Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: HUGH LEE SWITZER IRREVOCABLE TRUST 600 BURTIS PLACE, PECONIC SCTM#: 1000-67-4-21.1 Dear'Mr. Herrmann: The Southold Town Board of Trustees reviewed the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC, last revised February 22, 2019 and determined that the proposed single family dwelling and appurtenances on the captioned property are out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required for the proposed structures. The property is located outside Chapter 275 jurisdiction relative to the tidal wetland located on the opposite side of Mill Lane pursuant to Section 275-4(A)(1)(m) of the Town Code; and the proposed construction activities are located outside Chapter 275 jurisdiction relative to the freshwater wetland located to the northeast of the property pursuant to Section 275-3(C)(5) of the Town Code. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the 2 coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Specifically, after you identified a small freshwater wetland area located to the northeast of the subject property and we met there to identify the wetland limit nearest to the property, we had the survey updated to reflect the location of the wetland and the Trustees' 100'jurisdictional area pursuant to Chapter 275 relative to the subject property. As you will see from the enclosed copy of the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC, last revised February 22, 2019, the wetland is as you believed located approximately 75 feet to the northeast, as the 100' radius representing the Trustees' jurisdiction extends up to 25 feet onto the subject property. The site plan has thus also been amended to reflect an extension of the project limiting fencing around the northeast side of the proposed project. The site plan has also been revised to reflect a modified dwelling design and a generally more comprehensive development plan. Therefore, please issue your letter of non jurisdiction to reflect that a) the property is located outside-Chapter 275 jurisdiction relative to the tidal wetland located on the opposite side of Mill Lane pursuant to Section §275-4(A)(1)(m) of the Town Code; and b) the proposed construction activities are located outside Chapter 275 jurisdiction relative to the freshwater wetland located to the northeast of the property pursuant to Section§275-3(C)(5) of the Town Code.
