REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary t~ARDSHIP because the whole parcel is naturally dividable in two parcels, one
a shore front piece and one a l~_ke front piece. The private road dividing the
one large parcel is fixed in loca~on by use of other property to west so no other
division can b~made.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because most other parcels are smaller
than each parcel that would result from requested division. Also, the priwate
~oad east toBay Avenue has been actually uSed for egress and ingress for up-
wards of forty years and to east c~ premises is actually improved on the north
thereof facing the lake and on the south thereof facing~the Bay. , ~
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the resultin~ parcels would be as large or
larger than the other properties in the vicinity and thesccess is presently used
by petitioners and others and has been for many years prior to the passage of
Zoning Ordinances in the Town of Southold.
