Board and Office Policies, Practices, and Activities: ZBA Or anizational.Meeting On January j, 2019 the Board re-adapted, as written, the ZBA Code of Conduct, the ZBA Guidelines to Open Meetings Law and Ethical Issues, and the ZBA Procedural Guidelines. These three documents were voluntarily developed, as permitted by Town. Code Section 280-148, to supplement and further clarify the responsibilities and ethical standards proscribed for Zoning Boards by the Town of Southold.and New York State and explicate the responsibilities and operating procedures of Board Members, the Board Chair, and the ZBA Assistant. Optional Condition on Variance Relief for Additions and Alterations The number of instances in which demolitions have occurred when variance relief has been granted by the ZBA, for proposed additions and alterations to as built dwellings has been increasing in frequency. When projects exceed the scope of the relief granted, stop work orders must be issued by the Building Department, and delays in construction occur. In January, the members of the ZBA agreed to include a condition of variance relief, when deemed appropriate, with the goal of reducing or at least discouraging these demolitions by better informing property owners of the possible consequences before construction begins. The condition reads: "prior to receiving a building pczxn.t,the owner(s)of the sub' ect property cited herein must sigh a statement acknowledging that the applicant(s)have read this determination and understand the limits of the variance relief granted herein;that the applicant(s)will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the'Town Cade, occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; and that the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code." In future,when ZBA decisions that include this condition are mailed to property owners by the ZBA staff,they will include two Property Owner's Statement forms which must be signed and submitted.to the Building Department and the ZBA office. The Building Department,staff, the Chief Building Inspector, and the Town Attorney, all reviewed the proposed language and process and expressed their approval and support. Ill.
