The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following is considered: 1. To further Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem; the Board acknowledges the 50' wide non-disturbance buffer established under Wetland Permit 4745 in any decision. 2. Require compliance with Chapter 236 Stormwater Management of the Southold Town Code. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town Law Section 267-b(3) (b) (1)No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The proposed pool in the side yard will not be visible from the street (Willis Creek Drive) and will conform to side yard setbacks for accessory structures. The proposed location has adequate sun and is located away from the Creek. The majority 'of the patio around the pool is "on grade" next to the house but due to the slight change of grade toward the property line, the grade of the patio will be maintain with a low landscape retaining wall (approximately at elevation 301) . 2. Town Law Section 267-b(3) (b) (2)The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant made an application for the accessory pool in the rear yard. However, a prior Trustee approval for the existing house had unrecorded condition of a non-disturbance buffer. The Calodners did not know of this buffer and the buffer created permanent shade to the proposed location of the pool in the rear yard. The Trustees recommended relocating the pool away from the rear yard even though a variance would be required to locate the proposed in-ground swimming pool in a side yard. 3. ' Town Law Section 267-b(3) (b) (3)The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The placement of the accessory pool ,and patio in the side yard provides adequate room for privacy screening and landscaping. In addition, there is sufficient room for the patio and pool. A low landscape retaining wall is proposed to provide a level grade for the patio. 4. Town Law Section 267-b(3) (b) (4)The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The proposed location of the pool is due to the environmental , conditions of the Trustee's permit. This proposed location is 100' to 124' from the edge of the Creek. 5. Town Law Section 267-b(3) (b) (5)The alleged difficulty was not self-created. The non-disturbance buffer was not recorded. The property owners were not aware of Trustee's restriction to the permit to construct the house. The condition was not filed as a Covenant running with the land. On June 27, 2002 the prior owner had obtained a Trustee's permit #5574 to build a pool in the rear yard, however, this permit expired. The non-disturbance buffer is shown as seaward of 8' elevation. 6. Town Law Section 267-b The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. The proposed variance for the pool, in a location, other than the front or rear yard, complies with dimensional setbacks. - We respectfully request that the appeal be granted,together with any further relief that is deemed necessary and reasonable.
