1. STRICT APPLICATION OF THE ORDINANCE would pr~ucepmcticaldifficulti~ orunn~es~
sa~ HARDSHIP b~ou~ without the close picket-type stockade fence of
the proper height, traffic, noise is a continuing problem, interfering
with the sleep of appellant and his family. This is especially prevalent
i~ the summer months when the population in the Kenney's Beach area
increases manyfold aod windows a~e opened for ventilation purposes.
~Iso~ because the speed limit on this portion of Kenney's Road is
stil~ 50 ~iles per hour, cars and trucks travel at high rates of
speed day and night o~ a supposedly residential street, contributing
Further to the nois~ problem.
A stockade fence of six foot height effectively blocks out
much of the traffic noise as shown in Fig. C. The appellant aod
his family coo testi~y to this fae~ aFte~ experiencing a w~ek of
m~ch diminished t~affic nois~ since erection of the fence.
2. The hard~iocreatedis UNIqUEandisnotsha~d by all propedies alike in the immediate
vicinity ofthispr~e~¥ andin ~ use district bemuse the anQsual topography of the
appe~lant's propertY and adjacent Kelley's ~oad actually Funnels
traffic no. tee into the living ~ua~te~s of his house (fig. B), O~ig-
inally this was not so great a problem because the grade level of
the road was m~ch lower and a substantial shoulde~ prevented much
traffic noise from enteriog onto his property'(TilL A). SUch is not
the case since the Town Highway Department raised the grade level of the
road io fro~t of the appellant's property.
Neighborisg properties do not get the funneling effect because
the road level was maintained at~the existing height in their res-
~ective a~eas,
3. The Variance would obse~e the spirit ofthe O~inance end WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT becau~ the character of the Ke~newood area is
a wooded residential a~ea, and the appellant's house is of rustic
=ype redwood architecture in keepiog with the topography. The
stockade fence is of the sa~e ~ustic decor and will be stained to
match the redwood gables of the house further in keeping with the
rustic characte~ of the area.
