STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because: The property i~ question is overgrown with trees, honeysuckle otc and there is a swamp area in the centrai part of the lot. There is a relatively ~open:~spa. ce in,front of the swamp ~here it is proposed t~ lecatethe.garage, but it would leave space for a 35ft setback. The property west of thais location has many trees which we are trying to save and improve. The area surro~mding this let is elevated se that the swamp area is natural drainage for 'a:~A~Es area. It would be impractical te attempt to fill in the swamp area. 21 The hardship created is UNIQUE and 'is not shared by all properties alike in the immediate vicinity of this property and in this use district because: This lot is the lowest ares .in the vicinity, and bas the densest growth of trees etc. 3. The Variance would observe the SPirit ~f the Ordinance ~cJnd WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because: This is a residential area, where there is no uniform setback of dwellings or accessory buildings, there are ether detached a accessory buildings i~ the entire area.
