SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 19, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is located in an R-40 Zoning District along Willow Point Road with frontage on an underwater canal (Budd's Pond), Southold. The property measures 18, 217.38 sq. ft. as shown on survey prepared by Lisa McQuilkin, Land Surveyor, dated May 24, 2017. The property starts out at its southwest corner on Willow Point Road and runs. 148.92 feet to the east where it turns north 127.44 ft. to the Canal, then turns west 110.04 ft. before finally returning south 148.73 ft. to Willow Point Road. The property is improved with a one-story frame house with an attached garage, sunroom, and wood deck areas, an existing accessory in-ground swimming pool in the rear yard and floating docks with metal landings and ramps. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's September 4, 2018, Notice of Disapproval based on an application for a building permit to reconstruct an accessory in-ground swimming pool; at; 1)more than the code permitted maximum lot coverage of 20%; at: 325 Willow Point Road, (Adj. Budd's Pond/Canal), Southold,NY. SCTM#1000-56-5-26. RELIEF REQUESTED: The applicant requests a Variance to reconstruct an accessory in-ground swimming pool in the rear yard at 22.309% lot coverage which exceeds the code permitted maximum lot coverage of 20%. Page 2,January 17,2019 #7235,Donadic SCTM No. 1000-56-5-26 ADDITIONAL INFORMATION: As per testimony and material provided by the applicant's agent, and the applicant, this parcel was granted a variance for lot coverage relief not to exceed 23.6% in Appeal # 4602 dated October 8, 1998. The current proposal is for an in-kind replacement of the pool due to a failing liner. Additionally a neighbor testified in support of this application. The current proposal shows a lot coverage of only 22.309 %, which is less than the last variance granted in 1998. On March 6, 2018, a de minimus request was denied in a letter by the ZBA Chairperson for the reconstruction of a swimming pool in-kind, pursuant to the Building Department's assessment that once a structure is demolished, the certificate of occupancy and any prior variance relief is extinguished, and therefore an area variance for lot coverage relief is required in order to rebuild. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The pool and deck are existing, and this proposal is for an in-kind replacement. Therefore,there will be no change in the character of the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing pool and deck on the property already exist with previous lot coverage relief. When the existing pool was demolished through a major storm event, the previous relief granted was extinguished. Therefore, the applicant now requires new relief to proceed with the proposed in-kind pool replacement. 3. Town Law &267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 11.5% relief from the code. However, the previous variances granted the applicant 18% relief from the code, thereby, making the current proposal less substantial than previous approvals. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant has also received variance relief for this property in the past. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a accessory in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried,to GRANT the variance as applied for, and shown on the drawings provided by Joseph Fischetti, P.E., dated August 22, 2018; and the survey prepared by Lisa McQuilkin,Land Surveyor, dated May 24, 2017. Drywell for pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one(1)year terms. At the hearing,the applicant's agent submitted an aerial showing the two story dwellings in the neighborhood. Additionally, four letters of support were submitted from neighbors. FINDINGS-OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3,2013,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. The proposed work is as follows: 1. replace existing swimming pool (built in 1977 with CO) in kind and in place, and connect backwash to existing drywell (to code); 2. replace existing 51'6" wood double retaining wall landward of the existing bulkhead(B) in place, raise by 8" for storm protection to "existing grade" and replace 2 wood walls with one concrete wall. 3. replace existing stone patio on grade with 1,346 sq.ft. of bluestone patio set in sand/stone dust also "on grade"; all as shown on Site Plan prepared by Donadic dated January 26, 2018 My client is replacing the structures with less than the lot coverage approved by your Board in appeal #4602 dated 9/24/98 and confirmed in appeal #6689 dated 10/17/13. (approved for 23.6% and proposed is 22.309%) For your convenience I am enclosing_ the variance and Trustees permit history of the property: The subject property was granted variances in 1998 and 2013. Variance #4602 dated 9/24/98: The lot coverage of existing structures (house with decks, attached garage, sunroom, wood decks around the pool, in-ground swimming i pool and existing gazebo) exceeded 20% lot coverage. The Board granted lot coverage of 23.6% (or 4,289 square feet); Zoning Board of Appeals Re: Donadic February 16, 2018 Page 2 Thereafter the Trustees approved (6/18/08 permit#6917) replacing the wood decking around pool with pavers, wood deck, wood walkway, drywells and wood retaining wall with bluestone pavers and 8" concrete retaining wall to pool deck level (bluestone pavers to be pervious). These pavers and concrete retaining walls remain today. Variance #6689 dated 10/17/13 was for a variance for setback to the bulkhead for additions and alterations to the house and proposed lot coverage. The Board found that "the request for a variance for lot coverage of 22.969%, as requested, is not necessary' The concrete retaining wall and pavers were replaced in 2008 (see Trustees permit). The variance for setbacks from the bulkhead is no longer applicable and this project will not exceed the previously approved lot coverage of appeal #4602. The existing wood retaining wall is maintaining the existing grade between the rear yard and the adjacent bulkhead. The grade of the property is even along the house and pool. The current application to the Trustees is to replace and raise the existing retaining walls by 8" which will provide additional protection from storm tides. The retaining wall which is landward of the bulkhead (Section B) will match the finished grade of the Tibett property (neighbor). The grade landward of this retaining wall (Section B) will be raised by 52 cy (not more than 8"-12" depth). The finished grade in the back yard will match the back of the Donadic house and Tibett property on the west side. The pool and patio will remain "at grade". The bluestone patio will continue to be set in sand/stone dust and remain pervious. The existing non-turf buffer landward of the existing bulkhead is unchanged (area between section A and section B). The gazebo was removed. There is no increase in lot coverage. The existing retaining wall (B) is extended by 8"- 12", as needed, and the rear yard is re-graded within the area of the existing retaining walls shown since 1998 (as Trustees changed from wood to cement in 2008) and pool and patio will be level at grade. The pool is being replaced in kind and in place. The rear yard is re-graded within the Trustee's previously approved retaining walls. The Trustee's permit is required since the property will be re-graded. The existing structures have Trustee's permits (#6917) and should be a simple "administrative permit" to replace and raise by 8"the existing retaining walls and re- grade up to the house. Please review the above and if a "de-minimis" determination is applicable, please issue a de minimis determination.
