Uhlendorf and Edith Uhlendorf Trust PROPERTY LOCATION: 230 Landing Lane, Greenport,NY SCTM No. 1000-43-4-8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTSMESCRIPTION: The subject property is a non-conforming 12,500 square foot parcel located in an R-40 Zoning District. The parcel measures 100 feet fronting Landing Lane along the easterly property line, 125 feet along the southerly property line, 100 feet along the westerly property line, and 125 feet along the northerly property line. The parcel is improved with a dwelling under construction as shown on a survey prepared by Kenneth W. Woychuk, LLS, last revised August 10, 2018. BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's October 29, 2018, Notice of Disapproval based on an application to legalize an existing deck addition to an under construction single family dwelling, at; 1) less than the code required minimum rear yard setback of 35 feet; at: 230 Landing Lane, Greenport,NY. SCTM#1000-43-4-8. RELIEF REQUESTED: The applicant requests a variance to legalize a second story as-built deck addition approximately 10.2 ft. by 31.6 ft. and measuring 24.8 feet distance from the rear yard property line where code requires a minimum 35-foot rear yard setback. ADDITIONAL INFORMATION: The applicant's agent testified that the applicant's plans for a second-floor deck with a 24.8-foot setback were reviewed by the building department and a building permit was issued, and the applicant's agent testified that the applicant built the deck relying on building permit no. #42442 issued on March 8, 2018. Two letters of support from neighbors were received by the Board of Appeals on this application. Page 2, March 28, 2019 #7250, Uhlendorf SCTM No. 1000-43-4-8 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 14, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance(s)will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of small lots with single family homes. Decks are characteristic of this neighborhood and there are two other homes in the immediate area that have the same sort of second floor decks. The deck is on the rear of the house and will not be visible from the street. The deck is open to the sky and may not be enclosed. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has constructed the house at a conforming rear yard setback of 35 feet so any deck built on the rear of the house will require the benefit of variance relief. The applicant has code conforming front and side yard setbacks. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 29.1% relief from the code. However, the lot is small and the second-floor attached deck provides outdoor access and use from the first habitable level of the home which is located above a garage at the ground level. The attached deck does not create adverse visual impacts on adjoining properties or the street 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The applicant relied on the issuance of a building permit by the Building Department that included the proposed deck addition; and only after construction was a Notice of Disapproval issued for the non-conforming rear yard setback 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-floor attached deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the Architectural plans prepared by Drew B. Bennett,P.E., of Zarnecki Design, labeled Al thru A5 and S-3, dated October 18, 2017 and the survey prepared by Kenneth W. Woychuk, LLS, last revised August 10, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1)The deck shall remain open to the sky and shall remain uncovered and unenclosed. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The deck was constructed with the benefit of Permit#42442 issued March 8, 2018. Upon inspection by the Building Inspector, it was determined that the deck lies within the required setback. The subject premises is a pre-existing non-conforming 12,500 square foot parcel in the R-40 zoning district. The Applicant constructed her home last year pursuant to a validly issued building permit#42442. That permit was issued based upon a set of building plans that showed the location and size of the rear deck. After construction of the home was substantially completed, the Building Inspector determined that a portion of the rear deck was actually in the required 35-foot setback. As such, the Trust is seeking a 10.2-foot rear yard setback variance from the Code required 35-foot setback and the Building Inspector's Notice of Disapproval for a building permit to maintain an as-built deck addition to an existing single-family dwelling. For the following reasons, the Applicant submits that a Variance from Section 280-124 is warranted. POINT I THE APPLICANT HAS MET THE TEST FOR THE GRANT OF AN AREA VARIANCE SET FORTH IN TOWN LAW §267-B Under §267-B, the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant-can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of-the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. The applicant submits that under the facts and circumstances presented here, The Trust can clearly meet the standards set forth in Town Law §267-13 and as a result, the relief requested herein should be granted. 1. The Grant Of The Variance Will Not Cause An Undesirable Change In The Character Of The Neighborhood Or Create Detriment to Nearby Properties. The Trust has submitted photographs that document that elevated rear decks are in character with the surrounding neighborhood. There are also letters from neighbors attesting to that fact and supporting the Trust's request for relief here. It is therefore respectfully submitted that neither an undesirable change in the character of the neighborhood or a detriment to nearby properties will be created by the grant of this area variance. 2. The Benefits Sought to Be Achieved by Applicant Cannot Be Feasibly Achieved by Some Method Other Than the requested Area Variance. The survey confirms that with the exception of the deck, the existing house is constructed in a conforming location on the property. The deck cannot remain without variance relief. The deck is an essential component of the house design since there are sliding glass doors that exit onto the deck. As such, area variance relief is the only available means of legalizing the existing rear deck and maintaining access to the house. 3. The Area Variance Sought is Not Substantial The rear deck is only 322 square feet in size which is consistent with the size of t neighboring decks. The Trust is only seeking a 10.2 foot variance which equates to 29% variance from the code required setback. Under the circumstances, the relief requested is not substantial. 4. The Grant of the Variance Will Not Have an Adverse Impact on the Physical or Environmental Conditions in the Neighborhood or District. As stated previously, the deck is reasonable in size and consistent with similar decks in the neighborhood and zoning district. There is no perceivable environmental impact from the as built deck. 5. The Self Created Nature Of the Alleged Difficulty Should Not Preclude the Granting of Area Variance Relief. The Trust submits that it proceeded with construction of the house in its current location in good faith reliance on the building permit issued by the Town. The moment the error was discovered, the Trust sought immediate relief from this Board. CONCLUSION For the reasons set forth herein, it is respectfully submitted that the standards of Town Law Section 267-b have been met and, as such, relief from the requirements set forth in Southold Town Code Section 280-124 is warranted.
