Appeal No. 3794:
Application of JERRY AND MARY GEORGES for a Variance to the
Zoning Ordinance, Article XI, Section 100-119.2 for permission to
construct addition(s) to existing dwelling with an insufficient
setback from the top of bluff along the Long Island Sound.
Location of Property: 18565 Soundview Avenue, Southold, NY;
County Tax Map District 1000, Section 51, Block 1, Lot 22.1.
WHEREAS, a public hearing was held and concluded on
December 16, 1988 in the Matter of the Application of JERRY AND
MARY GEORGES under Appeal No. 3794; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The property in question is identified on the Suffolk
County Tax Maps as District 1000, Section 51, Block 01, Lot 22.1,
and has a frontage along the north side of Soundview Avenue in
the Hamlet of Southold, Town of Southold, of 103.08 feet.
2. The subject premises contains a total area of .625 of an
acre (or 27,225 sq. ft.) and is improved with a single-family
dwelling as more particularly shown on the site plan map prepared
by Ward Associates, P.C. dated September 28, 1988, set back
approximately 30 feet from its closest point to the top of the
bank, 10 feet from the westerly side property line, 13+- feet
from the easterly side property line, and 133+- feet from the
front (southerly) property line.

3. By this application, appellant proposes to construct:
(a) a second-story open deck at the rear of the dwelling having a
size of 7'9" deep x 24' wide, and (b) a 95 sq. ft. proposed
dining area extension, all as shown on the First Floor Plan
prepared by Ward Associates, P.C. dated September 28, 1988
(Drawing #A-3, Ref. #8512). Also proposed, as shown, are the
reconstruction areas of a portion of the existing dwelling, which
are also located within the 100-ft. setback restriction.
4. Article XI, Section 100-119.2, subparagraph A(1)
requires all buildings and structures proposed on lots adjacent
to the Long Island Sound to be set back not less than one-hundred
(100) feet from the top of the bluff, or bank.
5. The existing dwelling is shown to be set back at 30 feet
at its closest point (and 38 feet at the westerly end) from the
top of the bank line; the width of the parcel is nonconforming at
103.38 feet. ~ne dwelling as exists is understood to have been
built prior to 1957.
6. For the record it is noted that information concerning
the percentage of improvements of the building (as regulated by
Section 100-118 concerning reconstruction of nonconformities) was
requested at the December 8, 1988 hearing, and the following
figures were provided by the agent for the applicant:
(a) Existing residence (one floor): 1907 sq. ft.
(b) Proposed Addition First floor: 813 sq. ft.
(c) Proposed Addition Second floor: 767 sq. ft.
(d) Total improved: 3487 sq. ft.
(e) Percentage of new sq. ftg.: 46%.
7. In considering this appeal, the Board finds and
determines: (a) the activities required for the placement of
this construction are to be built without disturbance to the
vegetation of the bluff or be adverse to the character of the
immediate area; (b) the percentage of relief in relation to
the requirement is substantial; however, there is no other
alternative for appellants to pursue other than a variance;
(c) the practical difficulties are related to the land with the
established nonconformities, and are not personal in nature;
(d) the grant of this variance will not in turn be adverse to
the safety, health, welfare, comfort, convenience, or order of
the town; (e) in considering all the above factors, the
interests of justice will be served by granting the application,
as conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Grigonis, it was

100-119.2A of the Zoning Code for permission to construct
additions as applied in the Matter of JERRY AND MARY GEORGES
under Appeal No. 3794, SUBJECT TO THE FOLLOWING CONDITIONS:
1. There be no disturbance or land changes seaward (toward
the bluff (or bank) area) - any and all grading, excavating, etc.
shall be away from the bluff and directed toward the house/street
yard area;
2. Storm or similar drain(s) be installed and down spouts
to divert rain and drainage away from the bank area;
3. Second-story deck shall remain open and unroofed;
4. Recommend following guidelines of the Soil and Water
Conservation District of Suffolk County (see letter to Board of
Appeals dated November 17, 1988), as to the failing bulkhead, et
cetera.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Sawicki and Dinizio. (Member Doyen of Fishers Island was absent
due to serious family illness.) This resolution was duly adopted.

Dear Mr. Goehringer:
This letter is in response to the question raised by the Board at the public
hearing held on December 8, 1988, regarding the above residence. Section
100-118 Non-Conforming Uses, Paragraph E - "A non-conforming building may not be
reconstructed or structurally altered during its life to an extent exceeding in
aggregate cost fifty percent (50%) of the fair value of the building, unless the
use of such building is changed to a conforming use."
In answer to the specific question regarding the Code, Section 100-118, E; the
following analysis is presented.

The new square footage of the residence accounts for 46% of total improved
residence. It is our opinion that the improved house will not exceed the
present value of the residence by more than 50%, since the foundation, basement
and basic utilities are existing, which account for a large share of the fair
market value.

dwelling near the bluff of the Long Island Sound and as more
particularly shown on the attached sketch copy. Also attached
arecopies of the Suffolk County Tax Map, survey of the existing
premises, and construction diagram.
The subject premises is located along the north side of
Soundview Avenue in the Hamlet of Southold, Town of Southold,
just east of its intersection with Mt. Beulah Avenue.

A review has, been made of you~ proposal to~.'
Based on the information you have submitted, the New York State Department
of Environmental Conservation has determined that the
parcel
~ project is:
Greater than 300' from inventoried tidal wetlands.
Landward of a substantial man-made structure
greater than 100' in length which was constructed prior to 9/20/77.
Landward of the 10' above mean sea level elevation contour on a
gradual, natural slope.
~Landward of the topographic crest of a bluff, cliff or dune which is
greater than 10' in elevation above mean sea level.
Therefore, no permit is required under the Tidal Wetlands Act (Article 25
of the Environmental Conservation Law). Please be advised, however, that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10' contour or topographic crest without a permit. It is
your responsibility to ensure that all necessary precautions are taken to
prevent any sedimentation or other alteration or disturbance to the
ground surface or vegetation in this area as a result of your project.
Such precautions may include providing adequate work area between the
10' contour or topographic crest and the project (i.e. a 15' to 20' wide
construction area) or erection of a temporary fence, barrier, or hay
bale berm.
Please note that any additional work, or modification to the project as
described, may require authorization by this Department. Please contact
this office if such are contemplated.
Please be further advised that this letter does not relieve you of the
responsibility of obtaining any necessary permits or approvals from other
agencies.

Dear Mr. Goehringer:
We have completed a site review of Application No. 3794 Jerry Georges
(Variances), at your request.
The bluff face appears to be in a stable condition. It is heavily vegetated
as are the adjoining lots. The bulkheading is relatively new and ties in to
the east side bulkhead. However, on the west side there is no bulkhead and
Mr. George's bulkhead has a 90° return in towards the bluff. A section of
the bulkhead is failing. On the bluff face there is a variety of plantings,
including beachgrass, vines, shrubs and Japanest Black Pines. Above the bluff
top edge there is an existing sod lawn from the house and patio to the edge of
the bluff. The distance from the house to the bluff edge is between 28' to 30'.
Down spouts from the house gutters on the east side exit onto the ground sur-
face, on the west they exit into dry wells.
Repairs to the failing bulkhead should be executed as soon as possible.
There is some evidence of sloughing just above this point of the bulkhead.
Trees on the face of the bluff could cause severe sloughing if they become
undermined. At the bluff top debris such as grass clippings is being deposited
on the bluff face. This will smother existing vegetation and can also cause
sloughing due to the added weight. Roof runoff water should be diverted into
drywells to eliminate the chance of runoff onto the bluff face. A low berm
along the top of the bluff edge will also help keep runoff from flowing onto
the bluff face.

into an additional room for the house. This garage was used for
purposes he says he is having trouble with now. He could have
extended it. We would not have complained about it. I don~t
think having this garbage truck.parked in the street is~he best

RESOLVED that the Southold Town Board of Appeals postpone

The Chairman opened the hearing by reading the application
for a variance, legal notice of hearing, affidavits attesting to
its publication in the official newspapers, and notice to the
applicant.
~{E CHAIRMAN: The application is accompanied by a survey
by Van Tuyl indicating that there is approximately 206 feet on
Soundview Avenue, approximately 203 feet on Long Island Sound,
and the depth of the property is 270 feet on the easterly side
and 290 feet on the westerly side. The property runs from
Soundview Avenue to the Sound.

STEPHEN F. GRIFFING, JR., ESQ., Riverhead: I believe the
proposed division is 103 feet on the front and 98 feet on the
Sound. I can give you a little history. Mrs. Alexiadhes, in

October 1963, purchased the plot and dwelling. At that time the
mortgage was with Suffolk County National. It was increased in
1964-65. Then, in 1967, the Alexiadhes family, through incorpora-
tion, had the opportunity to acquire adjoining property to the
east. ~ne parcel to the east was owned by T. B. Pettit but there
was a piece owned by W. A. Salmon on the other side of their
original piece. I can show you the sketch. (This is the
original Goodman piece. To the west there was a small strip -
6 feet down to nothing; and to the east another piece 5 feet
down to nothing).
In 1967 my client acquired both small pieces. It was for
protection. I would normally have advised my client to buy it
separately except for the fact that they were tied in with
mortgages and took out another mortgage to buy the Pettit piece.
Naturally, the title had to go along with incorporation to the
Goodman piece. The corporation dissolved and all the properties
went to my client. I would like to submit to you a Van Tuyl
map showing No. l, the Goodman piece; No. 2 the Pettit piece.
It won't change the character of the neighborhood.
I would further like to qualify myself as a real estate
expert, having practiced for 27 years mainly in real estate tracts,
mainly in Riverhead Savings. If you include the Pettit piece
with the Goodman piece, it might add $15,000 to the sale.
THE CHAIRMAN: We have to consider that everyone has a
financial hardship.
MR. GHIFFING: My main point is that the neighborhood won't
be affected.

THE CHAIRMAN: Our Counsel indicates that even thought:
according to the Zoning Ordinance, 40,000 sq. ft. is the minimum
plot size required, there are many situations where it is not
applicable.
After investigation and inspection tho Board finds that
applicant requests permission to divide property with less than
required area and frontage on the north side of Soundview Avenue,
Seuthold~ New York. The Board finds that many of the lots
Soundview Avenue are 100~ or less~ and agrees with the reasoning
of the applicant.

The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship; the
hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district~ and the variance will not change the
character of the neighborhood, and will observe the spirit of the
Ordinance.

New York, be GRANTED permission to divide property with less than

tion. I have some sk~/~ches here. ~ think this i~ an application
that mee~s all the r~quisites that a~ essenti&l ~n the granting
of a varmance appl~ation. It meets ~.rdsh~p, unmquene?s,.and
character change%~f area. We are deal~h~ with a pre-exmst~ng
dwelling. In f~t, all the buildings in ~De immediate vicinity
h~ve pr~ exiet/~.9 the Zoging Ordinance. Th~ area that we would
llke to set ~ide contamns a greater area th~kn used to be required,
which was lZ,500 sq: ft. We have 135 feet on~ne line end ll7
feet on th~ other lmne. We can't go back any f~rther ~ha~ ll7 feet
or we wilt be in the middle of the barns. The f~m buildings are
essential to Mr. 0rlowski. If we were to extend along the Main
Road~i% would not accomplish a great deal. We would end up with
less than 40,000 sq. ft.
