SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 18, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP also recommends the existing sanitary system be upgraded to an I/A on site wastewater treatment system due to its proximity to Pipes Cove which is a high value marine wetland. Based upon the conditions imposed herein, the ZBA finds the application to be CONSISTENT with LWRP policy standards and therefore CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 8,593 square foot waterfront parcel located in an R-40 Zoning District. The parcel runs 50 feet along Pipes Cove on the easterly boundary, runs 50 feet along the westerly property line fronting Brooks Road (Pipes Neck Road), runs 168.75 feet on the northerly property line, and 175 feet on the southerly property line. The parcel is improved with a two-story frame residence, a bulkhead, a wood platform, and a 6 ft. by 10 ft. frame shed. All is shown on a survey by Michael K Wicks, LLS last revised August 13, 2018. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's July 12,2018, Amended July 13, 2018, Notice of Disapproval based on an application for a building permit to make additions and alterations to an existing single family dwelling; at; 1) located less than the code required minimum side yard setback of 10 feet; 2) located less than the code required minimum combined side yard setback of 25 feet; 3) more than the code permitted maximum lot coverage of 20%; at: 590 Brooks Road, (Adj. to Pipes Neck Creek), Greenport,NY. SCTM#1000-53-1-15. Page 2,January 17,2019 #7234,McMahon-Hintze SCTM No. 1000-53-1-15 RELIEF REQUESTED: The applicant requests a variances to construct additions and alterations to an existing frame residence with a side yard setback of 6 feet, a combined side yard setback of 12.5 feet, and lot coverage of 22.4 %. Town Code requires lot coverage not to exceed 20%, a minimum side yard setback of 10 feet and a combined side yard setback of at least 25 feet. ADDITIONAL INFORMATION: The survey lists the applicant's neighbors as the County of Suffolk. Site inspection showed that both neighboring lots are vacant parcels. In response to the LWRP Coordinator's comments, the applicant's representative submitted a proposed floor plan with a letter dated December 20, 2018, indicating that the existing bedroom plan is five bedrooms and that no additional bedrooms will be added. During the hearing, the applicant's representative enumerated two similar variances for side yard setbacks and lot coverage issued to neighbors; #6743 dated 2014 and#5516 dated 2004. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance(s) will/will not produce an undesirable change in the character of the nbighborhood or a detriment to nearby properties. The neighborhood consists of single family waterfront homes. The existing home is the second to last home on Pipes Neck Road which is a dead end street. The applicant is proposing to make a modest second floor expansion of an older home while keeping the existing footprint. The applicant's side yard neighbors are vacant lands owned by Suffolk County which will never be developed. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is proposing a second story addition within the existing footprint of the dwelling. None of the dimensional setbacks are changing. Any additions and alterations will require the benefit of an area variance. 3. Town Law X267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 40% relief from the code for the non-conforming side yard setback, 50% relief from the code for the combined side yard setback, and 12 % relief from the code for the non-conforming lot coverage. However, the existing footprint of the home is not changing and the dimensional setbacks for the home will remain the same. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. However, since the proposed additions and alterations are substantial, and the subject property is in close proximity to Pipes Cove, a high value marine wetland, the LWRP report recommends that the existing sanitary system be upgraded to an I/A on site wastewater treatment system. The applicant must also comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated dwelling with expanded second story while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman, and duly carried, to GRANT the variances as applied for, and shown on the Architectural Plans prepared by Anthony M. Portillo, R.A., labeled SP 100- A-100 -300, and dated August 27, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to receiving a building permit, the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s) will immediately contact the Building Department if a demolition, as defined by Section 280-4 of the Town Code,' occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing, to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. 2. The applicant shall upgrade the existing sanitary system to an UA on site wastewater treatment system as approved by Suffolk County Department of Health. 3. This approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. . In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. ' Section 280-4 of the Town Code defines "Demolition" as any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal. This parcel contains a total lot area of 14,500+- sq. ft. and is located in the R-80 Zone District. By this application, appellants have requested approval of a 10 ft. deep by 37+- ft. long open (one-story) deck addition at the southerly (waterview) side of the house, plus a four-ft. deck extending approximately 11 ft. in a north-south direction, all as shown on the two sketched diagrams prepared by the applicants for consideration. The sketches show the side deck to be set back at eight (81 ) feet from the' westerly side property line, and show the rear deck to be 67 feet from the highwater mark along Pipes Neck Creek (and 30 feet to the existing landscape ties landward of the edge of Pipes Neck Creek. at 42 feet from the closest bulkhead at the top of the bluff. The setback at the easterly side yard from the new deck will remain nonconforming at five feet (maintaining the existing setback) . 3. It is noted for record purposes that the deck was built about two years ago (without a building permit) . The accessory shed structure was also built (without a permit) , but was rebuilt to replace an existing structure. {See photos submitted for consideration). 4. Article XXIV, Section 100-239.4B requires all buildings located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back not less than seventy-five feet from the retaining structure. 5. Article III, Section 100-33 requires accessory buildings and accessory uses to be located in the rear yard. The rear yard for this property is technically that area seaward of the existing dwelling. 6. Article XXIV, Section 100-244B requires a minimum side yards at 10 and 15 feet, and an increase or expansion of other established nonconforming setbacks require a variance. 7. The amount of relief requested by this application is 10 feet for the deck at the southerly end and 5 feet at the easterly side yard. It should be noted that the setback of the deck to the highwater mark along the creek is shown to be more than the required 75 feet. 8. To locate the accessory shed in the required rear yard rather than landward of the house would encourage construction closer to the creek and beach area, which is not more feasible under the circumstances for environmental purposes.
