad-j ustnient of property lines. If eligible,the
re-subdivision may be authorized by the Planning Board by resolution and no
further review will be required. However, if the project is ineligible for a
waiver, the application will be processed as indicated.
4. Referrals to other agencies as needed.

6. Public Hearing (the public hearing may be waived in certain cases)

8. Record deeds in the Office of the Suffolk County Clerk and send a copy to the
Planning Department for our records
Please note the following:
• Suffolk County Department of Health Services approval may be required for
lot line modifications. In some situations existing County Health Department
approvals may be sufficient, or certain lots may be exempt (refer to Suffolk
County Sanitary Code—Article 6 §760-601 —609 for more details). In other
cases,the Planning Board may waive the requirement for SCDHS approval prior
to Planning Board approval (see attached Planning Board Policy).
• Subdivision process. While the Town Code requires re-subdivisions to be
processed the same as a standard subdivision, in many cases the Planning Board
has the ability to waive many of the requirements where it can be shown that the
public health, safety and welfare will not be affected by the lot-line modification.

FEBRUARY 14,2011:
WHEREAS, the Southold Planning Board has found that applications for lot line modifications
(re-subdivisions) often involve very minor adjustments of lot lines, or adjustments that result in
no new development potential; and
WHEREAS, the Southold Planning Board,pursuant to §240-56 of the Town Code,has the
authority to waive certain requirements in the subdivision review process; and
WHEREAS, the Southold Planning Board,by way of this policy, intends to simplify and shorten
the application process for certain lot line modification(aka re-subdivision)requests by reducing
the number of agency approvals necessary prior to Planning Board approval;
NOW, THEREFORE, BE IT
RESOLVED that the Planning Board of the Town of Southold hereby adopts the"Lot Line
Modification/Re-subdivision Application Process Policy" as follows:
Lot Line Modification/Re-subdivision Application Process Policy
The following applications for lot line modifications (re-subdivisions) are eligible for a decision
from the Southold Planning Board prior to receiving approval by the Suffolk County Department
of Health Services (SCDHS):
1. The transfer of land from an oversized parcel (larger than the minimum zoning requires)
where the oversized parcel remains above the minimum lot size required, and where no
new development potential will be created in the parcel to which the land is transferred.
2. The transfer of land between two or more parcels, all of which are currently developed
and can produce legal certificates of occupancy,which results in no new development
potential.
3. The transfer of land between two or more parcels, vacant or developed, where the
SCDHS has previously approved the subdivision map, and where the two lots will remain
at or above the minimum lot size required by zoning.
4. Other situations where the Planning Board finds the amount of land being transferred is
negligible will result in no additional residential units being developed, and that there will
be no impact to wetlands or other sensitive environmental features.
The Planning Board shall formally waive the requirement for SCDHS approval by resolution
prior to their decision resolution. The following language shall also be included in every
Planning Board decision resolution containing the waiver of the requirement for SCDHS
approval:
`The Southold Town Planning Board, in waiving the requirement for SCDHS approval
prior to their own approval, is simply waiving a technical requirement of final plat
approval under the Town Code and makes no representations as to whether SCDHS
approval is required. SCDHS approval of this lot line change may be necessary to be in
compliance with the Suffolk County Sanitary Code, and to be eligible for future
construction or renovations.'
The following clause will also be inserted at the end of the resolution and the applicant required
to sign a copy for our files:
`I understand that Southold Town Planning Board approval of this lot line modification
does not grant, guarantee or waive an approval, if required, from the Suffolk County
Department of Health Services. I understand that I will need to apply separately to the
SC HS baa y applicable approvals.'

RESOLUTION:
WHEREAS, 260 Horton's Lane, Southold,NY is on the Town of Southold,New York State
and National Registers of Historic Places,and
WHEREAS, as set forth in Section 56-7(b)of the Town Law(Landmarks Preservation Code)
of the Town of Southold,all proposals for material changetalteration must be
reviewed and granted a Certificate of Appropriateness by the Southold Town
Landmarks Preservation Commission prior to the issuance of a Building Permit,
and
WHEREAS, an application was submitted to reconstruct the south wall of the structure to its
original fagade, including a"back porch"area,as well as to remove the front
(west)vestibule and reconstruct the structure's original porch.
WHEREAS commissioners previously approved an administrative permit for limited
restoration and repair work to the structure.
WHEREAS commissioners met with the applicant to review the proposed project on site, and
WHEREAS, a public hearing for the purpose of considering approval of the proposal was held
on November 17, 2015,and,
WHEREAS, the applicant has agreed to use the Anderson 200 series 2 over 2 windows as
noted in photos presented during the public hearing and trimmed to match the
existing windows,
NOW THEREFORE RF IT RFSOLV ED,that the,Southold Town Historic Preservation
Commission determines that the proposal as outlined in plans with the revision date of 11.7.15
and marked Al,A2&A3, subject to final stamped drawings to be submitted to the Southold
Town Building Department,meet the criteria for approval under Section 170-8 (A)of the
Southold Town Code.
BE IT FURTHER RESOLVED,that the Commission approves the request for a Certificate of
Appropriateness.
