REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reason that premises in question situate at East Marion are
part of a tract acquired by Edna E. Brown in 1956 which has been sold
to at least a dozen different owners including the applicant who acquired
her title by deed dated April 16, 1951. Access to all of these parcels

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP becau~
Applicant has contracted to sell the premises to Robert Friedman
and Agnes Friedman who wish to build thereon as soon as possible.
Approval of access is necessary to obtain a building permit.
Contract provides that seller shall make this a~plication.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because--t~' ~ ~.~~ ~.~
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because: All residents of this immediate area
have to use the same access. The premises in question are larger
than most of the other lots in this locality. No present resident
will be adversely affected by the granting of this application.

of Henry C. Tuthill Estate; from said point of beginning running

Dear Mr. Terry:
Application is hereby made for permission to
erect a dwelling at Bay Lake Park, East Marion, New York,
owned by me and under contract of sale to Mr. and Mrs.
Robert Friedman.
Premises are situate on the west side of a
right of way running from the Main Road to Gardiner's Bay
about 136 feet in width on said right of way and about
250 feet on Marion Lake and over 200 feet in depth.
