MARTIN BANCROFT #7194—Request for Variances from Article XXIII, Section 280-124 and the
Building Inspector's April 23, 2018, Amended May 9, 2018 Notice of Disapproval based on an
application for a building permit to construct an accessory swimming pool and an accessory garage on a
residential parcel; at; 1) accessory in-ground swimming pool located in other than the code required rear
yard; 2)proposed accessory garage located less than the code required minimum front yard setback of
40 feet; at: 38099 Main Road(Adj. to the Long Island Sound), Orient,NY. SCTM#1000-15-2-16.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me,the proposed action is EXEMPT from LWRP review
pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item"F"which states:
F. Granting of individual setback lot line and lot area variances, except in relation to a
regulated natural feature or a bulkhead or other shoreline defense structure or any activity
within the CEHA.
Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).

achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a

Property Location: 38099 Main Road, Orient; Parcel 1000-15-2-16.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type ll category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 29,546 sq. ft. parcel is 304.39 feet deep with
101.58 ft. frontage along the Long Island Sound. The property is improved with a one-stoy frame
dwelling situated 60 feet from the front line along a 15-ft. imide right-of-way (at the southeast corner
of the property).
BASIS OF APPLICATION: Building Department's December 22, 2003 Notice of Disapproval, citing
Code Section 100-33 in its denial of,a building permit application concerning a proposed lap pool in
the westerly yard, an area determined by the building inspector as'a side yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a,public hearing on this application on March 18, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, "and tither evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct an 8' x 36' accessory lap
pool adjacent to the house, nine (9) feet from the west property line at approximately 140 feet from
the top of the bank,adjacent to,,the Long Island Sound.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections; the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in character of neighborhood
or a detriment to nearby properties. The proposed new 8 ft. by 38 ft. lap pool will be located on the
west side of the existing dwelling. The south end of the pool will be approximately 31 feet from the
southerly(front) property line and approximately nine (9)feet from the westerly (side) yard.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to
pursue, other than an area variance. If the applicant were to locate the lap pool in the rear yard

facing the north shore line of the Long Island Sound, the integrity of the already unstable bluff could
be affected. This property also has a very small front yard,which could not accommodate this pool.
3. The relief requested is the minimum relief that the board will allow.
4. The difficulty was self-created. The code limits the location for a rear yard; this restriction was in
place at the time applicant acquired the property and planned a location for a pool.
5. No evidence was submitted to suggest that this variance would have an adverse impact on the
physical or environmental condition in the neighborhood.* The lap pool will be greater than 100 feet
from the top of the Sound bluff.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by
Member Goehringer, and duly carried, to
GRANT the variance as applied for, as shown on the survey prepared by John T. Metzger,
L.S. dated February 17, 1999, amended to show a pool location January 14, 2004, and
observing the recommendations of the March 12, 2004 letter from the Suffolk.County Soil
and Water Conservation District (with respect to removing the lip of the bluff and re-graded
the bluff edge so that it gently slopes back towards the yard, away from the,bluff edge, and
properly vegetated to stabilize the soil and prevent erosion.)*
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly
addressed in this action.
