Tax Roil: Lily Woersdoerfer Unoccupied Upon receipt of an application for a Pre-existing Certificate of Occupancy, I made an inspection of the buildings on this prop- erty. I picked up keys from Mrs. Malinauskas and began this in- spection at approximately 10:05 A.M. The main house and the two-story cottage with an attached one-car garage are the pre-existing buildings on the premises. These units Were last registered by the previous owner, Henry A. Labens, on July 28, 1956, as required under Article VIII, Section 300 of the Multiple Residence Law of the State of New York. The registration by owner of record has not been made with the Building Department, Town of Southold, as required by statute. Also, addi- tional units have been added to the north end of garage attached to the two-story living unit. These consist of a one-room effi- ciency apartment and a single room with full bathroom facilities. This illegal addition is in violation of the New York State Multiple Residence Law and the Zoning Ordinance, Chapter 100, Town of Southold, New York, requiring building permits, Article VIII, Section 301 and Article XIV, Section 100-141 ~espectively. A metal accessory building is located in the rear yard, behind living units. There is no record of a building permit being issued for this structure as required by the Zoning Ordinance, Chapter 100, Town of Southold, New York, Article XIV, Section 100-141. The main building is a one-and-one-half story, wood framed structure. The first floor consists of a kitchen, a large L-shaped room for dining and living, and a hallway which provides access to two bedrooms, a full bathroom, and stairway leading to the second floor. The second floor contains one large sleeping room and a half bathroom. A free standing, gas-fired warm air heater provides heat to second floor area. Heat is furnished to first floor from a gas fired, hot water furnace located in the partial full cellar of the building's c~ment block and rubble stone foundation. A metal canopy over a flush cement patio provides protec~tion for two rear entries, one of which is to the bedroom on the northwest corner of building. The building in rear yard area is a partial two-story and one-story, wood framed structure. The two-story unit with entries on south and east sides contains one large room on first floor with full bathroom and kitchen facilities. There are two connecting rooms on second floor used for sleeping. Heat is furnished to this unit from a gas-fired, warm air furnace installed on exterior wall Page 2 - Lily Woersdoerfer on west side of building. A one-car garage connects two one-story units. One is an efficiency one-room apartment containing full kitchen and bathroom facilities. There is a single entry door on the east side of building. The end unit has a single room with full bathroom facilities. This unit also has one single entry door. There is a pre-existing wood framed utility shed which is located close to the property line on the east side. Other structures on the property include a fence erected under Building Permit 6919Z, dated October 11, 1973. The following violations of the Housing Code, Chapter 52, Town of Southold, New York, were found: MAIN DWELLING Entries - east side to living room and north side to bedroom, no means of controlling light in room on entering, Article V, Section 52-56 B (2). Kitchen - gas cooking range and oven, the built-in units, no shu~ off valve at units, Article V, Section 52-52 B Kitchen appliances and walls of room are in an unclean, unsanitary condition, Article VII, Section 52-71 D E. TWO-STORY UNIT ~~ (2) . Entries - south andC'~ast sid_~ no means of controlling light in room at point of entry, Article V, Section 52-56 B (2). Flooring - weak and deteriorating at kitchen sink and near window at south end of room. Flooring rotted away at the latter location exposing ground directly under flooring (It appears building was constructed on ground without crawl space and proper venting of foundation), Article III, Section 52-30 A, B, & C; Section 52-31 A; Section 52-32 A. Bedrooms on second floor, one room provided with privacy (~tatement of Registry declares this unit to have two bed- rooms, dated July 28, 1956), Article II, Section 52-24 D (2). Stairway - no rail on open side, width of stairway 28", Article II, Section 52-27 A & B. Attached garage - west wall constructed of two fixed door units, bottom panels pushed out creating excessive openings to exterior, Article III, Section 52-31 A & B. One-story living unit added without building permit sometime between this inspection and Statement of Registry dated July 28, 1956. Page 3 - Lily Woersdoerfer EFFICIENCY APARTMENT SLEEPING UNIT Gas cooking range - no shut off valve at unit, Article V, Section 52-52 B (2). Exit door - sliding pocket-type door not permitted. Also, two windows in unit, each one installed with bottom of window set 58" above floor, Article II, Section 52-28 B. Exit door - sliding pocket-type door not permitted. The following violations of the New York State Multiple Residence Law were found: MAIN DWELLING Kitchen - appliances and walls are in an unclean, unsanitary con-~on, Section 174 under Sanitation, Repairs and Cleanliness. TTACHED GARAGE No fire resistant materials used to separate garage from living units, Rule #7, Moter Vehicle Storage in New Multiple Dwellings, General R~quirements #2 and 4. (New York State Building Construction Code, Multiple Dwellings, Section 402-4.7.) Inspection completed at approximately 11:00 A.M. Key was Yeturned to Mrs. Malinauskas. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal). 3. Approval of electrical installation from Board of Fire Underwriters. 4. Commercial buildings, Industrial buildings, AAultiple Residences and similar buildings and installations, a certificate of Code compliance from the Architect or Engineer responsible for the building. 5. Submit Planning Board approval of completed site plan requirements where applicable. B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing" land uses: 1. Accurate survey.of property showing all property lines, streets, buildings and unusual natural or topographic features. 2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings. 3. Date of any housing code or safety inspection of buildings or premises, or other pertinent in- formation required to prepare a certificate. C. Fees: 1. Certificate of occupancy $5.00 2.
