SCTM No. 145-4-14.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 26, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 5, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 32,151 square feet, .738 acre creekfront corner parcel, located in the R-40 Zoning District, measures 136.68 feet along a private Paper Street referred to as Edgemere Avenue before turning at a rounded corner, 24.09 feet, then running west 186.94 feet along a second private Unnamed Street referred to as MacDonald's Road (aka MacDonald Crossing), then turning north along Brush's Creek and a rip-rap shore 90.80 feet,then dog-legging 26.35 feet along wood bulkheading with wood steps to the water, then continuing north 46.873 feet along wood bulkhead, and turning east, along the same creek and wood bulkheading, 213.02 feet meeting Edgemere Avenue. The site is developed with a one and one half story frame house with attached wood deck and steps on the westside along with a brick patio on the eastside of the residence along with a second, one story frame residential structure with garage, located in the northeast corner of the lot and has an attached wood deck with stairs and a brick patio on the northside with access to the property by two driveways; an earth drive on Edgemere Avenue and a paved bluestone drive on MacDonald's Road. Additionally, there are two sheds and a triangular brick patio as represented on the survey prepared by Nathan Taft Corwin III,Land Surveyor, dated January 18, 2018. Page 2,March 28,2019 #7253,Friedman SCTM No. 1000-145-4-14.1 BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's October 29, 2018, Notice of Disapproval based on an application to construct additions and alterations to an existing single-family dwelling, at; 1) less than the code required minimum front yard setback of 40 feet; at: 350 MacDonalds Road, (Adj. to Brushes Creek)Laurel,NY. SCTM#1000-145.-4-14.1. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to a single-family dwelling under construction that will result in the second floor covered and enclosed porch having a front yard setback of 9.1 feet where code requires a front yard setback of 40 feet. ADDITIONAL INFORMATION: The subject property is located in a private, waterfront, community known as Edgemera Park created in the early 201h Century and does not conform to current Zoning standards. According to the survey, the primary residence is located in the AE Flood Zone and is adjacent to Town of Southold underwater land (Brush's Creek). The property is well screened with mature trees and landscaping. The applicant and his agent spoke at the Public Hearing and indicated that they would work to preserve the large trees on the property and clarified that there is no formal neighborhood association. No member of the public or immediate neighbor spoke in favor or against this application. Included in the application is a letter dated February 26, 2018, from the Board of Town Trustees. The Trustees determined that, after review of the site plan, the proposed alterations and addition to the second floor of the home, which is to occur within the existing footprint of the existing house, is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111), no permit is required. The Zoning Board of Appeals has previously granted variance relief ZBA File No 7189 for additions and alterations that will result in a front yard setback of 12.8 feet from an "unnamed" street where code requires a 40- foot setback. The"unnamed street" is a paper road which is not used by traffic. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 14, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Edgemera Park is a small-scale neighborhood of single-family residences of varying size, scale and design, the majority of which have customary second floors. Several immediate homes have similar, non-conforming, front yard setbacks or other visible zoning hardships. The applicant's proposed second floor covered and enclosed porch is not characteristic of the neighborhood. Granting an unenclosed, uncovered deck, which is open to the sky, will be less visible from the street, create less of a non- conforming structure than the proposed covered and enclosed porch and would be more characteristic of the neighborhood. 2. Town Law 4267-b(3)(1b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence was built prior to current zoning with a 12.8 feet front yard setback and the applicant proposes to decrease the setback by 3.7 feet. The proposed alteration is to add a second floor covered enclosed porch. The proposed covered porch's non-conforming setback can be mitigated by granting alternative relief for a second-floor deck which is opened to the sky and unenclosed at the proposed 9.1-foot setback. Page 2, March 28,2019 #7253,Friedman SCTM No. 1000-145-4-14.1 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 83% relief from the code. However,the structure was built prior to current zoning. Moreover, the subject parcel does not have any immediate residential neighbor who would be impacted by this application. Brush's Creek is owned by the Town of Southold and the immediate neighbors opposite the dual road frontage have similar hardship. Furthermore, the paper road (MacDonald's Crossing) running parallel to the Peconic Bay and approximately 26 feet wide is not paved and grass has grown over creating a greater buffer and setback from the closest neighbor. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 2nd floor deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Planamento, and duly carried,to DENY as applied for and GRANT ALTERNATIVE RELIEF for a second-floor deck which shall remain open to the sky having a front yard setback of 9.1 feet. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The subject second floor deck shall remain unenclosed and open to the sky. 2. The applicant shall submit an amended site plan and architectural drawings depicting an unenclosed, uncovered second floor deck. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final architectural drawings conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such Page 2, March 28,2019 #7253,Friedman SCTM No. 1000-145-4-14.1 variance was granted.
