BETWEEN EDWARD L. DALEY, III and DIANE L. DALEY, husband and wife, both
residing at 916 Hudson Street, Hoboken, New Jersey 07030,
"party of the first part",
AND
EDWARD L. DALEY III, Trustee of the EDWARD L. DALEY III
REVOCABLE TRUST, as to a 50% interest, and DIANE L. DALEY, Trustee of the DIANE L.
DALEY REVOCABLE TRUST, as to a 50% interest, both having an address at 916 Hudson
Street, Hoboken, New Jersey 07030, as tenants in common,
"party of the second part",
WITNESSETH:
That the party of the first part, in consideration of One and 001100 ($1.00) Dollar and
other valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second
part, forever,
ALL of their interest in that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the Town of Southold, County of
Suffolk, State of New York, bounded and described as follows:
SEE ATTACHED "SCHEDULE A DESCRIPTION"
Said premises being known as 1350 Paradise Point Road, Southold, New York.
BEING the same premises conveyed to the party of the first part by Deed from Steven T.
Kolyer and Andrea Kolyer, husband and wife, dated January 3, 2017 and recorded on January
27, 2017 in Liber D00012898 at Page 273 in the Office of the Suffolk County Clerk.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and
to any streets and roads abutting the above-described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.

AND the party of the first part conveys the premises subject to a mortgage, however, said
mortgage is to remain the responsibility of the party of the first part and is not being assumed by
.the party of the second part.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for the conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.

Southold, in the Town of Southold, County of Suffolk and State of New York, being more
particularly bounded and described as follows:
BEGINNING at a monument set on the easterly side of Paradise Point Road distant North 24
degrees 53 minutes 20 seconds East, 1,254.97 feet northeasterly as measured along
the easterly side of Paradise Point Road from the corner formed by the intersection of the northerly
side of Cedar Beach Road with the easterly side of Paradise Point Road said point also being the
northwesterly corner of land now or formerly of Miller;
