An undesirable change will not be produced irr the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because the proposed Garage is in keeping with the character of the neighborhood and the existing architectural character of the house both in scale and design.The proposed one story Garage will replace an existing garage built in the 1980s. The new Garage will be 106 sf larger than the existing garage and will have a gable roof sturcture similar to other structures in the area. The existing garage has a flat roof and is not compactable with the surrounding properties. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than the area variance, because the size and configuration of the site will not allow for any alternative location for the Garage other than the side yard. The existing House is located on the far east side of the property at the minimum side yard setback and extends 42'-11 from the existing bulkhead to within 40'-3" of the front property line. The waterfront setback is 75' from the bulkhead and the Frontyard setback is 35'. Locating the proposed Garage in either the rear yard (waterfront) or frontyard would require an area variance. 3. The amount of relief requested is not substantial because the proposed Garage is replacing an existing garage and increases the garage area by 106 square feet. 4. The variance will NOT have an advers 'effect or impact on the physical or environmental conditions in the neighbgrhood or district because the proposed Garage is 94'-6" from the bulkhead, all roof a d driveway run off will be retained on site via new drywells and will not involve any landdisturbance near the seaward side of the residence. 5. The alleged difficulty has not been self created because it has been caused by the location of the existing house on the site. The parcel then runs 168.79 feet on the West side, 100.00 feet along Watersedge Way, and 179.59 feet along the East side. The property is improved with a two story frame house, an accessory garage,and a hot tub. The survey also shows a wood deck seaward of the bulkhead. The existing 2 story frame house is located 42 feet, 11 inches from the wood bulkhead. All is shown on a survey by John T.Metzger L.L.S. dated July 8, 1998. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116B and the Building Inspector's June 9, 2015, amended June 19, 2015 Notice of Disapproval based on an application for building permit for additions and alterations to existing single family dwelling, at; 1) less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations at a bulkhead setback at 71.7 feet where code requires a bulkhead setback of 75 feet. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties._ The neighborhood consists_of single family water front homes. The proposed addition and alterations are proposed on the side of the dwelling and are 71.7' from the bulkhead.The addition will serve as a laundry room and pantry, is only 80 sq.ft.and will fill in a"U"shaped space that will square off the east side of the dwelling within the conforming side yard setback. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing 4welling has a non-conforming bulkhead setback of 42. 11 ft. The proposed addition is within the side yard setback and, although it will be located farther from the bulkhead by approximately a third of the entire dwelling, it is encroaching into the bulkhead setback by 3.5' and will therefore require a variance. 3. Town Law &267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 6% relief from the code. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the.neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.
