Pursuant to the provisions of 'Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on January 18.2017, and
in consideration of application fee in the sum of$250.00 paid by Robert Serling and subject to the Terms and
Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
" Wetland Permit to construct a two-story,single-family 2,276sq.ft(footprint) dwelling with
attached garage,600sq.ft.of covered and screened-in seaward side porches; 139sq.ft. covered
entry porch, 684sq.ft. seaward side on-grade terrace; 183sq.ft.on-grade terrace on side of
dwelling; renovate the existing 107sq.ft. shed, remove existing and install a new sanitary system
landward of dwelling; install gutters to leaders to drywells to contain roof runoff; install
drywell for proposed driveway;install underground electric and water lines; install and
perpetually maintain a 10'wide non-turf buffer along the landward edge of the bulkhead; and
a line of silt fencing is to be installed prior to and during construction; and as depicted.on the
site plan prepared by Samuels& Steelman Architects,dated December 13,2016,and stamped
approved on January 18,2017. a .,

TERMS ANY) CONDITIONS
The Permittee Robert Serling residingat_ 3575 Wells Road Peconic New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

1. Conformance With Plans All activities authorized by this permit must be in,,strict conformance
with the approved plans submitted by the applicant or applicant's agent As pa"rt of the permit application.
Such approved plans were prepared by Nancy L. Steeman, dated 12/13/16,stamped "NYSDEC
Approved"on 2/27/17.
2. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
3. Notice of Commencement At least 48 hours prior to commencement of the project,the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project,�the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
4. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State,nor shall washings from ready-mixed concrete
trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
5. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area(upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.

6. Storage of Equipment,Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 75 linear feet from the tidal
wetland boundary.
7. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be
stabilized with appropriate vegetation(grasses, etc.) immediately following project completion or prior
to permit expiration,whichever comes first. If the project site remains inactive for more than 48 hours
or planting is impractical due to the season-,-thei'&area shADbe-stabilized with straw or hay mulch or
jute matting until weather conditions-favor germination.
8. Clean Fill Only All fill shall consist of clean sand, gravel,or soil (not asphalt,slag,flyash, broken
concrete or demoliti6n debris).
9. Straw Sales or Other at Tidal Wetland A row of staked.straw bales or approvable-erosion control
devices shall be placed at the landward edge of the buffer area or 30 linear feet from the tidaf,. etland
boundary;.or as per the NYSDEC-approved plan,prior to commencement of any regulated activities and
remain in'place and in good,functional condition until the project is completed and all disturbed'areas
are stabilized with vegetation. Vt
10. Runoff Directed to Upland Drywells Roof runoff shall be directed to drywells a minimum of�50
linear feet landward of the tidal wetland boundary for immediate on-site recharge.
11, Driveway/Parking Area of•Pervious,Material Driveway,and-parking areas shall be,eonstructe,d
of NYSDEC-approved pervious materials.
12. Sanitary Systems above Groundwater -Sanitary system(bottom of tank and leaching pools) shall
be located a minimum of 2 feet above seasonal high groundwater.
13. Contain Exposed,Stockpiled Soils All disturbed areas where soil will be temporarily exposed or
stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt
curtains (or other NYSDEC approved devices)placed on the seaward side between the fill and the
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
14. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free
navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the
State, or cause loss or destruction of the natural resources of the State,the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without
expense to the State, and if, upon the expiration or revocation of this permit, the structure,fill,
excavation, or other modification of the watercourse hereby authorized shall not be completed,the
owners,shall, without expense to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable and flood capacity of the watercourse.
No claim shall be made against the State of New York on account of any such removal or alteration.

15. State May Require Site Restoration if upon the expiration or revocation of this permit, the
project hereby authorized has not been completed,the applicant shall,without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New fork on account of any such
removal or alteration.
16. Precautions Against Contamination-of Waters All necessary precautions shall be taken to
preclude contamination of any.wetland or waterway by suspended solids,sediments, fuels, solvents,
lubricants,epoxy coatings;paints,concrete, leachate or any other environmentally deleterious materials
associated with the project.
17. State Not Liable for Damage The State of New York shall in no case be liable for my damage or
faro'
injury to the structure or work herein authorized which may be caused by or result from future
operations undertaken by the State for the conservation or improvement of navigation, or for'other
purposes,,-.and no claim or right to compensation shall accrue from any such damage. tl
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility llispecfi`oyi•by Tfie De&rt�eut The permitted'site`or"facility, iincliidirig"rel'e`v`�nt-Yecords,
is subject to inspection at reasonable hours and intervals by an authorized representative of the;
Department of Environmental Conservation(the Department)to determine whether the permittee is
complying with this permit and the ECL. Such representative may order the work suspended pursuant
to ECL 71- 0301 and SADA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.

3. Applications For Permit Renewals,.Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal,modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal, modification or transfer are to be submitted to:

4. Submission of Renewal.Application The permittee must submit a renewal application at least 30'
,days before permit expiration for the following permit authorizations:Tidal Wetlands.
5. Permit Modifications,Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds-for modification, suspension or revocation include:
a...:materially false or inaccurate statements in the permit application or supporting papers;
11: failure by the permittee to comply with any terms or conditions of the permit;

d. newly discovered material information or a material change in environmental conditions,
relevant technology or applicable law or regulations since the issuance of.the existing permit;
e. noncompliance with previously issued permit conditions,orders of the commissioner,any

6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or

PART B: REASONS FOR APPEAL
1. An undesirable change will not be produced in the CHARACTER of the
neighborhood for a detriment to nearby properties if granted. The proposed
two story residence is characteristic of other residential properties• in the
neighborhood in scale, design and setbacks to the street and bulkhead.
2. The benefit sought by the applicant CANNOT be achieved by some method
feasible for the applicant to pursue, other than an area variance. The
proposed Single Family Residence is a replacement for an existing residence
that was totally destroyed by a fire in the Spring of 2016. An addition to the
existing residence was currently under construction when the house was hit by
lighting. The proposed residence is set back an additional 5'-7" from the existing
bulkhead than the original house. All other setback have been maintained. The
existing storage shed was damage and will be renovated with new siding, door
and windows.
3. The amount of relief requested is not substantial. The proposed Residence
is encroaching on the 75' setback by a total of 6'-1" or 6% of the required
setback. This is a minimum request for relief.
4. The variance will NOT have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. The Town of
Southold Board of Trustees has issued a Tidal Wetlands Permit for this project.
At the time of submittal to the Trustees, the project was reviewed by the Town of
Southold Building Department and the Trustees were told a variance was not
required. Due to an error in the filing for the change of code regarding the
setback requirement from Bulkhead, a variance is now being required. The
Southold Town Board of Trustees and the NY State Department of Environmental
Conservation did not see any adverse effects on the environment when they
issued their permits. See attached. The proposed construction will retain all rain
water on site via new drywells and comply with all best management practices for
storm water run off during construction. A new Sanitary System, approved by the
Suffolk County Department of Health Service will be installed and will meet all
requirement.
5. The alleged difficulty has not been self-created. The new construction is the
result of a pre-existing situation where the existing house was located within the
setback prior to current zoning restrictions
There are no Covenants or Restrictions concerning this land.
This is the MINIMUM that is necessary and adequate, and at the same time preserve
and protect the character of the neighborhood, and the health, safety, and welfare of the
community. The variance requested is the minimum relief practicable given the
personal benefits anticipated by the applicant. The renovation is needed to maintain the
investment and the proposed residence is modest in scope and scale.

This is a rehearing of the appeal of Rose Dansker for an area
variance. The history of the case is as follows: By application
dated December 3, 1980 Appellant applied to this Board for an area
variance. By decision of this Board approved on April 28, 1981,
the appeal was denied for the reasons stated in the Board' s decision.
By letter application dated May 6 , 1981, Appellant' s attorney
applied to this Board for a rehearing of this matter. By resolution
of this Board adopted on May 22 , 1981, such rehearing was unanimously
approved. A rehearing was held on July 9, 1981 pursuant to due
notice thereof.
This Board' s denial of the original appeal was predicated
primarily upon the Suffolk County Department of Health Services'
position that the westerly parcel (Lot No. 11) "may not meet . . .
minimum standards for new construction of a septic system and water
supply. "
Upon rehearing of this appeal, Appellant presented evidence
showing a substantial loss in value of the premises if the variance
is not granted. However, the question of whether or not the Suffolk
County Department of Health Services will approve of the water supply
and septic system on the vacant lot (Lot No. 11) appears to be
unresolved at the present time. In its letter to Appellant' s attor-
ney dated September 23, 1981, it stated: "As already indicated,
the vacant parcel will have problems meeting our requirements for
sewage and water supply. The problems will have to be resolved
prior to approval to construct. " Since this Board' s original denial
was primarily based upon the possibility that the vacant lot may not
meet Suffolk County Health Services ' requirements, and since such
approval has not as yet been granted, this Board is of the opinion
that although the Appellant has presented "dollars and cents" evi-
dence to demonstrate practical difficulties, Appellant has not
produced evidence that the requirements of the Health Services
can be complied with.
Lot No. 11 has an area of approximately 15,750 square feet with
approximately 90 feet road frontage; Lot No. 10 has a preexisting
one-family dwelling, an area of approximately 12,500 square feet and
approximately 80 t:eet of road frontage. The lots to the east of the
subject premises are of similar size and shape.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it
was
RESOLVED, that the matter of Rose Dansker, Appeal No. 2766,
for approval of insufficient area and width of two parcels, be
granted, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the Appellant obtain approval by the Suffolk County
Health Services Department of a sewage and water supply system
for vacant lot No. 11 prior to any new construction on vacant lot
No. 11;
2. That the owner of Lot #10 guarantee rights for a water
easement to be located not closer than five feet to the northerly
property line on the house lot (Lot #10) for use by the owner of
the vacant lot (Lot #11) , and that a copy of same be supplied to
our office as early as possible;
3. That the Appellant obtain approval by the Southold Town
Planning Board for this subdivision pursuant to its letter dated
January 2, 1981;
4. That this matter be referred to the Suffolk County
Planning Commission pursuant to Sections 1323, et seq. of the
Suffolk County Charter.

The Board finds and determines as follows:
This is an Appeal for a variance pursuant to Article III, Section
100-31 for approval of insufficient area and width of two proposed
parcels located at Wells Road, Peconic , New York. Lot 10 designated
as such on the Suffolk County Tax Map has erected thereon an one-family
private dwelling. Lot 11 is vacant. The property was acquired by
Appellant' s husband at two different times. The house was acquired in
1957 and the vacant lot adjacent thereto in 1963. Title to both lots
was taken in the name of Appellant's deceased husband, William Dansker.
Lot 10 has an area of 16 ,000 square feet, and Lot 11 has an area of
17,500 square feet. Appellant' s husband died in 1980 and under his
will devised Lot 10 to his surviving spouse, Rose Dansker. The vacant
Lot 11 was devised to the children of a former marriage. In 1971 the
Zoning Code was amended to require a minimum size lot of 40 ,000 square
feet. Accordingly, both lots were merged into one lot. At the hearing
considerable testimony was given by property owners in the vicinity of
the premises in question concerning the severe water problem. There is
evidence of salt water intrusion as well as insufficient- water supply
during periods of draught. The Suffolk County Department of Health
Services has advised this Board that Lot 11 may not meet the minimum
standards for new construction of a septic system and a water supply
system, .and that the ground water quality in the area is marginal.
In view of the foregoing, it is the opinion of this Board that to
permit -Lots 10 and 11 to be divided would lead to the intensification
of the water problem which presently exists in the area. No evidence
has been given to this Board of any attempt by the Appellant to either
acquire title to Lot 11 or to attempt to have both lots sold to a
single owner. It is the further opinion of this Board that the Appel-
lant has not shown practical difficulties,' and accordingly, on motion
by Mr. Sawicki_, seconded by Mr. Douglass, the appeal is denied.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is, intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list,policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its sig ' scant
beneficial and;adverse effects upon the coastal area(which includes all of Southold ToM11).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
