HENRY HINTZE, LYNN MCMAHON, AND MARIE BASILE#7234 - Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's July 12,2018, Amended July 13, 2018, Notice of Disapproval based on an application for a building permit to make additions and alterations to an existing single family dwelling; at; 1) located less than the code required minimum side yard setback of 10 feet; 2) located less than the code required minimum combined side yard setback of 25 feet; 3) more than the code permitted maximum lot coverage of 20%; at: 590 Brooks Road, (Adj. to Pipes Neck Creek), Greenport,NY. SCTM#1000-53-1-15. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as INCONSISTENT with the below LWRP policies. Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The requested variances do not enhance community character in that they do not meet the purpose and intent of setbacks to the property lines or maximum lot coverage. Development that does not meet bulk schedule restrictions results in an erosion of community character and sets precedent. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. The proposal includes adding 4 additional bedrooms. The location and function of the sanitary system is unknown and has not been adequately provided. In the event the application is improved it is strongly recommended that landowner is required to replace the existing sanitary system with an I/A On-site Wastewater Treatment System due to the proximity to Pipes Cove, a high value marine wetland,. Funding may be available to replace existing systems through http:/hvww.reelaimoiLrwater.inloH. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
