SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 12, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 7,244 sq. ft. parcel in the R-40 Zoning District. The parcel measures 50.00 fronting Sigsbee Road along the easterly property line, 145.09 along the southerly property line, measures 50 feet along the westerly property line, and 144.95 feet along the northerly property line. The parcel is improved with a one story house, an attached a wood deck, a detached accessory garage and a shed, as shown on survey prepared by Kenneth M. Woychuk, L.S., last revised April 5, 2018. BASIS OF APPLICATION: Request for Variances under Article XXIII, Section 280-124 and the Building Inspector's August 17, 2018, Amended September 18, 2018 Notice of Disapproval based on an application for a permit to make additions and alterations to an existing single family dwelling at: 1) located less than the code required minimum side yard setback of 10 feet; 2) more than the code permitted maximum lot coverage of 20%; located at: 1980 Sigsbee Road,Mattituck,NY. SCTM#1000-144-1-15. RELIEF REQUESTED: The applicant requests a variance to construct a covered porch and wood stoop attached to a single family dwelling while proposing a 27.9% lot coverage, which will exceed the allowable 20% lot coverage, and have a side yard setback of 6.2 feet instead of the required 10 feet side yard setback. ADDITIONAL INFORMATION: The survey prepared on August 13, 2017 depicts 2,240 sq. ft. of lot coverage or 30.9 % which exceeds relief the applicant was granted in Appeal No. 3512 on May 15, 1986 for approximately 28% lot coverage. The applicant proposes to remove the existing shed, and remove an existing wood deck that is attached to the rear of the dwelling, and replace it with a 4 ft. by 8 ft. wood stoop to reduce lot coverage 27.9%. Page 2, February 21, 2019 #7240, Crom SCTM No. 1000-144-1-15 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 7, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many of the homes on Sigsbee Road have non-conforming setbacks, lot sizes, and excessive lot coverage. The front porch entry maintains a conforming front yard setback 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The covered porch entry on the front of the dwelling is as built and has the same side yard setback as the existing dwelling, which received prior side yard variance relief. A variance must be obtained for the applicant to keep the as built porch 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 38% relief from the code for the side yard setback and 39% relief from the code for lot coverage. However, the proposed lot coverage will become less non-conforming than what currently exists on the property, and will be slightly less than the 28% lot coverage that was previously approved by the Board of Appeals in 1986; and the as built front porch maintains the previously approved non-conforming side yard setback 4. Town Law X267-b(30)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 if the Town's Stormwater Management code 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of covered front porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairperson Weisman, seconded by Member Lehnert, and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Kenneth M. Woychuk, LS, last revised April 5, 2018 and architectural drawings prepared by Jim Deerkoski, P.E. dated February 12, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The applicant shall remove the existing 8.3 feet by 10.2 feet. frame shed and replace the existing rear wood deck with a 4 ft. by 8 ft. wood stoop. 2) The proposed covered porch shall remain unenclosed and unconditioned. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. If the Building Department determines that the construction of additions and alterations, as described in this determination, exceed the scope of the approvals granted herein, or a demolition has occurred, the Zoning Board of Appeals shall retain jurisdiction and shall have the right, after a public hearing, to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXil Section 280-141 of the Town Code. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. BAIL SEP Decision Rendered June 25 , 1986 ZONING BOARD OF APPEAL By this application , appellant requests variances : (a ) for permission to construct an 11 ' by 17 ' deck addition at the rear of the existing dwelling having a setback from the rear property line at 35 feet and from the westerly side property line at 10 feet , which exceeds the present lot coverage of 1796 square feet with an additional 170 square feet , and , (b) for permission to construct roof overhang of approximately 45" by 14' 2" deep , leaving a reduced sideyard at not less than 50 inches , and exceeding the lot coverage limitation by an additional 70 square feet . The total lot coverage in excess of the existing 1796 square feet is 241 - feet , for a total of 2036 square feet. Twenty-percent of the total lot area is 1450 square feet. 4. Itis the opinion of the board that the variances requested are minimal and that the roof overhang is necessary to prevent water from accummulating in the existing cellar stairway. In considering this appeal , the board also finds and determines : (a) that the difficulties claimed are sufficient to warrant the granting of this variance ; (b) there will be no substantial change in the character of the neighborhood or detriment to adjoining properties ; (c) that the relief requested is not substantial ; (d) that the difficulty cannot be obviated by some method feasible for appellant to pursue other than a variance ; (e ) that the variance will not in turn cause a substantial effect of increased population density or be adverse to the safety , health , welfare , comfort, convenience and order of the town ; (f) that in view of the manner in which the difficulty arose and in consideration of all the above factors , the interests of justice will best be served by allow- ing variance , as noted below.
