In the Matter of the Petition of: DECISION Ann D.Clements For a Variance to the New York State PETITION NO.2002-0978 Uniform Fire Prevention&Building Code Upon the application of Ann D.Clements,filed pursuant to 19 NYCRR 450 on August 20,2002 and upon all other papers in this matter,the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the alterations to an existing building of Al (one family)occupancy.,two stories in height,of type 5(wood frame)construction,approximately 2,000 square feet in maximum gross fire area,located at 360 Ruch Lane, Southold,Town of Southold, County of Suffolk,State of New York.The petitioner is seeking relief from: 9 NYCRR 711.1(a)(2),which requires ceiling heights in habitable space to be 7 feet 6 inches,and 9 NYCRR 711.2(b),which requires that bathrooms,toilet rooms,kitchenettes,corridors and recreation rooms shall have a minimum height of seven feet.[The petitioner wishes that a second floor dwelling unit having a minimum ceiling height of 7 feet 6 inches in the bedroom and 6 feet 0 inches in the bathroom,be permitted.] FINDINGS OF FACT 1. At the time of inspection by Department of State staff, the subject building contained a bedroom with a horizontal ceiling height of 7feet 8 inches in the center of the room for approximately 5 feet 0 inches sloping down to 7 feet 6 inches and terminating at the knee wall with a height of 6 feet 0 inches. 2. The uniform code does address sloping ceilings in habitable spaces,allowing as floor space,that area beneath sloping ceilings which is 5 feet 0 inches or more above the floor. It is reasonable to apply the height allowance for habitable space,where people remain for extended periods of time. Petition No.2002-0978 Page 2 3. The second floor also contains a bathroom with a horizontal ceiling height of 7'- 8"sloping to 6'-0"at the knee wall,with the placement of the fixtures,the ceiling height is adequate for normal usage. 4. Furthermore, in that the subject space is in a single family dwelling, used by - - -- i-ndividuals vho are accustomed-to-their surroundings - the--height-of-the-ceiling__ -_ in the bedroom or bathroom, would not have a substantial negative effect on their health or life safety. 5. Electrically wired smoke detecting alarm devices, if installed within the dwelling unit and connected to at least one similar device located on the main level of the building would, if properly maintained, provide ample warning to the occupants in advance of a smoke related emergency. 6. The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.1(a)(2)and 9 NYCRR 711.2(b),to permit a second floor dwelling unit having a minimum horizontal ceiling height of 7 feet 6 inches in the bedroom and a horizontal ceiling height 6 feet 0 inches in the bathroom;be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That electrically wired smoke detecting alarm devices shall be installed throughout the dwelling unit in conformity with 9 NYCRR 721.1 and shall be interconnected to at least one device located on the main level of the building 2. Based on the information you have submitted, we have determined that the project is located landward of the topographic crest of a bank which exceeds ten feet above mean sea level and is therefore outside the area regulated by this Department under the Tidal Wetlands Act and the Tidal Wetlands Land Use Regulations(6 NYCRR Part 661). Therefore, in accordance with Part 661,no permit is required under the Tidal Wetlands Act for the project depicted on the referenced plan. Please be advised,however,that no construction, sedimentation or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary (the crest of the bank)without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such precautions may include maintaining an adequate work area between the tidal wetland jurisdictional boundary and your project(i.e., a 15'to 20'wide construction area) or erecting a temporary fence,barrier or hay bale berm.
