Burnham III, residing at right of way off Peninsula Road,Fishers Island,New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. Since that time we have been slowly attacking the invasive Japanese Knotweed that had engulfed virtually the entire parcel. This invasive dies to the ground each season and can spread both by seed and rhizomes. Once the dead biomass was removed we began grubbing out the plant crowns and root systems by hand. Areas with measurable soil disturbance were seeded with annual Rye to insure soil stabilization. Only downed trees and broken branches found amongst the Knotweed were removed and then replaced with native plants. Plants included: eastern red cedars,winterberry, cranberry viburnum, arrowwood viburnum, shads, dogwoods and ferns. Over the past two years,the hand grubbing has continued and several spot treatments of the selective herbicide Speedzone (Commercial Pesticide Applicator#C1883840)were applied to help suppress the Knotweed as it appeared. A drip irrigation system was installed (supplied by an above ground blank line from the Burnham's garden) and additional native plants were added. There is no intent for lawn grasses in the area and the annual rye has pretty much petered out at this point. Some of the areas that appear to be bare earth are actually Canadian Mayflower(false Lilly of the valley) that fades out by the end of the summer. The owners goal in purchasing the lots, as described to us, was to insure the property remain undeveloped and that the invasive plants be removed and a -- natural native habitat be restored that will neither need maintenance nor fertilizers to thrive. We anticipate that we will need to continue to hand pull and monitor the Japanese Knotweed for several more years. The question of whether an action may be significant is not always easy to answer. Frequently, there�are,aspects of a project that are subjective or unmeasurable. Except for a few residents around the perimeter, no one can really get more than a glimpse of the cove. The proposed dock will be similar to the dock of Jim Baker across the cove. There is virtually no public use of the waterfront in this area due to the overgrown nature of the bank and the steep slope down to the water's edge.
