enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.

WHEREAS, there was presented to the Town Board of the Town of Southold, Suffolk County,

New York, on the 18 day of December, 2018, a Local Law entitled “A Local Law to amend the
Zoning Map to change the zoning of the parcel known as SCTM #1000-140-01-6, from B
(General Business) & R-40 to LB (Limited Business) & R-40”; and
WHEREAS, on January 30, 2019, pursuant to §280-29(C), the Planning Board reviewed the
subject change of zone and issued a report supporting same; and
WHEREAS, on February 12, 2019, the Town Board of the Town of Southold held a public
hearing on the aforesaid Local Law, at which time all interested persons were given an

opportunity to be heard; and
WHEREAS, the public hearing is officially closed; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby declares itself lead agency
for the purposes of SEQRA review for the subject change of zone; and be it further
RESOLVED that the Town Board of the Town of Southold hereby adopts a negative declaration
for the purpose of SEQRA review and finds that the subject change of zone will not have a
significant effect on the environment and that a Draft Environmental Impact Statement will not
be prepared; and be it further
RESOLVED, that the Town Board of the Town of Southold hereby ENACTS the proposed
Local Law entitled, “A Local Law to amend the Zoning Map to change the zoning of the parcel
known as SCTM #1000-140-01-6, from B (General Business) & R-40 to LB (Limited Business)
& R-40 and be it further ” which reads as follows:
LOCAL LAW ______ of 2019
Section 1. Purpose.
A local Law to change the zoning of the parcel known as SCTM #1000-140-01-6, from B
(General Business) & R-40 to LB (Limited Business) & R-40.
Section 2. Code Amendment.
Based on the goals of the Town, and upon our consideration of the recommendations of the
Town Planning Board, the Suffolk County Planning Commission, and the public comments
taken at the public hearing and otherwise, we hereby amend the official Zoning Map of the Town
of Southold as adopted by Section 100-21 of the Town Code to change parcel SCTM #1000-140-
01-6, from B (General Business) & R-40 to LB (Limited Business) & R-40. The property is
located at 1605 Wickham Avenue, Mattituck, New York.
Section 3. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 4. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

WHEREAS, there was presented to the Town Board of the Town of Southold, Suffolk County,

New York, on the 18 day of December, 2018, a Local Law entitled “A Local Law to amend the
Zoning Map to change the zoning of the parcel known as SCTM #1000-6-6-20.8, from R-80
(Residential) to HD (Hamlet Density); and
WHEREAS, on February 15.2018, pursuant to §280-29(C), the Planning Board reviewed the
subject change of zone and issued a report supporting same; and
WHEREAS, on February 26, 2019, the Town Board of the Town of Southold held a public
hearing on the aforesaid Local Law, at which time all interested persons were given an
opportunity to be heard; and
WHEREAS, at the public hearing there was testimony from the public regarding the need for
housing for full time residents of Fishers Island, and
WHEREAS, there was also testimony from members of the public concerned that if the
application for the change of zone was approved that without certain conditions placed on the
change of zone, there was a potential for dwelling units could be as short term housing for
visitors to Fishers Island, and
WHEREAS, the applicant’s representative stated that the applicant intended to use any
dwelling units built on the subject property as housing for full-time year-round residents of
Fishers Island and that the applicant was willing to place covenants and restrictions on the
property limiting the use of the subject premises to full-time year round residents of Fishers
Island, and
WHEREAS, the Town Board of the Town of Southold hereby finds that based on the goals of
the Town, and the consideration of the recommendations of the Town Planning Board, and the
public comments taken at the public hearing that approval of the change of zone should be

subject to the filing of covenants and restrictions limiting the use of the subject property to
housing for full-time year round residents of Fishers Island, and
WHEREAS, the public hearing is officially closed; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby declares itself lead agency

Lane from Route 25 to Pike Street, Mattituck on May 3, June 7, July 5, Aug 2, Sept 6, and Oct 4,

Town of Southold as addition insured for two million dollars and comply with all the conditions

RESOLVED that the Town Board hereby authorizes the acceptance of residential brush free of
charge for four weeks, at the Southold Town Compost Facility in Cutchogue (leaves are always
accepted free). This four-week grace period is for those homeowners who wish to take their
brush directly to the Town’s compost site themselves. The grace period will start Monday, April
1, 2019, and end Tuesday, April 30, 2019; be it further
RESOLVED that commercial landscaping and tree removal companies will no longer be

permitted to deposit any loads of branches or yard debris for removal in the Town’s right-of-
way. It will be the homeowner’s responsibility to make certain that their contractor(s) haul their
yard debris to the Cutchogue Compost Facility as anyone observed dumping in the Town right-
of-way will be fined for illegal dumping; and, be it further
RESOLVED that the Fishers Island Spring Clean-Up will also commence on Monday, April 15,
2019.
RESOLVED that the normal tip fees for brush disposal at the Cutchogue Compost Facility shall
be waived for residential vehicles for the period April 1, 2019 through April 30, 2019; and that
tip fees for brush shall be reduced for commercial vehicles to $30/ton for the period from April
1, 2019 through April 30, 2019; and be it further
RESOLVED that for the purposes of this resolution, residential vehicles shall be defined as any
vehicle with a resident disposal permit issued by the Town Clerk of the Town of Southold
carrying less than one ton of debris (including trailers), or for vehicles without a permit, any
vehicle with a less than one ton carrying capacity (including trailers); and that commercial
vehicles shall be defined as any vehicle with a commercial disposal permit issued by the Town
Clerk of the Town of Southold, or for vehicles without a permit, any vehicle with a carrying
capacity of one ton or greater; and be it further
RESOLVED that the tip fee waiver/reduction described herein shall not apply to stumps of any
type; and that it applies to the charge for the weight of the debris ONLY, and not to single entry
fees for vehicles without permits, which will still be charged as appropriate.

Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, “A Local Law in relation to Amend Chapter 245 Taxation, to Provide
Property Tax Exemption for Certain Veterans Who Participated in Operation Graphic
Hand reads as follows:
LOCAL LAW NO. 2019
A Local Law entitled, “A Local Law in relation to Amend Chapter 245 Taxation, to Provide
Property Tax Exemption for Certain Veterans Who Participated in Operation Graphic
Hand
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town Board finds and determines that in March of 1970, the United States was in the midst
of a communication crisis when letter carriers for the U.S. Postal Service voted to strike in major
cities throughout the country.
The Town Board determines that New York City was the epicenter of the strike movement,
affecting not just local mail delivery but also the routing of correspondence and parcels
throughout the nation.
The Town Board also finds and determines that on March 23, 1970, President Richard Nixon
issued an executive military order, declaring a state of emergency and mobilizing 25,000 active
duty and reserve service members to maintain postal service in New York City. The Mission
was later designated Operation Graphic Hand.
The Town Board further finds and determines that, while the strike was short in duration, ending
on March 25, 1970, the service of the men and women assigned to Operation Graphic Hand
ensured that essential elements of mail delivery occurred during this period.
The Town Board finds that New York State and Suffolk County recently enacted legislation
authorizing towns in their discretion to extend real property tax exemptions provided under State
and County Law to veterans who were assigned to Operation Graphic Hand.
The Town Board determines that given the Town of Southold’s close proximity to the main site
of Operation Graphic Hand, the Town of Southold should authorize the property tax exemption
for those veterans who helped keep our national postal service operating in a time of crisis.

Therefore the purpose of this amendment is to amend Chapter 245 to authorize the inclusion of
veterans of Operation Graphic Hand in the Town’s real property tax exemption laws.
II. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
§ 245-15
Definitions
VETERAN - A person:
A. Who served in the active military, naval, or air service during a period of war or
who was a recipient of the armed forces expeditionary medal, naval expeditionary
medal, Marine Corps expeditionary medal or global war on terrorism
expeditionary medal, and who was discharged or released therefrom under
honorable conditions; or
B. Who was employed by the War Shippings Administration or Office of Defense
Transportation or their agents as a merchant seaman documented by the United
States Coast Guard or Department of Commerce or as a civil servant employed by
the United States Army Transportation Service (later redesignated as the United
States Army Transportation Corps, Water Division) or the Naval Transportation
Service; and who served satisfactorily as a crew member during the period of
armed conflict, December 7, 1941, to August 15, 1945, aboard merchant vessels
in oceangoing (i.e., foreign), intercoastal or coastwise service, as such terms are
defined under federal law (46 U.S.C.A. §§ 10301 and 10501), and further to
include near-foreign voyages between the United States, Canada, Mexico or the
West Indies via ocean routes or public vessels in oceangoing service or foreign
waters and who has received a certificate of release or discharge from active duty
and a discharge certificate or an honorable service certificate/report of casualty
from the Department of Defense;
C. Who served as a United States civilian employed by the American Field Service
and served overseas under United States Armies and United States Army Groups
in World War II during the period of armed conflict, December 7, 1941, through
May 8, 1945, and who was discharged or released therefrom under honorable
conditions; or
D. Who served as a United States civilian flight crew and aviation ground support
employee of Pan American World Airways or one of its subsidiaries or its
affiliates and served overseas as a result of Pan American's contract with Air
Transport Command or Naval Air Transport Service during the period of armed
conflict, December 14, 1941, through August 14, 1945, and who was discharged
or released therefrom under honorable conditions. or;
E. Who served as military personnel in the Reserve component of the United States
Armed Forces and deemed on active duty under Executive Order 11519, signed
March 23, 1970, 35 Federal Register 5003, dated March 24, 1970 and later
designated by the United States Department of Defense as Operation Graphic
Hand, and who was discharged or released therefrom under honorable conditions.

II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

FIFD Bond Order After Public Hearing
WHEREAS, the Board of Commissioners of the Fishers Island Ferry District (the
“District”), in the Town of Southold (the “Town”), Suffolk County, New York, pursuant to a
resolution of said Board of Commissioners, which together with a petition in due form, was duly
submitted to the Town Board (the “Town Board”) of the Town, has requested that Town Board
call a public hearing to hear all persons interested in the subject thereof; and
WHEREAS, on February 26, 2019, the Town Board of the Town of Southold
(herein called the “Town”), in the County of Suffolk, New York, on behalf of the District,
adopted an Order pursuant to Section 202-b of the Town Law, describing in general terms a
proposed increase and improvement of facilities, consisting of the acquisition of a high speed
passenger ferry boat, at the aggregate estimated maximum cost of $460,000; and said Order
stated that the Town Board would meet to hear all persons interested in said increase and
improvement of facilities on March 26, 2019 at 4:30 o’clock P.M. (Prevailing Time) at the Town
Hall, 53095 Main Road, Southold, New York; and
WHEREAS, a Notice of said public hearing was duly published and posted
pursuant to the provisions of Article 12 of the Town Law; and

WHEREAS, said public hearing was duly held by the Town Board on March 26,
2019 at 4:30 o’clock P.M. (Prevailing Time) at the Town Hall, 53095 Main Road, Southold,
New York, with considerable discussion on the matter having been had and all persons desiring
to be heard having been heard, including those in favor of and those in opposition to said
increase and improvement of such facilities; and
WHEREAS, the District, as lead agency, has given due consideration to the
impact that the project described herein may have on the environment pursuant to the State
Environmental Quality Review Act (SEQRA), constituting Article 8 of the Environmental
Conservation Law, and 6 NYCRR, Regulations Part 617.5 and has determined that the
acquisition of a high speed ferry is a Type II action and no further environmental review is
required for said project;
Now, therefore, on the basis of the information given at such hearing, it is hereby
DETERMINED, that it is in the public interest to increase and improve the
facilities of the District as hereinabove described, at the estimated maximum cost of $460,000;
and it is hereby
ORDERED, that the facilities of the District shall be so increased and improved
and that the Board of Commissioners shall prepare plans and specifications and make a careful
estimate of the expense for said increase and improvement of such facilities and, with the
assistance of Attorney for said Board, shall prepare a proposed contract for such increase and
improvement of facilities of the District, which plans and specifications, estimate and proposed
contract shall be presented to the Town Board as soon as possible; and it is hereby
FURTHER ORDERED, that the expense of said increase and improvement of
facilities shall be financed as hereinabove set forth, and the costs thereof, including payment of
the principal of and interest on the obligations authorized to be issued, shall be assessed, levied
and collected by the Town Board from the several lots and parcels of land within the District in
the same manner and at the same time as other Town charges, but if not paid from such source,
all the taxable property within said Town shall be subject to the levy of ad valorem taxes, in an
amount sufficient to pay the principal of and interest on said obligations; and it is hereby
FURTHER ORDERED, that the Town Clerk record, or cause to be recorded, a
certified copy of this Resolution and Order After Public Hearing in the office of the Clerk of
Suffolk County within ten (10) days after adoption hereof.

FIFD Bond Adopting Resolution
WHEREAS, after a public hearing duly called and held, the Town Board of the
Town of Southold (herein called the “Town”), in the County of Suffolk, New York determined
that it is in the public interest to increase and improve the facilities of the Fishers Island Ferry
District (referred to herein as the “District”), and ordered that such facilities be so improved;
Now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN
THE COUNTY OF SUFFOLK, NEW YORK (by the favorable vote of not less than two-thirds
of all the members of said Board) AS FOLLOWS:
Section 1. The Town hereby appropriates the amount of $460,000 for the
increase and improvement of facilities of the District, consisting of the acquisition of a high
speed passenger ferry boat. The estimated maximum cost thereof, including preliminary costs
and costs incidental thereto and the financing thereof, is $460,000. The plan of financing
includes the issuance of bonds in the principal amount of $460,000 to finance said appropriation,
and the assessment, levy and collection of assessments upon the several lots and parcels of land
within the District in the same manner and at the same time as other Town charges, but if not
paid from such source, all the taxable property within said Town shall be subject to the levy of
ad valorem taxes, in an amount sufficient to pay the principal of and interest on said obligations.
Section 2. Bonds of the Town are hereby authorized to be issued in the principal
amount of $460,000 pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called the “Law”), to finance
said appropriation.
Section 3. The following additional matters are hereby determined and stated:
(a) The period of probable usefulness of the object or purpose for which said
bonds are authorized to be issued, within the limitations of Section 11.00 a. 26 of the Law, is
thirty-five (35) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution. The foregoing statement of intent with respect to
reimbursement is made in conformity with Treasury Regulation Section 1.150-2 of the United
States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of said bonds shall contain the recital of validity
prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation said
bonds shall be general obligations of the Town, payable as to both principal and interest by a
general tax upon all the taxable real property within the Town. The faith and credit of the Town
are hereby irrevocably pledged to the punctual payment of the principal of and interest on said

bonds and any notes issued in anticipation of the sale of said bonds, and provision shall be made
annually in the budget of the Town by appropriation for (a) the amortization and redemption of
the bonds and any notes issued in anticipation thereof to mature in such year and (b) the payment
of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the
issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative
to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections
56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized, and the renewals of said bond anticipation
notes, and relative to executing contracts for credit enhancements and providing for substantially
level or declining annual debt service, are hereby delegated to the Supervisor, the chief fiscal
officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with, and
an action, suit or proceeding contesting such validity is commenced within twenty days after the
date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This resolution shall take effect immediately and the Town Clerk is
hereby authorized and directed to publish the foregoing bond resolution, in summary, in “The
Suffolk Times,” a newspaper having a general circulation in said Town, which newspaper is
hereby designated as the official newspaper of the Town for such publication, together with the
Town Clerk’s statutory notice in the form prescribed by Section 81.00 of the Local Finance Law
of the State of New York.

NOTICE
The resolution, a summary of which is published herewith, has been adopted on March 26, 2019,
and the validity of the obligations authorized by such resolution may be hereafter contested only

the County of Suffolk, New York is not authorized to expend money or if the provisions of law

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED MARCH 26, 2019, APPROPRIATING
$460,000 FOR THE INCREASE AND IMPROVEMENT OF
FACILITIES OF THE FISHERS ISLAND FERRY DISTRICT,
AND AUTHORIZING THE ISSUANCE OF BONDS IN THE
PRINCIPAL AMOUNT OF $460,000 TO FINANCE SAID
APPROPRIATION
The object or purpose for which the bonds are authorized is the increase and improvement of
facilities of the Fishers Island Ferry District, consisting of the acquisition of a high speed
passenger ferry boat at the estimated maximum cost of $460,000.
The maximum amount of obligations authorized to be issued is $460,000.
The period of probable usefulness is thirty-five (35) years.
A complete copy of the Bond Resolution summarized above shall be available for public
inspection during normal business hours at the office of the Town Clerk, Town Hall, 53095 Main
Road, Southold, New York.
