Sepenoski Jr. Tom Stevenson Mark VanBourgondien Councilman Bill Ruland Opening: The meeting of the Agricultural Advisory Committee was called to order at 7:05 pm on March 6, 2019 in the Southold Town Hall conference room. Minutes and Administration: • Acceptance of meeting minutes of February 20, 2019. o Motion made by Mark VanBourgondien, seconded by John B. Sepenoski Jr. to adopt the Agricultural Advisory meeting minutes of February 20, 2019. All in favor, motion carried. Next Meetinq(s): • Joint AAC and Code Committee Meeting on 3/13/19 at 2:30 in the Southold Town Annex Executive Board Room. • The next regular AAC meeting is scheduled for Wednesday March 20, 2019 at 7:00 pm in the Southold Town Hall Conference room. Review Proposed Acquisition of Development Rights: • No new applications submitted to the committee from the Town Board or Land Preservation. • Discussion concerning lack of applications being submitted to the AAC for review. Proposed Agricultural Revisions to Town Code: • To be discussed at Code Committee meeting: o Discussion of handout on New York Consolidated Laws, Town Law-TWN § 64-e. Peconic Bay region community preservation funds. ■ 4. Preservation of community character shall involve one or more of the following: (a) establishment of parks, nature preserves, or recreation areas; (b)preservation of open space, including agricultural lands provided, however, that farm buildings and structures used for the marketing of farm products produced on such agricultural lands where at least fifty percent of the gross annual income results from sales of products produced on such lands and, in addition the sale of any other locally sourced and/or produced food and plant products shall be permitted. The plan shall establish the priorities for preservation, and shall include the preservation of farmland as its highest priority. o Discussion on handout of Town of Southold Chapter 280. Zoning ■ § 280-173. Requirements for eligibility. C. Recommend removing the word aesthetic and adding agricultural. ■ § 280-174. Zoning approval; application and review procedure. B. Add Agricultural Advisory Committee to the review and recommendations. C. Add Agricultural Advisory Committee to the consideration of applications. F. Calculate Agricultural yield based on square footage to compute number of development rights on a property. ■ § 280-176. Price for Development Rights. Add "up front appraisal of parcel, from two independent certified appraisers". ■ § 280-177 Subsequent Development right Sales to Town, § 280-179 Clearing house &§280-180 Conditions. Were also discussed with emphasis on inclusion of the Agricultural Advisory Committee and consistency with the language. o Conflicts within the Town Code regarding Chapter 70 reviewed with attention to NYS law which allows on farm processing and farm stands on "Development Rights Sold" Land. o Review of"on farm processing" and "Agricultural Use" definitions. o All growers regardless of crop, should be allowed and have the ability to process crops. o Agricultural Bulk Schedule needs revision regarding Parking and Water runoff. o Possible guidance document for Agricultural Use land with regard to permits and Site Plans with a specific square footage of space for farm stands not requiring a Site Plan or Building Permit. o Chapter 72 discussed regarding Town Code. o On farm processing areas and parking areas discussed with regard to space allowances. o Contiguous and non-contiguous farmland to be considered all part of the same farm operation. Review of Agricultural related Site Plan Applications/Sub-Divisions: • No new applications submitted to the committee for review. • As yet, no response from Brian Cummings or the Town Attorney regarding the Amended Site Plan for Tenedios Farm Greenhouse on the determination if a site plan is required for an already approved and conforming building lot. • Discussion on Jakubiak property on Young's Ave. with regard to water runoff and downscaling of the barn. Review Proposed zoninq changes in Agricultural Districts: 0 No new proposed zoning changes submitted to the committee. Town of Southold Agricultural Advisory Committee Meeting Minutes of March 6, 2019 Local, County, State and Federal Legislation related to Agriculture: • Suffolk County Aquaculture Lease Program Public Information Meeting on Wednesday March 27, 2018 at 6:OOpm. At the Southold Town Recreation Center. Review Applications for structures related to Agriculture on parcels with Town /County owned development rights. • No new applications submitted to the committee for review. New Business: • Discussion of Dan Rattiner's article on the lawsuit Devon Yacht Club filed against Suffolk County regarding Oyster farming activity in Gardiners Bay. • Email on the EPA reviewing Captan from an original post in the Virginia Grape Disease Update Blog.
