SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. Before
we get to the business of the agenda, I wanted to mention that we have a gentleman named Ted
Webb, Edward Webb who lives out in the Orient-East Marion area, who actually is stepping
down from his role as an emergency shelter coordinator, in that area, representing that area. He
has done a great job, he has been there from the beginning. They have such a well-run shelter,
that became very apparent during hurricane Sandy, hurricane Irene. I want to thank him, he
stepped forward to help along with another great group of people, so I want to publicly thank
Ted for everything he has done for the people of Southold Town. Now, what we will do is we
will get to the business of the agenda. I know some are here to probably speak on the public

hearing, what we will do is get the agenda done and then we will go into public hearing and take
comment on that.
COUNCILWOMAN DOHERTY: Scott, can I just add to the shelter thing, that the town is, we
had a conversation at the work session today that anyone who wants to volunteer for our shelters
when we need them to, what did we say, get in touch with your office?
SUPERVISOR RUSSELL: Yes, Denis in my office.
COUNCILWOMAN DOHERTY: Denis, yes, Denis Noncarrow in the Supervisor's office if you
are interested in volunteering when the shelters are open.

Financial Impact: Total Department Cost for Event = $1,603.44
RESOLVED that the Town Board of the Town of Southold hereby grants permission to The
North Fork Chamber of Commerce and the Cutchogue Fire Department to use the following
route: staging on Eugene's Road and begin at Cox Lane, west on the Main Road to Cases Lane,
ending at the Village Green for its 15th Annual St. Patrick's Day Parade in Cutchogue, on
Saturday, March 9, 2019 beginning at 1:00 PM,provided they adhere to all the conditions in the
Town's Policy for Special Events on Town Properties. No objects of any kind shall be thrown to
event spectators. All fees, except the clean-up deposit, shall be waived.

WHEREAS, the Building Inspector of the Town of Southold inspected the property located at
2875 Hyatt Road, Southold, SCTM #1000-54-1-12 and prepared a written report of his findings
in the form of a Notice dated January 7, 2019; and
WHEREAS, the Building Inspector determined the structure to be unsafe and dangerous due to
inadequate maintenance, neglect, dilapidation and abandonment; and
WHEREAS, said Notice was sent certified mail to the interested parties, Carla Block; and
WHEREAS, the Notice advised that the property must be made safe, and if the owner failed to
comply, that a hearing would be held before the Southold Town Board on January 29, 2019; and
WHEREAS, the owner or agent failed to remediate the premises or demolish the structure prior
to said date; and

WHEREAS,the Southold Town Board held a hearing pursuant to Chapter 100 of the Southold
Town Code on January 29, 2019 at 9:00 a.m. The Southold Town Board reviewed documentary
evidence, including notice sent to the property owner and photographs of the premises; and
RESOLVED, that the Town Board of the Town of Southold hereby adopts the recommendation
of the Building Inspector and hereby declares the structure located on the property of 2875 Hyatt
Road, Southold, to be an unsafe building pursuant to Chapter 100 of the Southold Town Code;
and further directs that service of this Notice be made on the owner of the premises, and in the
event that complete rehabilitation or removal of the structure by the owner has not occurred
within thirty (30) days of service of this Notice, the Town directs demolition of the structure and
removal of associated debris and the costs and expenses incurred assessed against the property of
2875 Hyatt Road, Southold, in accordance with Chapter 100 of the Southold Town Code.

SUPERVISOR RUSSELL: What we generally do when we have local laws proposed, we
generally rather than adopt them that evening, if there's any commentary either written or public
and I do believe we got a letter of opposition, so the Town Board needs to consider all of the
facts before we take a final vote. Just as an aside, I thought a great deal about this local law and I
understand the purpose for it but I wonder if we are looking for a rather substantial permanent
solution to what might be a transient issue but it is something I am going to consider very heavily
over the next two weeks.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose

ROBERT DUNN: Robert Dunn, Peconic. Just one point, you weren't here last meeting, you
were sick. After the meeting, I happened to be outside chatting with some people, the meeting
went rather quick and so after the meeting I happened to be chatting with some people outside
and I would say four people showed up for 7:30, so you might want to put that out there a little
more. Put that on the website that the time has changed from 7:30 to 7:00 because people
weren't aware of it. I guess they just don't read the little spot.
SUPERVISOR RUSSELL: It's a point well-taken, I actually had some reluctance because of the
habits that were formed over the years, 4:30 to 7:30, so people just presume they are at 7:30.
You are right, it moved a little bit earlier because sometimes public hearings go late.
MR. DUNN: It goes too late, I fully understand.
SUPERVISOR RUSSELL: No, I am just trying to explain.
MR. DUNN: There's no debate to it but I just think you need to get it out there a bit more so
people don't come and get disappointed, saying good-bye to everybody.
SUPERVISOR RUSSELL: I don't like change myself but we will certainly make an effort to
reach out to as many people as possible....
MR. DUNN: I'm not crazy about it, I can't see the news before I come.
SUPERVISOR RUSSELL: We will make an effort to get it out there more and more.
MR. DUNN: The second thing is, we spoke a little, I don't like to interject too much during the
work session because it's really not a public discussion area, but we were talking about the IA
systems and I had raised the issue once before with Denis...

COUNCILMAN GHOSIO: For those of you who are here who don't know what IA's are...
MR. DUNN: It's a new type of septic system that's being encouraged and being almost required
if you live along the shorefront, it puts less nitrogen out into the Sound, which is critical to all
that stuff that's growing out there that we don't like. Anyway, as I had said, I am putting one in
and the price of it can knock your socks off. In my situation, but what I have existed many other
places and the reality of this, these systems are going to have an impact, they are not going to
have an impact by new construction, it's going to be retrofitting. That's really where they can be
effective, I mean, when you consider the amount of houses we have as opposed to the amount of
houses you are building each year, the number we build each year is very small amount of the
total that are already in place. Some of the systems I am sure that are out there are working fine
but some of them are not. We know that there's whatever in the ground, that some of these older
homes, some of the south shore, as you said, some of the south shore towns have a lot of money
in their CPF funds are able to, some of them are underwriting them in their entirety, which I
personally think is a little nuts. When someone has a $7,000,000 home and the town has to help
them with a $100,000 bill. In any case, it wouldn't help me, it would be way too late for it but I
think it's time for you guys to start considering something to encourage some of the retrofits, via
a grant, via a tax thing over four or five years, a tax credit. And it doesn't have to be a lot,just to
put some skin in the game, the change to these systems is going to come as much by, the
economy is a scale so the price will go down but it's also getting the people who design for our
community to be willing to use it, nobody likes to, like you said before, nobody likes to do
anything new, so when you tell these guys why don't you design that system, right away there's
pushback because they are uncomfortable with it because it's new. I had happened to use
Glynnis who's very comfortable with them, she's been in them since the beginning here. But a
lot of the people that design the houses and do the installations and certainly some of these guys
that have been digging cesspools and septic systems for years, they don't want to deal with them
because they don't understand it. It's the same work, it's just putting different mechanics into
the ground than they are currently using. So anything that gets it moving along and like I say, it
doesn't have to be a lot of money, just some skin in the game that encourages people to do it
would be good. Thank you.
SUPERVISOR RUSSELL: Just a point of information, a few y ears ago, I had called for the
state should consider a tax credit against investment in the IA systems. It worked for solar
panels, it did.
MR. DUNN: Absolutely.
SUPERVISOR RUSSELL: It really promoted the use of solar energy in residential properties.
MR. DUNN: I got that, too.
SUPERVISOR RUSSELL: And New York State secured about $5,000,000 underwriting a grant
to study nitrogen loading into the bays, into the estuaries. If New York State is willing to
commit $5,000,000 to a study and it will hopefully create a roadmap, the long term consequences

of what costs they might absorb over tax credits, over time, I think they could absorb. They've
done it in the past for different issues that are compelling for public policy...
MR. DUNN: Sure.
SUPERVISOR RUSSELL: And they should do it here.
MR. DUNN: It doesn't have to be, like I said, a tax credit is better because nobody is laying out
cash but it means something to somebody, if you say to somebody, well, you'll get a $1,500 tax
credit, it may be over five years, so you are really only getting $300 a year but people spin those
numbers in their head. I mean, for someone like myself, what I am considering now in terms of
the cost of this, you know, it's the rest of my life. I am retired, what I got is what I got, I never
am going to get another big hit here. I may get another part-time job here and there for a couple
of bucks and gas money but there's never going to be any large sums of money going into my
bank account but if you tell me that there's $1,500, well, that's real even if it's going to take five
years to get it. That's $1,500, it's $1,500. So those and when you consider who owns the
properties, a lot of them are retired so why would you want to take a major portion of your net
worth and put it into this,well,just gives people a little more encouragement to do this.
SUPERVISOR RUSSELL: I would agree. The one problem in the Hamptons is they are flush
with money in the Community Preservation Fund...
MR. DUNN: They are. Their whole....
SUPERVISOR RUSSELL: The problem with their program is...
MR. DUNN: They don't know where to spend it.
SUPERVISOR RUSSELL: They haven't really identified priority areas. The first thing we need
to do as a town before we even consider spending any money is or creating grant program,
identify the areas where they are needed the most. For instance, would the eight houses maybe
along a shoreline somewhere be the best way to spend it or maybe should that money be
organized for investing in a sewer system or a treatment facility for a large facility like a school,
in other words, where are you going to get your biggest bang for your buck and I don't think we
are quite there yet but we are getting there. This county is actually evaluating now making IA
systems mandatory, not just for construction or reconstruction, they are actually considering a lot
of different triggers, including transfer of ownership, a deed. Filing a deed would require an
upgrade to an IA system.
MR. DUNN: Right.
SUPERVISOR RUSSELL: It's pretty radical idea. I don't think you are going to see it
happen...

MR. DUNN: which quite frankly is why, as I mentioned this morning, what I am doing at my
house, it's all for my kids. It's not for me. you know, I am just thinking about their future and
do I want to, you know, I'm slowly making improvements to the property, part of this thing is
taking down the garage that is non-conforming and putting it elsewhere on the property that
would be conforming and to just get everything in order to not then have to be told later, well,
you have got to do this. After everything is finished. So, it just makes it, and there's also the
possibility of doing it on a larger scale where a community could do it, I mean, to tell you, my
community would have been perfect. The way it's situated there, there's 38 houses in one little
end. If everyone wanted to get together on something like that, it would work very well. There
are a number of places like this, old bungalow communities that have been broken up and sold
off where you can put a system like this and those are the ones you will find their septic systems
are actually old oil tanks that were buried in the ground with holes drilled in them. So I mean, to
get 8 former houses in a bungalow colony to get together and put in a larger system, it minimizes
the unit costs and makes it work. Those are the places that are near the beaches.
SUPERVISOR RUSSELL: That's another thing that the county is considering under the current
code, you can't mingle septic systems among parcels but they are, there's a lot of discussion of
whether that should be allowed or not. Again, getting back to the Hamptons model, great idea
but you know, they will issue grants regardless of location and Southold, the pot of money no
matter what pot it is is going to be limited. You know, we need to establish a criteria on where
we want that money to go, giving a grant to someone along the spine of the North Road or
something might not have the immediate impacts as say a beachfront community would be but
yeah, there's a lot to think about but I agree with everything you are saying.
MR. DUNN: Thank you.

COUNCILMAN RULAND: To Mr. Dunn's point, Judge Evans previously read the rather
perfunctory resolution that said our next meeting is February 12th at 7:00 PM, so to our TV
audience, our next meeting is February 12`h, it's at 7:00 PM and every evening meeting for 2019
will also be at 7:00 PM. Good point, Mr. Dunn.
MR. DUNN: I was standing out there talking to someone and it really shocked me, people were
getting out of cars. And pretty much everybody had already left.

SUPERVISOR RUSSELL: And the last thing I will mention is a resolution to advertise for
vacancies on committees, we would encourage everybody that would have an interest in getting
involved in a town committee to feel free to submit an application or a letter of interest to the
Town Clerk's Office. If you have a particular interest, you can indicate that on the letter of
intent or the letter of interest, than we could consider it based on that. One thing I want to ensure
the public is, regardless of your interest, contact us, we probably have a committee created just to
