SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 5, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 22,351 SF corner lot located in an R-40 Zoning District with 224.47 feet of frontage on Bay Avenue and additional road frontage of 83 feet on Tuthills Path, a private dirt road (24-foot-wide right of way). The eastern lot line, shared with a residential neighbor, measures 221.84 feet with a southern lot line of 118.27 feet on Marion Lake. As a result of a corner location, the property is classified as having two front yards. The parcel is currently improved with a one-story single-family residence of approximately 1,636 square feet, a wood deck and concrete retaining wall, walkways and steps, fencing and s small waterside, concrete building. This is all shown in a survey by Nathan Taft Corwin, Land Surveyor dated October 18,2018. BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's October 2, 2018, Notice of Disapproval based on an application to legalize "as built" demolition and proposed reconstruction of the existing single family dwelling, at; 1) less than the code required minimum front yard setback of 40 feet; at: 1695 Bay Avenue, (Adj. to Marion Lake)East Marion,NY. SCTM#1000-31-9-21.1. RELIEF REQUESTED: The applicant requests a variance to decrease the front yard setback from 40 feet to 17.7 feet for an as built construction of a single-family dwelling with an attached 14 ft. by 28 ft. deck. Page 2, March 28, 2019 #7247, Robalino SCTM No. 1000-31-9-21.1 ADDITIONAL INFORMATION: This project was granted variance relief as ZBA file # 7153, dated April 23, 2017 for additions and alterations to an existing single-family dwelling and a building permit was issued for this project in June 26, 2018; Building Permit # 42818. Subsequently, the entire structure was demolished and was being rebuilt. Once discovered by code enforcement, the project was halted. At the hearing verbal testimony was given by the contractor on the project who stated that this new application resulted from the demolition of the dwelling because areas of the house had substantial rot in the framing members. Due to the expanse of the rot, and the required repairs, walls had to be taking down and replaced, thereby exceeding the scope of the variance relief and the building permit which were granted for additions and alterations to an existing dwelling. Photos were submitted showing the expanse of the rot. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 14, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the relief will not produce and undesirable change in the character of the neighborhood or a detriment to nearby properties. The general residential area surrounding Marion Lake is made up of single-family residences on non-conforming lots of varying shapes, configuration and access, many of which are sited on the lake or on Peconic Bay. The majority of the neighborhoods original bungalows have been renovated into more substantial homes reflective of modern needs. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence is sited close to Bay Avenue and has stood for many years without incident. The setbacks proposed were already granted by past variance relief for additions and alterations, (#7153), and the building as it currently exists conforms to that past relief, and the approved building plans. The only reason for this variance was because of the demolition and substantial reconstruction done to mitigate rot in the existing structure. 3. Town Law &267-b(3)(b)(3). The variance applied for is mathematically substantial, representing 55.7% relief from the code. However, the relief requested has previously been granted in a past variance (# 7153), while still substantial will allow the applicant to enjoy the renovated residence. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary to enable the applicant to enjoy the benefit of a renovated house, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, March 28, 2019 #7247, Robalino SCTM No. 1000-31-9-21.1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried,to GRANT the variance as applied for and shown on the survey prepared by Nathan Taft Corwin, I11, Land Surveyor, dated October 18, 2018 and plans, pages 1, 2 & 3, prepared by James Delucca, Architect, dated July 18, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written` request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 16, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION. The applicant's parcel is a non-conforming 22,351 square feet corner lot located in the R-40 Zoning District with 224.47 feet frontage on Bay Avenue and additional road frontage of 83 feet on Tuthill's Path, a private dirt road (24 feet wide right of way). The eastern lot line, shared with a residential neighbor, measures 221.84 feet with a southern lot line of 118.27 feet on Marion Lake. As a result of a corner location, the property is classified as having two front yards. The parcel is currently improved with a one-story, wood-frame, single-family residence of approximately 1,636 square feet, a wood deck and concrete retaining wall, walkways and steps, fencing and a small, waterside, concrete building. Marked "to be removed", are a waterside wood deck accessed by stairs from the deck above and a frame shed, located in the Tuthill's Path front yard as illustrated on the survey prepared by Nathan Taft Corwin, III,Land Surveyor,dated September 26, 2017. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to the existing single family residence, including a wood deck of 448 square feet measuring 28 feet in length and 16 feet in depth on the west side of the residence with a front yard setback of 15.7 feet where the Code requires a front yard setback of 40 feet, AMENDED RELIEF: During the hearing the Board discussed with the applicant bringing the plan into more conformity with the code. The applicant agreed to reduce the size of the proposed deck from 16 feet in depth of 14 feet which would increase the proposed front yard setback to 17.7 feet and thereby reducing the deck to 392 square feet in size. On April 17, 2018, the applicant's representative submitted an updated survey (revision date April 15, 2018) depicting an increased front yard setback of 17.7 feet, and the reduction in depth of the proposed deck to 14 feet, as discussed by the Board. Building plans dated April 17,2018 were also submitted. ADDITIONAL INFORMATION: No member of the public spoke at the hearing in favor of, or against this application. The Board discussed the existing non-conforming 6 foot high chain link fencing along the front yard property line. The applicant and their agent stated that they will be removing this fencing running along Bay Avenue and replacing it with a 4 feet high fence that conforms to the Code. Furthermore, the applicant agreed to apply for a Certificate of Occupancy for the"as built' rear deck located on the southeast comer of the residence. A Pre-Existing Certificate of Occupancy,Z-22150, was issued February 22, 1993. The applicant was also asked to submit prior variances for other non-conforming front yard setbacks, and documentation of general non- conforming front yard setbacks in the neighborhood. On April 17, 2018,the applicant submitted comparative front yard setback relief to neighboring properties. They are listed as No. 830 granted March 24, 1966,No. 3079 granted on March 8, 1983, and No. 6868 granted on July 16,2015, all receiving front yard setback relief of 14 feet, 20 feet and 15.8 feet; respectively. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5,2018 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b( )(b M. Grant of the relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The general residential area surrounding Marion Lake is made up of single-family residences on non-conforming lots of varying shapes, configuration and access many of which are sited on the lake or the Peconic Bay. The subject property has a unique terrain; level on the north side fronting on Tuthill's Path and sloping down to Marion Lake on the south side with the residential structure built into the embankment above the lake and Bay Avenue. The majority of the neighborhood's original bungalows have been renovated into more substantial homes reflective of modern needs, many of which have customary front porches. While a deck on the front fagade of a home is not a common feature in this neighborhood, the placement of the proposed addition, is offset by the fact that it will service the kitchen, dining and living room areas and will sit above the roadway,not visible from below. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence is sited close to Bay Avenue and has stood for many years without incident; it was constructed prior to Zoning with a front yard setback of 27.9 feet. The proposed location works log��ally with the existing floor plan 3. Town Law &267-b( A)(3). The variance as applied for is mathematically substantial, representing 60.75% relief from the code. However, the relief granted as amended herein will reduce that relief to 55.7 percent and, while still substantial, will enable to the applicant to enjoy an outdoor deck that will logically provide access from the kitchen, dining and living room areas of the dwelling, and will sit above the roadway, not visible from below 4. Town Law §267-b(3) b( )(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on,the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief as amended is the minimum action necessary and to enable the applicant to enjoy the benefit of alterations and additions including a deck addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
