EASEMENT AGREEMENT
THIS INDENTURE made this PS day of.J anuu l 2019, by and between Ellen
Harvey, 756 Rugby Road, Bryn Mawr, PA 19010(hereinafter referred to as"Grantor") and Tad
Glenn Sperry, 756 Rugby Road, Bryn Mawr, PA 19010 (hereinafter referred to as"Grantee").
WHEREAS, Grantor owns certain improved land situate at 1106 Equestrian Avenue,
Fishers Island, New York 06390, Suffolk County Tax Map No. 1000-9-4-14.2 ("Grantor's
Property"); and
WHEREAS, Grantee owns certain improved land situate at 1108 Equestrian Avenue,
Fishers Island, New York 06390, Suffolk County Tax Map No. 1000-9-4-14.1 ("Grantee's
Property"); and
WHEREAS, Grantor, for good and valuable consideration, is desirous of conveying an
Easement to Grantee over a 580 square foot portion of Grantor's Property so that Grantee can
construct a septic system.
WITNESSETH:
1. Grantor does hereby grant, transfer, bargain, sell and convey unto Grantee, in
perpetuity, an Easement in gross of the nature, character, and to the extent hereinafter set forth,
over and upon the 580 square foot portion of Grantor's Property more fully described in
Schedule "A" attached hereto ("Easement Area").
2. The nature, character and extent of the Easement hereby granted is as follows:
A. Grantee shall have the right, subject to the rights of the Grantor, its
successors and assigns as more fully set forth herein, to construct and maintain a septic system
for the benefit of Grantee's property and to access the Easement Area as needed for maintenance
of said system.
B. The location of the Easement Area described in Schedule "A" shall not be
changed without the consent of both parties and their respective representatives.
C. Any and all costs associated with the use of said Easement shall be borne
solely by the Grantee, and furthermore, the Grantee, in conjunction with use of the Easement by
the Grantee, agrees to provide the Grantor with proof of liability insurance provided for by the
Grantee, naming the Grantor, its heirs, successors and assigns as the case may be, as an
additional insured thereon as the Grantor's interests may appear.
D. Grantee also agrees to indemnify, save and hold Grantor harmlcss against
any and all claims for property damage and/or personal injury arising out of the use and
enjoyment of said Easement by the Grantee, their heirs, successors and assigns, invitees and
trespassers to the extent not covered by insurance. Grantor, its successors and/or assigns, shall
notify the Grantee by certified mail, return receipt requested, of a change in ownership in order
to facilitate changes in the endorsement.
3. This Agreement shall inure to the benefit of, and bind, the parties, their heirs,
successors, legal representatives and/or assigns, and shall run with the land in perpetuity.
IN WITNESS WHEREOF, the parties hereto have executed this Easement Agreement on
the day and year first above written.

Southeasterly corner of land now or formerly of Tad Glenn Sperry, said pipe being at the
Southwesterly corner of the herein-described Easement and located 2,037.28 feet North of a
point which is 2,326.24 feet West of a monument marking the United States Coast and Geodetic
Survey Triangulation"PROS";
THENCE running North 16 degrees 21 minutes 05 seconds West, 20.00 feet to a point;
