REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (xx) A Variance to the Zoning Ordinance ( ) is requested for the reason that: It is desired to convert the existing ba:?n into a one family residence. The building in question has existed for m~ny years on a lot of 270 ft frontageon highway, 555 ft deep on one side, 589 on other & 198 ft on creek, but has only a 5 ft setback from sideline of' property. A variance is requested to use the (Continue on other side) existing building for residential putposes. l~onn ZB1 REASON FOR APPEAL Continued 1.: STRICT :APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because ~ The existing building which it is desired to convert to residential use has existed on the property for many years prior to the adoption of the zoning ordinance, and while~ it has ~nly a five foot sideyar&, there-~is much more total area tha~iis required ~f the ordinance. Th~ i~ediate area is not ~tensiY built~'and th~s the proposed use would not tend to conjest any one or thing. A building of this size would be costly tc move such a short distance to make it complyi~wit?~Present requirements. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate vicinit~ of this p;r0perty and in this use district because: - 'This parcel is part ofthe largest estate in the area, which has recently been divided by heirs~ 3. The Variance-wQuldlobSe~e'the-spirit:bf, the! o~inohce and.WOUL~ NOT CHANGE THE CHARACTER OF THE DISTRICT because: the present buiidings have existed many years in their present location. The proposed use i~ residential in a residential area, and the lot is of extremely generous proportions, greatly in excess of the requirments of the ordinance. This application must be completely filled in by typewriter or in ink and submitted in duplicate to the Building Inspector. b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or areas, and gwing a detailed description of layout of property must be drawn on the diagram which is part of this location. c. The work covered by this application may not be commenced before issuance of Building Permit. d. Upon approval of this application, the Buildin~ Inspector will issue a Building Permit to the applicant. Such permit shall be kept on the premises available for inspection throughout the progress of the work. e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy shal have been granted by the Building Inspector.
