ago on lots 30' - 40' front and less than 12, 500 sq. ft. in area.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because applicant came into title prior to the adoption of the present
ordinance, 12-17-71. At the tirr~/ applicant took title, the plot conformed to the then existing
ordinance, in that the area ]~/al~proximately 18~ 260 sq ft. Applicant is desirous of selling
the plot for sumrne~ re~iderice put-poses, and "as is" a dwelling canflot be ei~cted thereon.
2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate
vicinity of this property and in this use district because when applicant took title, premises
conformed to the existing ordinance, l~remises cannot be used for a residence under the
present town ordinance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because, as previously stated, premises are within a
summer colony in which some of the residences are constructed on 30 and 40 foot lots.
Water for residential purposes poses no problem to the premises in question as
any dwelling erected thereon would be serviced by the water system maintained by the
Rabbit's Lane Association.

Application of Doris Schmitz
Gentlemen:
Doris Schmitz of Rabbit Lane, East Marion has submitted
an application for a variance in accordance with Zoning
Ordinance, Article Ill, Section 301, for permission to divide
property and off-set lots of less than required frontage and
area. In general, the property lies between Rabbit Lane on
the south and Marion Lake to the north, a few feet above the
level of the lake and sea level.
A fe~~y owners on the same south shore of the
lake have and of the lake as fill
to extend their property to the north. On one hand, the property
is considered desirable as it is adjacent to a beautiful, clean
lake and near a slowly eroding beach front. On the other hand,
intense development of the land by granting approval of smaller
~lots will lead to the irrevocable destruction of the lake and
its many positive values.
It is my understanding that the homes along Rabbit Lane
must obtain their water supply from a common we__~___~point near the
bridge over Marion Lake and on Bay~ This is a considerable
distance from Rabbit Lane. How much more of a demand can be
made on the water supply in the area of the lake before there is
an intrusion of salt water?
On the basis of health standards, the water in the lake is
safe enough in which to swim. How many more "tidal flow's cess-
pools can the area to the south of the lake accommodate before
the lake is contaminated? Are health standards maintained when
a newly constructed cesspool fills with water?
The area south of the lake and contiguous to Rabbit Lane
is reaching a critical stage for sanitary waste disposal and
water supply. Further division of said property can be viewed
only from the personal profit motive and not in the best in-
terests of the residents of the area.
