Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the,LWRP provided the following is considered: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: This property is part of the McCall family compound. Applicant's uncle, Robert McCall, owns the adjoining property on the South,which contains a cottage in its rear yard which, together with the existing garage on the subject property, blocks the view of the existing and proposed structures on applicant's lot. Therefore, applicant's structures will not be a detriment to Robert McCall's property. The applicant's property is wooded, which minimizes the impacts of the proposed construction. The two other nearby properties, owned by applicant's two brothers, are large lots (tax lot 4, 2.6 acres; and tax lot 3.1, 15.4 acres and restricted to one dwelling) where improvements can be constructed without being close to applicant's structures. The variance for the reduced front yard setback is along a private right of way servicing only one additional property,that of applicant's brother, who owns the flag on which the right of way is located as part of the 15.4 acre parcel (tax lot 3.1) and on which only one residence may be built. The structures are proposed to be built in an area of the lot where clearing has already occurred from construction of the pre-existing frame storage shed (which has been removed since the survey was completed) and the agricultural operations associated with the nearby McCall Ranch and Vineyards operation. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The placement of the residence and swimming pool is designed to maximize the distance of the residence and the swimming pool from the wetlands,to avoid the need to take down large trees north of the proposed house location, and to preserve the large rhododendrum grove on the south part of the property. The applicant feels that it is better from an environmental position to seek a front yard setback variance than to request a reduction of the Trustee's and DEC setbacks from the wetlands boundary. 3. The amount of relief requested is not substantial because: The setbacks of both structures is comparable to the setback of the existing garage and an existing storage building which has been used fairly intensively for farm use and will be removed. Since the 30 foot right of way will only be improved to a width of 15 feet for the use of only two residential properties,the visual impact of the setback from the road will be similar to that required by Code. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The topography is flat so no drainage issues will be created. The area where the variances are located is not visible from any public highway. This proposal maximizes the distance of the structures from the wetlands. The building area will be where ground disturbance and clearing has already occurred from prior usage. 5. Has the alleged difficulty been self created? { } Yes, or { X } No Why: The narrowness of the lot dictates a wetlands setback that requires a reduced front yard setback to better site a residence and swimming pool. Applicant's father,prior to 2 purchase of the property, obtained full approvals from the Suffolk County Dept. of Health, Southold Town Trustees and NYS Dept of Environmental Conservation for a residence and sanitary system which did not require variances because the wetlands setback at that time was 75 feet. Those approvals have expired, and the current 100 foot wetlands setback has resulted in the necessity of a variance.
