After investigation and inspection the Board finds that
applicant requests permission to divide property with insufficient
frontage and area on property located on the north side of North
Bayview Road, ~outhold, New York. The findings of the Board are
that this application to divide the property will be favorable to
the area as it will reduce density. This property was divided
into five lots under the old Ordinance and it is proposed to
divide them to make three lots, as £ollows: Lot No. ~ and part
of Lot No. 3 will comprise a new lot with 13~ foot frontage on
North Bayview Road by 200t deep, sidelines being parallel; a
portion of Lot No. 3 and a portion of Lot No. 2 will comprise a
new lot with 13~t on North Bayview Road by 270~ in depth, side-
lines being parallel. All of the remaining property comprising of
128.3 feet on North Bayview Road with a depth of 538.89 feet,
and ~.02 feet on the easterly line, shall comprise a new lot.
The property does not lend itself to exact division. The Board
agrees with the reasoning of the applicant.
The Board finds that strict application of the 0rdinauce
would produce practical difficulties or unnecessary hardsh~p;.the
hardship created is unique and would not be shared by all properties
alike in the immediate vicinity of this property and in the same
use district; and the variance will not change the character of
the neighborhood and will observe the spirit of the Ordinance.

lots which Will have frontage and area requiremnnts on some l~ut Will be
short on one.

1. STRICT APPLICATION OF THE ORDINANCE would produce pmcticaldifficulti~ orunneces-
sam HARDSHIPbecau~: This unusual shaped peice of property does not
led itself to to a division that will meet the new ordinance requirements.
~Je are changing from our old plan of five lots to a three lot
plan which most nearly meets the present zoning requirements of 135 ft
width and 40,000 square feet of area.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property end in this use district because J the prop~erty is an T, shaped
parcel and there is no possibility of enlarging it or making a better
division.
3. The Variance would obsewe the spirit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT becau~: The property is located in the "A" residenti~
- agricultural distr~ct~ and near developments with 12~500 to 20~ 000
square foot lots.
It is proposed to sell the lots for one family dwellings~ so
there will be no change or harm to the area or neighborhood.
