The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP with the LWRP provided the following is considered: 1. Establish a vegetated buffer landward of the top of bluff which incorporates the existing vegetation. 2. Verify that no stormwater runoff will be directed towards the bluff from structures. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. EXISTING BRICK PATIO: Remove 223 SF of brick patio and replace with lawn EXISTING DECK OFF HOUSE WITH AS-BUILT ADDITION & PROPOSED ADDITIONS A major portion of the-deck off the main house was approved with the construction of the house in 1982. (see attached site plan Al and 3). The approved deck extended 19.8ft. from the house toward the bluff and is 746.4 SF.. Sometime afterward, but before the present owner purchased in 2013, the deck was extended toward the bluff by 5.2 ft., adding an additional 215.6 SF for a present total deck of 962'SF.+/-. We propose to add a 25SF deck expansion to square a corner and a 68 SF deck expansion on the southern side, with a relocated staircase, to permit a.wider walkway for ease of ingress/ egress and added planting. In addition, the decking would be replaced on the main deck and the adjacent lower and upper decks north of the main deck.(143SF ea.) and replace the access steps for both the main deck and adjacent deck with added planting. The owner would request that the extension be allowed to remain and the proposed additions, repairs and modifications be approved accordingly. EXISTING AS-BUILT LOWER DECKS/ BOARDWALKS/STORAGE BINS Between the bulkhead and retaining wall presently exists a series of two boardwalks ( 183 SF and 67 SF for a total of 250 SF ) connecting two decks ( 119 SF, after new staircase built, and 119SF with bench and concrete table on the southern line. The decks and boardwalks are even with the top of the wood cap for the bulkhead and averages approx. 2" above existing grade. In addition, there are 3 small storage bins 15" x 4.5 Ft each (5.62 SF ea.), plus a 19SF bin on the northern line. There are lighting fixtures (5) installed in the retaining wall as well as a hose bib.The owner would request that the as-builts between the retaining wall and bulkhead be allowed to remain. PROPOSED MASONRY PAD The proposed pad would accommodate the placement of refuse containers and be ground level. PROPOSED GRADE LEVEL STEPPING STONE PATH The existing stepping stone path would be reconfigured to accommodate the proposed southern deck expansion with the new planting area and continue along the waterside of the deck along the new planting area to the proposed new platform. ADDITIONAL INFORMATION: This application only addresses the as-built deck addition that is attached to the rear of the dwelling and landward of the top-of-bluff,ZBA jurisdiction. The area between,the existing top-of-bluff and existing bulkhead at the bottom of the slope (bluff face) has multiple retaining walls, decking, landings and stairs of which some are being removed and/or repaired or rebuilt. This area is under the jurisdiction of the Town Trustees. The Board of Appeals requested and received comments on the subject application from the Board of Town Trustees in a Memorandum dated March 9, 2016, which included the proposed removal of an existing dilapidated "boathouse/gazebo" which the applicant intends to do. The Board also required that the applicant contact Jay Tanski, Senior Coastal Processes and Facilities Specialist, at Sea Grant to determine the impact of removal of retaining walls and other structures on bluff stability. A letter from Tanski, dated April 22, 2016, was received at the public,hearing on May 5,2016. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 3,2016 and May 5,2016, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Rear yard attached decks are characteristic of residential properties in this neighborhood and the subject as-built deck cannot be seen from the street. 2. Town Law X267-b(3)(b)(2).The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue,other than an area variance.The applicant could have constructed a patio at grade in lieu of the raised as-built deck. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for a top-of-bluff setback is mathematically substantial, representing 80% relief from the code. However, is has been professionally determined by a Senior Coastal Processes and Facilities Specialist that "The blur face was steep but well-vegetated, indicating it was relatively stable".Therefore, since the deck is as-built from at least 2001 (from viewing Suffolk County GIS data), it shows that its existence, over time, has not been detrimental to the stability of this bluff, which mitigates the substantiality. The variance granted herein for a side yard setback is mathematically substantial,representing 13%relief from the code. However, the applicant's representative stated that there is an error in the submitted survey showing the subject existing side yard setback.Upon site inspection, it was discovered that the as-built deck addition is aligned with the dwelling in the side yard. The as-built deck addition is in alignment with the dwelling and has the same existing side yard setback as that of the dwelling, of 14 feet,which represents a 7% relief from the code,which is not substantial. We propose to add a 2519F deck expansion to squ�Uire a corner and a 68 SF deck expansion on the southern side, with a relocated staircase, to permit a wider walkway for ease of ingress/ egress and adcled planting.
