SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LV,RP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his recommendation dated March 5, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards, and therefore is INCONSISTENT with the LWRP. The coordinator states in his comments that the"as built" structure does not support Policy 1 of the LWRP provisions since it does not reinforce the traditional land use pattern of the Town. PROPERTY FACTS/DESCRIPTION: The subject property is a 21, 780 sq. ft. non-conforming parcel located in the R-40 Zoning District. The parcel has a 322 ft frontage on New Suffolk Avenue, then turns 68.39 ft towards Deep Hole Creek, then runs 285 ft along the creek before returning 84 ft back to New Suffolk Avenue. The parcel is slightly wooded with wetlands along the creek on its southern boundary and there is an existing wood deck located on the eastern portion of the property as shown on survey prepared by Melvin Keeger, L.S., dated November 22, 2004. BASIS OF APPLICATION: Request for a Variance under Article IV, Section 280-17A and the Building Inspector's September 26, 2018, Notice of Disapproval based on an application to legalize an "as built" accessory deck and construct a roof over, on the basis that the accessory structure does not constitute a permitted principle use on a residential parcel; at: 5550 New Suffolk Avenue, (Adj.to Deep Hole Creek)Mattituck,NY. SCTM#1000- 115-10-5. Page 2,March 28,2019 #7251, Carlen SCTM No. 1000-115-10-5 RELIEF REQUESTED: The applicant requests variances to legalize an "as-built" accessory wood deck with a temporary screen porch enclosure, and further to permit the construction of a permanent screened structure on a parcel that does not have a single family dwelling which is the code required principal use on the subject residentially zoned parcel , ADDITIONAL INFORMATION: At the public hearing the applicant testified as to the history of the property, and submitted a document detailing the chain of events which led to the request for variance relief. As per the owner's testimony, the following took place on the property: 1. The owner acquired the property in 2003,with the remains of a collapsed cabin. 2. In 2004 the owner cleaned up the property of various debris. 3. In 2004 the owner replaced the cabin floor, mirroring the size of the existing cabin. 4. Also, in 2004, the owner put a picnic table, storage container and tent on the deck. 5. In 2004,the Southold Bay Constable issued a violation and a summons for the deck. 6. In January 2005, the Southold Town Board of Trustees issued a permit for the existing deck, and to construct catwalks and a dock, Permit No. 6064, dated January 19, 2005. 7. In 2012 a fine was issued for installation of railing on the deck and the owner was advised that ZBA approval was needed for the deck. 8. On August 18, 2019, a stop work order was issued by a Southold Town code enforcement official for continued work on the deck. The applicants also testified that they do not live in Southold Town and that they use the subject property for recreational purposes to access Deep Hole Creek for swimming, paddle boarding and canoeing. They also use a large storage container on the property for changing and to use an onsite port-a potty. They have a Trustees permit for the as built catwalk and dock but have since rebuilt the wood deck and added the screened enclosure that they would like to further improve with a more permanent screened gazebo-type structure. In addition, a letter was received from an adjoining property owner stating their objection to the continued use and existence of the deck. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 14, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. The Notice of Disapproval issued by the Building Department in this matter clearly states the application was denied because the described "as built" structures were not permitted principal uses. Despite the clear wording in the Notice of Disapproval, the applicant submitted an application addressing the criteria for an area variance as opposed to a use variance. 2. In granting a use variance, a board must examine three criteria, the record must show that (1) the land in question cannot yield a reasonable return if used only for a purpose allowed in that zone; (2)that the plight of the owner is due to unique circumstances and not to the general conditions in the neighborhood which may reflect the unreasonableness of the zoning ordinance itself; and (3)that the use to be authorized by the variance will not alter the essential character of the locality. Here, the applicant failed to provide any evidence that the land in question cannot yield a reasonable return if used only for a purpose allowed in that zone or that the plight of the owner is due to unique circumstances and not to the general conditions in the neighborhood which may reflect the unreasonableness of the zoning ordinance itself. With regard to Page 3, March 28,2019 #7251, Carlen SCTM No. 1000-115-10-5 the third criteria for the granting of the use variance, as discussed below, the applicant failed to establish that the use to be authorized by the variance will not alter the essential character of the locality. 1. Town Law §267-b(2)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes. There is no evidence that any property in the neighborhood is improved with accessory structures without first establishing a principle residential use. Decks and screened enclosures are characteristic of the neighborhood when accessory to single family dwellings and in code conforming locations. 2. Town Law X267-b(2)(b)(2). The hardship is unique to the property and it does not apply to a substantial portion of the district or neighborhood. The property is a narrow strip of land adjacent to Deep Hole Creels. 3. Town Law §267-b(2)(b)(3). The requested use variance, if granted, will alter the essential character of the neighborhood. There is no evidence of nearby properties used only for a recreational use without a principal use or dwelling on the property. 4. Town Law 4267-b(2)(b)(4). The difficulty has been self-created. The applicants purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 5. Town Law V67-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a non-conforming use of the property and/or area variances, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. An inconsistency with Chap. 268 of the LWRP has been referenced as the basis for the violation. Please seethe following sequence of events and summary. 10/2003 While looking into purchasing the property, we visit the Town of Southold Bldg. Dept.to inquire about replacing the collapsed cabin. After a brief review of pictures, was advised that the floor could be replaced but not walls and roof as they're no longer standing. 12/2003 Purchased Property. 01/2004 Cleaned up debris dumped over past years (appliances, oil drums, bldg. materials, etc.). 03/2004 Replaced cabin floor closely mirroring size, height and footings. 04/2004 Put picnic table and storage container on deck with tent over. Fall '04 Received call from Bay Constable. Met at property. Politely explains that this is Trustee jurisdiction, they are �violabi d and changes to property must have their appro I. Issun and summons us to report to Trustees. We immediately do. Application submitted. Small floating dock is discussed and OK. No violation issued for deck itself. 03/28/12 Met with town attorney. Pay $1000-fine for putting railing on deck. Directed back to Trustees for railing approval. Advised by that office that any alterations to deck will now also require ZBA approval and further directed to their office. 04/2012 Begin process for ZBA approval. While reviewing application with ZBA representative, advised that this will be a "heavy lift" and to basically not bother. On that recommendation, withdraw request and alter railing to be removable/non-permanent in order to satisfy all parties. 08/20/18 ReceiveStop Work Or from Ordinance Inspector although no work ha een taking place. Met with Ordinance Inspector and Town Attorney. Attorney explains that the deck now needs ZBA approval and references Chap 268 of the LWRP (the first we'd heard of this). 10/2018 ZBA application complete and submitted. Summary We do not acknowledge that the deck is currently "illegal" and, respectfully, ask the following to be verified and considered. 1. Trustee application contains this clause... "Upon'receipt of a completed application to this office, the project will formally be reviewed by the Building Dept. Department Head to determine if the project will require a Variance by ZBA. If the project will require a variance, your application will be immediately tabled". Our application in Fall of 2004 was not tabled and the LWRP or Chap. 268 that was currently in the approval process was never mentioned. 2. Replacement of pre-existing deck was completed prior to the adoption of Chap. 268 and permit issued before NY State approval of the LWRP (Perhaps the reason ZBA approval was not required at the time). 3. "Rebuild of existing deck" approved at public hearing after proper notification of all interested parties. Trustees, as agents for and under the seal of the Town of Southold, issue permit for deck. 4. Since settling the initial violation for building without a permit in 2004, no new violations have been issued for the deck itself until 08/2018, even after several visits from Town Representatives over the past 14 years. 5. We have submitted a ZBA application for consideration of a permanent roof over the deck with screened sides to replace the temporary screen room current being used.
