600 Madison Avenue, Suite 2001, New York, NY 10022, "Party of the First Part", and
HARVEST POINTE HOMEOWNERS ASSOCIATION, INC., a New York not-for-profit
corporation, having an office at 825 Third Avenue, Suite 1801, New York, NY, 10022-
7519"Party of the Second Part",
WITNESSETH :
THAT the Party of the First Part, in consideration of Ten Dollars ($10.00)
and other good and valuable consideration paid by the Party of the Second Part, does
hereby grant and release unto the Party of the Second Part forever,
ALL THOSE CERTAIN PLOTS, PIECES OR PARCELS OF LAND,
situate, lying and being located in Cutchogue, Town of Southold, Suffolk County and
State of New York, designated as District 1000, Section 102.00, Block 01.00, and Lot
033.007 on the Suffolk County Tax Map, and shown as "Property of Harvest Pointe
Homeowners Association, Inc." on the Unit Designation Map of "Harvest Pointe
Condominium I", filed in the Office of the Clerk of Suffolk County on January 9, 2018 as
File No. 471 and more particularly described in Schedule "A" annexed hereto and made
a part hereof.
BEING AND INTENDED to be part of the premises conveyed to the Party
of the First Part by deed made by Nocro Ltd., dated March 31, 2017, and recorded on
April 27,2017 in Liber 12910 Page 370, in the Office of the Clerk of Suffolk County
SUBJECT to the Declaration of Covenants, Restrictions, Easements,
Charges and Liens of the Party of the Second Part, as same may be amended from
time to time, recorded in the Office of the Clerk of Suffolk County on January 9, 2018 in
Liber D00012945, page 278, and the By-Laws of the Party of the Second Part.
SUBJECT to the Declaration of Condominium made by the Party of the
First Part establishing a plan for condominium ownership of Premises located at
Cutchogue, Town of Southold, Suffolk County, State of New York, pursuant to Article 9-
B of the Real Property Law of the State of New York dated November 7, 2017 and
recorded in the Office of the Clerk of Suffolk County on January 9, 2018 in Liber 12945
Page 279, and the By-Laws of HARVEST POINTE CONDOMINIUM I.
SUBJECT to any and all other covenants, conditions, restrictions,
reservations, easements, charges and liens of record.
TOGETHER with the appurtenances and all the estate and right of the
Party of the First Part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the Party of
the Second Part, its successors and assigns forever.
AND the Parry of the First Part, in compliance with Section 13 of the Lien
Law, covenants that the Party of the First Part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
The word "Party" shall be construed as if it read "Parties" whichever the
sense of this Indenture so requires.
The words "Party of the First Part" and "grantor" and 'Party of the Second

Part" and "grantee" shall be construed to include their respective grantees, heirs,
executors, administrators, legal representatives, successors and assigns.
