Although deemed to require front yard setback relief, the raised deck addition is actually proposed in the effective side yard of the property on the north side of the dwelling, greater than the code- required 40 feet from North Sea Drive to the west and greater than what would otherwise be the required 15' minimum side yard setback from the northerly property line. But due to the presence of an unopened "paper" dogleg turn in Horton's Lane that adjoins little more than half of the northerly property line, it has been determined that the northerly lot line creates a second front yard for the property, thus necessitating 23 feet of relief for the deck's proposed 17' setback. However, the granting of this relief would do nothing to create an undesirable change in the character of the neighborhood, as the adjoining unopened north-south dogleg of Horton's Lane, which is oriented perpendicular to Long Island Sound, is unimproved and heavily vegetated and therefore does not provide a thruway for vehicular or pedestrian traffic or possess any other visual or functional characteristics of a front yard. Rather, the west-east legs of Horton's Lane (farther to the north) and North Sea Drive to the south act as the functioning front yards for the subject and neighboring properties along this stretch of roadway. Therefore, the deck would for all practical and functional purposes appear to be located in the side yard. The only other corner property located on North Sea Drive, which is similarly constrained by a second front yard created by Kenny's Road, was granted similar front yard setback relief in 1984 (Case No. 3204) when a variance was granted for the construction of an addition with a 16' setback from Kenny's Road. Granting of the requested variance would also cause no detriment to the neighboring property to the north because the unopened leg of Horton's Lane that separates the two properties is in fact heavily vegetated and indistinguishable from the heavily vegetated and unimproved property to the north, which was purchased for preservation by the Town of Southold in May 2017. Thus, unless the land purchased for preservation were to be cleared along its southerly boundary, the entire dwelling and proposed deck should remain obscured from the viewshed of that property. And even in the unlikely event that the property were cleared and the small section of road improved, the side of the house and proposed deck would not directly face the side of the preserve land due to the location and configuration of the roadway relative to the location of the dwelling. The benefit sought by the applicant, which is to gain additional deck area for recreational use and to cover part of the deck for shade and use during foul weather, cannot be achieved without the benefit of area variance. Specifically, due to the presence of the freshwater wetlands associated with Lily Pond in the easterly portion of the property and the adjacent naturally vegetated non- disturbance buffers imposed by the Board of Trustees and New York State Department of Environmental Conservation, there is not enough room to expand the deck on the rear side of the house. Thus, due to the location of the driveway on the south side of the house, the north side of the house is the only practicable location for the deck expansion. And though the proposed deck would otherwise meet the required minimum 15' side yard setback for the principal dwelling structure, the presence of the unopened dogleg of Horton's Lane that adjoins the northerly property line creates a"second front yard,"thus making the requested setback relief unavoidable. 3. The approximately 58% setback relief required for the deck's proposed 17' setback from the northerly property line is mathematically substantial but it is not substantial relative to the actual site conditions, as described above. Specifically, because 1) the west-east legs of North Sea Drive to the south and Horton's Lane to the north act as the functioning front yards for the subject and neighboring properties along this stretch of roadway; and 2) the dogleg of Horton's Lane that creates the second front yard setback requirement is actually unopened and heavily vegetated, the deck would for all practical and functional purposes appear to be located in a conforming side yard location. The requested relief is also nearly identical to that granted in 1984 to the only other corner property located along North Sea Drive. 4. In order to maintain and protect the integrity and function of the existing wetland and naturally occurring wetland buffer vegetation on the property, the proposed deck addition is to be located beyond the limit of the existing 65' wide, NYSDEC-required, naturally vegetated wetlands non- disturbance buffer situated adjacent to the freshwater wetlands associated with Lily Pond to the east. Thus, where proposed, the deck addition will require no clearing or disturbance of existing natural vegetation and will be located farther from wetlands (73') than the existing deck (71'), so there will be no additional encroachment on the existing wetlands setback. Although the deck expansion would add only 460 sf of lot coverage to the property, which would remain just over half the code-permitted 20 percent at 12.7 percent, a drywell is proposed to capture and recharge potential runoff associated with the proposed 375 sf roofed over portion of deck. And a temporary project limiting siltation fence will be installed along the landward limit of the non-disturbance buffer to ensure that the naturally existing buffer and wetland areas are in no way disturbed during construction. Therefore, the project will not have any adverse effects on the surrounding physical and environmental conditions or surrounding natural resources and ecosystems. rA� Z11- Ro ert E. It is arguable that the difficulty is self-created based on the idea that the owners are presumed to have had constructive knowledge of the property constraints at the time they purchased the property. However, because the section of roadway creating the need for front yard setback relief was not and is not open or improved, the owners did not in fact have actual knowledge that a "road" affecting their building area existed on the north side of their house until the Building Permit application for the proposed deck addition was disapproved.
