REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that premises in question situate at East Marion are part of a tract acquired by Edna E. Brown in 1956 which has been sold to at least a dozen different owners including the applicant who acquired her title by deed dated April 16, 1951. REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP becau~ Applicant has contracted to sell the premises to Robert Friedman and Agnes Friedman who wish to build thereon as soon as possible. Approval of access is necessary to obtain a building permit. Contract provides that seller shall make this a~plication. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because--t~' ~ ~.~~ ~.~ 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because: All residents of this immediate area have to use the same access.
