LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 5, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP, provided the following is required: 1. The sanitary wastewater system is not shown on the plans. Verify the location and function of the sanitary wastewater system. 2. Due to the close proximity of the action to a sensitive, freshwater, wetland system, the installation /upgrade to an I/A OWTS is strongly recommended to further Policy 6. 3. Require a vegetated, non-turf buffer landward of the wetland delineation line that integrates the existing vegetation(trees). 4. Require that the action comply with Chapter 236 Storm Management of the Southold Town Code. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure. PROPERTY FACTS/DESCRIPTION: The subject property contains five acres with 534.8 feet along Paradise Point Road. The property is improved with a single-family one-story frame residence and a one- story frame accessory 2-car garage structure as shown on the survey prepared by Peconic Surveyors, P.C. dated January 14, 2019. The accessory structure has a Pre-Certificate of Occupancy record dated February 2, 1996 under Certificate of Occupancy#Z-24149 confirming that the accessory garage building was built prior to January 1, 2008. The subject property has the following Certificates of Occupancy: Z-4210 April 22, 1971 Private one family dwelling (additions) Z-5485 September 25, 1973 Private one family dwelling (additions) Z-24149 February 2, 1996 Pre-C of O for a one family dwelling with accessory garage built prior to April 9, 1957 Z-26172 December 15, 1998 Unheated addition to a one family dwelling Z-37670 July 21, 2019 "As built"heat added to an unheated room The Zoning Board of Appeals requested the Southold Town Building Department to verify the livable floor area of the proposed conversion of the accessory garage on October 23, 2018 and received the following determination on October 26, 2018, in response: "The livable floor area is determined to be approximately 605 square feet and is conforming to Section 280-13B(13A) of the code." (Corrected Page 2 on July 8,2019) Page 3,March 28,2019 #7249SE,Lev SCTM No. 81-2-4 FINDINGS OF FACT: The Zoning Board of Appeals held a public hearing on this application on March 14, 2019,at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article 111, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment unit will be located in a single-story accessory garage with an area of approximately 605 square feet of livable floor area in conformity as proposed, as described and shown on the floor plan Craft Modern dated October 15, 2018 and unsigned and confirmed by the Building Inspector in a memorandum titled"Verification of Livable Floor Area"dated October 26, 2018 and received by the Board of Appeals on October 29, 2018. 2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with the code requirements as defined in Section 280-13(B)(13) of the Zoning Code. The owner confirms that the accessory apartment shall not contain less than 450 sq. feet nor will the accessory apartment exceed 750 square feet of livable floor area, all on one floor with only one full bathroom. 3. The applicant herein, owns and resides at the property and will continue to occupy the single family residence as a principal residence in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4), and as documented by New York State STAR tax rebate, Federal Tax documents and New York State Driver's Licenses for each,Erica Lynn Lev and Zachary Steven Lev. 4. The occupants of the accessory apartment located in an accessory structure will be either a family member or a resident who is currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed the number of persons permitted, in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4). The proposed tenants of the accessory apartment are Jessica Lynn Lev's parents, Cindy&Mathew Finkelson, as evidenced by copy of the applicant's New Jersey Birth Certificate, Family Birth Announcement, and the Lev's California Marriage Certificate. 5. The owners' plans comply with the on-site parking requirements and provide for a total of three (3) parking spaces, two for the principal use and one for the Accessory Apartment, utilizing the existing driveway areas, as shown on the survey prepared by Peconic Surveyors,P.C. dated January 14,2019. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is located, Page 4,March 28,2019 #7249SE,Lev SCTM No. 81-2-4 adjacent use districts, and nearby adjacent residential uses. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the Accessory structure, and as proposed will not prevent the orderly and reasonable use of districts and adjacent properties. 3) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, order of the Town would be adversely affected. 4)The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied. 5)No adverse conditions were found after considering items listed under Sections 280-142 and 280-143 of the Zoning Code. BOARD RESOLUTION: On motion by Member Planamento, seconded by Member Lehnert, it was RESOLVED,to GRANT a Special Exception for an Accessory Apartment, in the existing Accessory Structure, as applied for. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. The applicant shall resubmit a floor plan calculating the livable area of the accessory apartment signed and dated by a licensed professional. 4. The applicant is required to install/upgrade to an Innovative Alternative Waste Water Treatment System (UA OWTS) as approved by the Suffolk County Department of Health. 5. The applicant is required to create a ten-foot-wide vegetated, non-turf buffer landward of the wetland delineation line that integrates the existing vegetation. 6. The applicant must comply with Chapter 236 Storm Management of the Southold Town Code. 7. The applicant is required to immediately notify this office and the Southold Town Building Department should there be a need to demolish the existing accessory garage. Demolition is defined as work exceeding 49% repair to the existing structure, including foundation, framing, roofing. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. We wanted to take the opportunity to provide the information requested by the ZBA to further demonstrate our home is our primary residence. In addition to the multiple supporting documents previously provided (pay stubs,a K1 form and a healthcare 1095-C form),we've attached here photos from our bank account of the 2017 and 2018 STAR exemption checks that we received and deposited from NY State. In addition,we also wanted share some background about ourselves so you can get to know us better. Zach is a partner at an advertising agency in New York City. Unless he has critical client meetings, he works remotely from our home, as do many creative professionals in the marketing and production field. Erica is a lawyer for a clothing company with its US headquarters in New York City. Similarly, her company offers a flexible work schedule,which she takes advantage of as much as she can. If there are nights we work late hours or have to be in the city for multiple days in a row,we will stay over in our Brooklyn apartment, but our home in Southold is where we spend the majority of our time. Since 2016, Erica's parents spend 5 months of the year on their boat docked in Greenport. As they age, living full- time on a sail boat has become less comfortable for them. Given the small footprint of our home,our goal of this project is to build them an in-law's suite in our detached garage. Lastly,we thought it was important to give you a "heads up"that we recently began a properly permitted renovation to add a second bathroom to our home. Fingers crossed, construction will hopefully be finished at the end of April. During the renovation,we have been spending more time at our Brooklyn apartment.
