An undesirable change will not be produced in the CHARACTER of the neighborhood for a detriment to nearby properties if granted The proposed Pool House is characteristic of accessory structures on other residential properties in the neighborhood in scale, design and setbacks to the street. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance. The permitted swimming pool is structurally attached to the principal structure, making it part of that structure. There is no allowable/conforming envelop for new structure in front of this pool, due to front yard zoning setback. Similarly, there is no allowable/conforming envelop behind the structure due to required 75 foot environmental setback from wetlands per NYSDEC and Southold Trustees. The proposed construction maintains the existing building setback. 3. The amount of relief requested is not substantial. The proposed Pool House is a small structure with a low height. It will not encroach on setback to the road, and with a 20 foot side yard setback from the property to the south, will not encroach on that residence. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district The proposed construction will retain all rain water on site via new drywell and comply with all best management practices for storm water run off during construction. 5. The alleged difficulty has not been self-created The new construction is the result of zoning setbacks which prevent the structure from being located in a conforming location. There are no Covenants or Restrictions concerning this land. The project has been approved by the Trustees, NYSDEC and SCDHS. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood, and the health, safety, and welfare of the community. The variance requested is the minimum relief practicable given the personal benefits anticipated by the applicant. The renovation is needed to maintain the investment and the proposed expansion is modest in scope and scale. The board made the following findings and determination: By this appeal, appellant seeks to construct a 36' by 30' accessory two-car garage structure approximately 160 feet north of the existing one-family dwelling and 35 feet from Wells Road. For the record it is noted that the N.Y.S. Department of Environmental Conservation has restricted the proposed construction to an area a minimum of 75' from tidal wetlands as shown in Permit #10-83-0014 TW issued March 24, 1983. Inasmuch as the land in question is partly meadowland, there is minimal practical building area, and the board does agree with reasoning of appellant. In considering this appeal, the board determines that the variance request is not substantial; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible to appellant other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests Of justice will be server by allowing the variance as indicated below. SCTM#1000-86-2-1.2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 2, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 24, 2015. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. The LWRP Coordinator issues an inconsistent finding regarding an accessory in-ground swimming pool which is,however,not before this Board. PROPERTY FACTS/DESCRIPTION: The parcel is a code conforming 109,159 square foot water front parcel located in an R-80 zone. The parcel is irregularly shaped with 693.02 feet of wetland frontage on Richmond Creek. The parcel runs 196.18 feet on the South side, 599.81 feet on Wells Road, and 128.07 feet on the North side. The parcel is improved with a residence, and existing garage, and an existing shed. The existing residence is located 57.5 feet off of Wells Road. All is shown on a site plan by Samuels and Steelman, Architects dated March 4, 2015. BASIS OF APPLICATION: Request for Variance from Article III Section 280-14 and the Building Inspector's March 3, 2015 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1) less than the code required minimum front yard setback of 60 feet. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to a structure with a front yard setback of 56.8' feet where 60 feet is required per code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 7, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and 6 Page 2 of 3—May 21,2015 ` ZBA#6854—Fischetti/Deaver SCTM#1000-86-2-1.2 surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. 'Town Law &267-b(3)(b)(D Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing residence has a non-conforming 57.5 foot front yard setback. Additions and alterations increasing the front yard setback by 10 inches will not change the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing structure has a non-conforming front yard setback. Further, the rear yard of the property borders Richmond Creek and tidal wetlands. Any expansion of the structure into the rear yard will move the structure closer to the tidal wetlands. 3. Town Law 4267-b(3)(b)(3).
