The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item "F"which states: F. Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA. Although the structures were constructed without seeking the benefit of Board review, the action is categorically exempt. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted,because: The existing one story house was renovated with a new elevated foundation to protect from storm flooding. The existing house, prior to the renovation, had a front yard setback of 18.5' and 7.4' side yard setback. A front porch was added to the house applying the average front yard setbacks. The average front yard setback permitted is 14' 16". The proposed is 14' 6" (the degree of nonconforming front yard setback is 10" (less than one foot). The side yard setback requested is 7.2 when the existing is 7.4. The existing side yard setback of the house was retained, however, because the lot narrows slightly towards the road no one realized that the side yard was reduced from 7.4' to 7.2.' A minor reduction (2 inches). The applicant obtained a building permit for the existing porch but the Certificate of Occupancy could not be issued due to the small variances required. The porch adds character to the house, otherwise the house foundation would overwelm the appearance of the house. The porch softens the appearance of the house from the road. In addition,the porch gives the owner a small sitting area at the same level as the house. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The porch was constructed with a building permit. The porch would have to be cut and only an elevated staircase would be permitted without the requested variances. The deck was a significant investment. In order to maintain the existing setbacks, the staircase was placed off center. New footings and a new structure would need to be reconstructed. (3) The amount of relief requested is not substantial because: The relief requested is minimal. As previously stated, the average front yard setback permitted is 14' 16". The proposed is 14' 6" (the degree of nonconforming front yard setback is 10" (less than one foot). The side yard setback requested is 7.2 when the existing is 7.4. In addition, as is shown on the survey and as seen from the road the porch and house are set back from the road more than three of the four neighbor's homes. The difference between all the neighbor's setbacks and the applicant's is more or less 6 inches. The deck is an additional 4' back but the landing encroaches onto the front yard. The Young & Young survey shows the front yard setbacks of each neighbor's home. The home is only one story, an outside porch provides the owner with a minimal living space at the same level as the first floor. The landing and stairs provide mandatory access. The landing ansd stairs turn to the driveway (north) to limit the encroachment toward the street. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The "as built" porch and stairs have no impact on the physical or environmental conditions in the neighborhood.
