Specifically, many of the properties located in close proximity to the subject parcel are less than a quarter-acre in size with even smaller "Buildable Land" areas due to the presence of freshwater wetlands associated with the lake, leaving both limited space indoors and outside on the property for storage of common recreational and household items such as outdoor lawn furniture, bicycles, kayas, and gardening equipment. The subject parcel, for example, has a total area of 4,943 sf and a buildable land area of 4,631 sf, meaning that permissible lot coverage is limited to 926 square feet, little more than the minimum 850 sf living floor area required for a single-family dwelling in an R-40 zoning district. Because current lot coverage is 911 square feet, addition of the proposed 96 sf shed on the property will require 81 sf of lot coverage relief from §280-124(B) since total lot coverage will increase to 1,007 square feet or 21.7 percent of buildable land. However, granting of this relief will not produce an undesirable change to the character of the neighborhood. Rather, the overall lot coverage and structural density of the property will be consistent with that of the surrounding community and the two neighboring properties in particular, both of which are similar in lot size and improved with similarly sized dwellings and sheds located in close proximity to the applicants' side property lines. And to additionally mitigate the shed's potential visual impact on the neighborhood and the northerly adjacent property in particular due to the additional relief needed from §280-15 for placement of the shed in the northerly side yard, the shed will be sided, painted, and roofed to match the existing dwelling; will not exceed 9 feet in height at its peak to match the height of the neighboring sheds; will meet the required 3' side yard setback from the northerly property line; will be largely obscured from the view from the north by the existing 6' stockade fence located along the property line; and, unlike the neighboring sheds, would not interfere with lateral water views. Therefore, granting the relief needed from §280-15 and §280-124(B) to erect the proposed shed will not have an undesirable impact on the character of the neighborhood or cause a detriment to nearby properties. Because the existing lot coverage is 911 square feet, it is not possible to place a shed on the property without relief from §280-124(B). And it is not possible to avoid the need for relief from §280-15 for placement of the shed in the side yard because there is not enough room to place a shed in the front yard; and while there may be just enough room to physically place the shed in the rear yard, best environmental management practices and the regulatory wetland protections enforced by the New York State Department of Environmental Conservation and Town of Southold Trustees prevent placement of the shed immediately adjacent to the freshwater wetlands and surface water of Marion Lake. And the benefit of having additional storage space on the property cannot be more reasonably achieved by any means other than proposing a detached storage shed on the property. Specifically, the very small house, which contains no garage, no basement, no attic, and has a total footprint of 665 square feet (including the porch and stoop), simply does not provide sufficient space for storing common household or recreational items such as outdoor patio furniture, bikes, kayaks, bar-b-que grill, or lawn mower. And although a small outdoor"shed" that was authorized by the Board for the prior owners in 2012 remains currently"attached" to the house, this structure is truly a small, narrow storage bin for small items; is not watertight; and pursuant to the Board's decision can never be replaced (Case No. 6604). Therefore, the need for additional storage space and the requested area variance relief is unavoidable. 3) The 81 sf of lot coverage relief required for the proposed shed, which is small enough to be exempt from Building Permit requirements, is mathematically insubstantial. The relief required for placement of the shed in a side'yard is also insubstantial, as the shed meets the required side yard setback and would not affect the neighboring properties any differently than if it were located in a conforming rear yard location to the east of the house. 4) Placement of the proposed 96 sf shed would not have any significant adverse impacts on the physical and environmental conditions of the subject property or natural resources. In fact, the shed is proposed in the side yard rather than in the rear yard—where it would be located substantially closer to the freshwater wetlands associated with Marion Lake—in in order to avoid any such natural resource impacts. The same buffer area was previously required as a condition of Town Wetlands Permit No. 7858A, which was issued to the prior owners in 2012, but was never formally documented by a notice covenant to the deed. 5) The difficulty is self-created due to the applicants' presumed constructive knowledge of the lot size and dwelling constraints at the time they purchased the property. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30-days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. 2. Conformance With Plans All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or applicant's agent as part of the permit application. Such approved plans were prepared by Nathan Taft Corwin III last revised April 17, 2018 and stamped NYSDEC Approved" on July 20, 2018. 3. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. Area Limits The limits of clearing, grading and ground disturbance line is equal to 3 feet beyond all sides of the proposed shed, as shown on the approved plans. 5. Work Area Limits Any work, disturbance, and or storage of construction materials shall be confined to within the limit of clearing and ground disturbance as described above. 6. Equipment storage less than 100 feet from the wetland. If equipment and machinery cannot be stored greater than 100 feet from the wetland a the end of each work day, then it must be stored as far from the wetland boundary as possible and an absorbent tarp/mat system must be used. The absorbent tarp /mat system must ensure that inadvertent,le'aka'ge`of deleterious substances never reaches the ground or into the regulated wetland for water body/wetland. 7. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. 8. Seed, Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass, and mulched with straw immediately upon completion_ of the prcject,.twithin two days of final grading, or by the expiration of the permit, whichever is first. 9. Temporary Mulch, Final Seeding If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather. conditions favor germination and growth but not more than six months after project completion. 10. Minimum % Vegetative Cover Suitable vegetative cover is defined as a minimum of 85 % area vegetative cover with'contiguous unvegetated areas no larger than 1 square foot in size. 11..Clean Fill Only All fill shall consist of clean=soil, sand and/or gravel that..i&,fiee"of the following,' substances: asphalt, slag, flyash, broken concrete, demolition:-debris,,garbage;household refuse, tires,: woody materials including tree or landscape debris, and metal objects. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby,authonzed shall not be completed, the owners, shall, without expense to the State, and to such'extent and in such time and manner as'the-Department of Environmental Conservation'may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse.
